ČLÁNEK 1 - EUROVIZNÍ SOUTĚŽ MLADÝCH TANEČNÍKŮ
1.1)
Popis
1.1.1)
Koprodukce EBU
Eurovizní soutěž mladých tanečníků (Eurovision Young Dancers, dále jen "EYD") je mezinárodní koprodukce členu EBU v oblasti
kombinace klasického a moderního tance, která je pořádána pod záštitou Evropské vysílací unie (European Broadcasting Union ,
dále jen "EBU") jako součást výměnného televizního programu známého pod názvem Eurovize.
Právo přihlásit se do EYD a účastnit se ho mají pouze členové EBU. Maximální počet zúčastněných vysílajících organizací je
uveden v harmonogramu.
Aktivní členové, kteří byli přijati k účasti v EYD, budou dále označováni jako „zúčastnění vysílatelé”.
1.1.2)
Obsah/Formát
EYD bude tvořena jedním pořadem, kde soutěžící přihlášeni zúčastněnými vysílateli,aby reprezentovali svoje země, budou
postupně tančit před porotou, která bude posuzovat jejich výkony, a před živým publikem.
Prvních 14 tanečníků bude jednotlivě tančit sólový tanec. Poté, co všichni tanečníci odtančí své sólové tance, budou rozděleni do
dvou skupin (každá skupina se bude skládat maximálně ze sedmi tanečníků) a obě tyto skupiny budou tančit tentýž skupinový
tanec. Choreografii skupinového tance vypracuje choreograf, který bude pro tuto příležitost speciálně pozván ("choreograf").
Nakonec dva nejlepší tanečníci, které vybere porota, zatančí závěrečný tanec.
Pořad bude patřit mezi současnou přední televizní produkci. Bude ho nahrávat, vyrábět a vysílat hostitelský vysílatel (viz
harmonogram akce) a bude zpřístupněn přes satelitní síť Eurovision,aby ho mohli vysílat zúčastnění vysílatelé.
Hlavní název pořadu je "Eurovizní soutěž mladých tanečníků ", následovaný rokem konání. Tento název budou používat všichni
vysílatelé, i když mohou namísto něho použít překlad tohoto názvu do jejich tuzemského jazyka, pokud ho odsouhlasí výkonný
supervizor EBU. Pokud je překlad schválen, hlavní název nemusí být použit. Vysílatelé také smějí k hlavnímu názvu přidat i
vedlejší název, pokud použijí pojmenování, pod kterým je EYD v posledních letech v příslušných zemích známá.
O pořadí soutěže a pořadí vystoupení sólových tanců bude rozhodovat hostitelský vysílatel. Pořadí bude podléhat schválení
výkonného supervizora EBU a Řídící skupiny EYD (skupina zástupců členů EBU ). O rozdělení tanečníků na skupinový tanec bude
rozhodovat choreograf po poradě s řídící skupinou. Pořad bude probíhat na jevišti, v angličtině, pod vedením mezinárodního
komentátora. K mezinárodní verzi pořadu může být přidán národní komentář komentátorů jmenovaných každým ze zúčastněných
vysílatelů, aby mohl být vysílán v příslušných zemích,pokud je tento požadavek vznesen před uplynutím lhůty pro komentátory.
EYD je nepolitický zábavný program. Za žádných okolností se zde nesmí vyskytnout nějaký přímý nebo nepřímý výrok politického
rázu.
1.1.3)
Proces výběru soutěžících do pořadu
Každý zúčastněný vysílatel vyšle níže popsaným způsobem před uplynutím lhůty pro soutěžící tanečníka, aby se zúčastnil EYD,
a spolu s ním pošle materiály uvedené v harmonogramu dodání. Národní kolo je organizováno na výhradní odpovědnost
dotyčného zúčastněného vysílatele.
Národní kola mohou být vysílána v televizi, pokud si to přejí zúčastnění vysílatelé. Pokud je národní kolo vysílané v televizi,
nastoupí vítěz tohoto národního kola do soutěže jakožto soutěžící za zemi zúčastněného vysílatele.
Pokud národní kolo není vysílané v televizi, navrhne zúčastněný vysílatel dva tanečníky, kteří by se mohli účastnit EYD.
Choreograf potom libovolně rozhodne, který ze dvou navržených tanečníků se EYD bude účastnit. Rozhodnutí bude sděleno před
uplynutím lhůty pro registraci a bude konečné a závazné.

1.2) Kritéria způsobilosti
1.2.1)
Soutěžící
a) Všichni soutěžící navržení na účast v EYD musejí být ve věku od 16 do 21 let v roce konání EYD.
b) Soutěžícími budou buď občané státu zúčastněného vysílatele, prostřednictvím kterého do EYD vstupují, nebo budou občany
tohoto státu po dobu nejméně dvou let před svou účastí v EYD.
c) Do soutěže mohou vstupovat tanečníci, kteří tuto činnost nevykonávají na profesionální úrovni. Účastníci by měli být členy
uznávané taneční instituce a měli by mít základní dovednosti v oblasti klasického/moderního baletu.
d) Vítězové z minulých ročníků EYD se nesmějí účastnit EYD nebo jejích příštích ročníků.
e) Finalisté EYD se nebudou smět účastnit dalších ročníků EYD.
1.2.2)
Vystoupení
Všichni tanečníci, kteří budou v pořadu vystupovat, musejí být předem schváleni výkonným supervizorem EBU a Řídící skupinou.
a)
Každý soutěžící bude během pořadu tančit jeden sólový tanec. Maximální povolená délka bude 1 minuta 30 sekund. Hudba
pro sólový tanec a styl sólového tance mohou být vybrány libovolně. Tanečníci jsou podporováni v tom, aby si vybírali hudbu
širokého rozsahu a různé styly tance. Kvalita hudby, která má být pro tanec použita, musí umožňovat výkon na vysoké úrovni v
souladu s očekáváními kladenými na zábavný televizní program na špičkové mezinárodní úrovni.
Výkonný supervizor EBU si po poradě s Řídící skupinou a výkonným producentem vyhrazuje právo požadovat úpravy
vystoupení (jako zkrácení vystoupení v případě, že překročí povolenou délku, a/nebo změnu hudby a/nebo provedení změn v
choreografii na žádost choreografa).
Každý zúčastněný vysílatel tímto bere na vědomí, že přijetí sólových tanců do pořadu nadále podléhá konečnému schválení
výkonného supervizora EBU a Řídící skupiny.
b) Skupinového tance se budou účastnit soutěžící, kteří budou rozděleni do dvou skupin po sedmi tanečnících. Choreografii
skupinového tance bude vytvářet choreograf. Tento skupinový tanec nebude soutěžícím oznámen před týdnem konání akce a
soutěžící ho budou během tohoto týdne zkoušet.
c)
Závěrečný tanec budou tančit pouze dva tanečníci, kteří od poroty obdrží nejvíce bodů. Závěrečný tanec bude obsahovat
prvky jak sólového, tak skupinového tance.
1.3)
Porota
1.3.1)
Složení
Hostitelský vysílatel jmenuje porotu, aby hlasovala v pořadu. Porota musí splňovat následující kritéria:
•
•
Bude se skládat ze tří osob.
Tyto tři osoby budou profesionálové v tanečním oboru a každý z nich by měl být odborník na jinou oblast tance, aby
pokryli různé taneční styly. Musí pocházet z různých zemí, aby byla zajištěna rozmanitost.
•
Mezi členy poroty musí být rovnováha, aby byla zajištěná dostatečná representativnost z hlediska pohlaví, věku a
společenského původu.
Nikdo z porotců nesmí být žádným způsobem spojený s žádným ze zúčastněných tanečníků a/nebo umělců účinkujících v
EYD, aby byla zajištěna naprostá nezávislost při hlasování a nestrannost porotců.
Konečné složení poroty schválí Řídící skupina.
1.3.2)
Postup hlasování
Na začátku týdne konání akce zorganizují výkonný supervizor EBU, hostitelský vysílatel a choreograf meeting se členy poroty, aby
je stručně informovali o postupu hlasování a aby stanovili cíle EYD. Porota bude přítomná na generální zkoušce a během pořadu.
Po každém představení sólových a skupinových tanců v pořadu vyjádří každý člen poroty v pořadu svůj dojem z představení, aby
publikum a diváci u obrazovek lépe chápali postup výběru.
Členové poroty budou kromě toho udělovat body na základě následujících kritérií:
•
Dodržování choreografie
•
Kvalita tanečního vystoupení a uměleckého vyjádření
•
Schopnost tanečníka přizpůsobit se novým tanečním stylům (bude použito pro skupinový tanec)
Nebude povoleno zdržet se hlasování. Každý člen poroty bude udělovat body každému z deseti tanečníků. V této fázi ale udělené
body ještě nebudou oznamovány veřejnosti. Po předvedení všech sólových a skupinových tanců bude výkonný supervizor EBU
zodpovědný za sběr hlasovacích lístků od všech členů poroty.
Dva tanečníci, kteří na konci těchto dvou tanečních kol získali nejvíce bodů, budou vyhlášeni za finalisty EYD a budou spolu
účinkovat v závěrečném tanečním duelu pořadu.

Členové poroty potom budou podle výše uvedeného postupu udělovat body každému z tanečníků za dané vystoupení. Tanečník,
který dostane od poroty nejvíce bodů, bude vyhlášen vítězem EYD.
1.3.3) Postup v případě nerozhodného výsledku
Pokud by dva nebo více tanečníků dostalo od poroty úplně stejný počet bodů, přezkoumají členové poroty situaci a ještě jednou
stejným způsobem, aby určili, kteří tanečníci budou vybráni za finalisty. V případě, že se porotci nedohodnou, budou finalisté
jmenováni po poradě s choreografem. Stejný postup se použije v případě nerozhodného výsledku mezi finalisty, aby byl vybrán
vítěz EYD.
ČLÁNEK 2 - PRÁVNÍ A FINANČNÍ USTANOVENÍ
2.1)
Postup podání žádosti
Způsobilost členů
2.1.1)
Způsobilými k účasti v EYD jsou pouze televizní vysílatelé, kteří jsou členy EBU, a jsou tedy oprávněni podat příslušnou žádost.
2.1.2)
Postup
Před uplynutím lhůty pro sdělení (viz Harmonogram akce), sdělí EBU svým členům, kteří mají zájem o účast v EYD,jaká by byla
výše jejich účastnických poplatků. Tato výše bude stanovena po poradě s Řídící skupinou.
Všichni členové EBU, kteří mají zájem o účast v EYD, musí vyplnit formulář potvrzení o účasti připojený k tomuto dokumentu, a to
před uplynutím lhůty pro podání žádosti (viz harmonogram akce) dle níže uvedených pokynů.
Členové EBU přijatí za zúčastněné vysílatele mohou bez vzniku jakékoliv finanční pokuty odstoupit před uplynutím lhůty pro
odstoupení (viz harmonogram akce). Aniž by tím byla narušena jakákoliv sankce, kterou lze aplikovat dle ustanovení článku 2.6
níže, v případě, že po uplynutí lhůty pro odstoupení vysílatel odstoupí nebo je diskvalifikován z důvodu nedodržení těchto
pravidel, bude i nadále povinen uhradit 100 % výši svého konečného účastnického poplatku.
Konečné účastnické poplatky stanoví výkonný supervizor EBU a sdělí je zúčastněným vysílatelům nejpozději před uplynutím lhůty
pro oznámení (viz harmonogram události).
Za kterékoli z výše uvedených okolností se může výkonný supervizor EBU i nadále svobodně rozhodnout, jestli vymění nebo
nevymění zúčastněného vysílatele, kterého diskvalifikoval nebo stáhl jiný člen EBU, pokud je to stále v souladu s harmonogramem
pro přípravu pořadu.
2.4.2)
Závazky zúčastněných vysílatelů
Tím, že přihlásí tanec do EYD a podepíše formulář potvrzení o účasti, každý zúčastněný vysílatel:
a) akceptuje tato pravidla (včetně dodržování všech požadavků a lhůt uvedených v přiložených přílohách), která se vztahují na
Eurovizní soutěž mladých tanečníků jako celek; a
b) potvrzuje, že jeho závazek účastnit se Eurovizní soutěže mladých tanečníků zůstane platný ve všech svých aspektech, a to i
tehdy, když v hostitelském městě a/nebo hostitelské zemi dojde ke změnám a/nebo když je organizace a produkce soutěže
zajišťována jiným hostitelským vysílatelem než tím, který je uveden v harmonogramu akce; a
c) zavazuje se, že se nezapojí do žádné akce nebo chování, nebo nedovolí jiné osobě, nad kterou má kontrolu nebo za kterou je
podle současných pravidel zodpovědný,aby se zapojila do takové akce nebo chování, které by mohlo zdiskreditovat EYD nebo
EBU; a
d) zavazuje se navrhovat soutěžící v souladu se současnými pravidly před uplynutím lhůty pro soutěžící a zorganizovat národní
proces výběru tak, jak to považuje za vhodné, a na svou výhradní odpovědnost; a
e) zavazuje se jmenovat vedoucího delegace před uplynutím lhůty pro jmenování vedoucího delegace, který bude jednat jako
kontaktní osoba mezi výkonným supervizorem EBU a/nebo hostitelským vysílatelem a který bude takto plně zodpovědný za
všechny aspekty související s účastí jeho organizace v EYD, a zejména za:
-
f)
monitorovat všechny aspekty vstupu soutěže na národní úrovni, včetně včasného dodávání materiálů, které požaduje
výkonný supervizor EBU a hostitelský vysílatel;
zajišťovat dodržování těchto pravidel;
být (i) zodpovědný za svou národní delegaci, která se bude skládat maximálně z 15 akreditovaných osob, a (ii) být
zodpovědný za osobní bezpečnost svých soutěžících a (iii) být zodpovědný za dohled na soutěžící v průběhu EYD; a
bude zodpovědný za žádosti o akreditaci pro novináře a fanoušky z jeho země, v souladu s instrukcemi od EBU a
g) zajišťovat, aby:
-
jeho delegace a umělci dorazili včas do města, kde se koná EYD, aby se mohli účastnit první zkoušky na jevišti (detailní

akce (viz přesné datum harmonogramu akce)
jeho delegace bydlela v jednom z oficiálních hotelů , které určí hostitelský vysílatel a/nebo EBU;
jeho soutěžícího po celou dobu trvání akce doprovázela osoba poskytující oporu (například člen rodiny nebo učitel).
Vedoucí delegace bude zodpovědný za to, aby osoba poskytující oporu jeho soutěžícímu nadměrně nezasahovala do
průběhu produkce.
h) zajistí, aby jeho komentátoři respektovali atmosféru a spravedlivost soutěže. Komentátoři nebudou dělat gesta nebo používat
výroky politického, komerčního nebo jiného rázu, používat nadávky nebo jiné nepřijatelné jazykové projevy, a/nebo vznášet
jakékoli sexistické, rasistické nebo jinak nadměrně diskriminující připomínky na adresu umělců nebo tanců. Komentátoři
nebudou mluvit v průběhu vystoupení jednotlivých tanečníků. Komentátoři budou nestranní a v žádném případě se nebudou
zapojovat do vytváření choreografie jakéhokoli z tanců účastnicích se EYD; a
i)
zavazuje se maximálně usilovat o to, aby propagoval své národní kolo a EYD
-
j)
ve svých tuzemských médiích, včetně propagačního traileru EYD a/nebo reportáže o novinkách
na tuzemské webové stránce EYD věnované jeho národnímu kolu nebo specializované webové stránce v rámci
jeho hlavní webové stránky (nepovinné). V mezích všech příslušných národních pravidel a předpisů také zřídí na
tuzemské webové stránce nebo jiné specializované stránce link k oficiální webové stránce EYD - www.youngdancers.tv
Kromě toho každý zúčastněný vysílatel na svých internetových stránkách za účelem zajištění transparentnosti zveřejní
pravidla týkající se postupu jeho národního výběru. Po národním kole zveřejní zúčastněný vysílatel rovněž úplný přehled
o splnění těchto pravidel a kritérií.
bere na vědomí, že během týdne konání akce bude mít výkonný supervizor EBU právo činit rozhodnutí na poslední chvíli,
pokud to tak bude vyžadovat produkce, a interpretovat stávající pravidla, pokud budou tato rozhodnutí následně nahlášena
Řídící skupině.
2.3 Získání práv
2.3.1
Práva, oprávnění a závazky každého zúčastněného vysílatele
Jako podmínka pro účast v EYD a za účelem propagace EYD musí každý zúčastněný vysílatel zajistit, aby autor(ři) hudby,
skladatel(é), umělec(umělci), majitelé děl (audio) nahrávek a majitel(é) případných dalších práv vybrané doprovodné
hudby/nahrávek, každý autor, choreograf tance a každý případný držitel práv týkající se doprovodné hudby nebo tance udělil
níže uvedená převoditelná práva (pokud povolení používat takováto práva je získáno od inkasující společnosti):
a) Vysílací práva: Toto jsou celosvětová výlučná práva na dobu neurčitou nahrávat a vysílat živě (audio i vizuálně) taneční
představení v pořadu (včetně každé generální zkoušky) a potom současně neomezeně vysílat nahrávku pro veřejnost na
soukromých i veřejných místech pomocí jakýchkoli technických prostředků (jako pozemní vysílače, satelit, drát, kabel, vlákno,
telefonní linky, široké pásmo, internet a mobilní telefony) nebo jakákoli následná kombinace (včetně simultánní, nezkráceného
a nezměněného opakovaného přenosu pomocí takovýchto prostředků), v jakékoli technické normě (jako analogové, digitální
nebo vysoké rozlišení), pro přijetí a zobrazení na jakémkoli typu zařízení (jako televizní sety, obří obrazovky video stěny,
počítačové obrazovky, kapesní počítače, přenosná zařízení a mobilní telefony), a to bez ohledu na způsob financování služby,
ať už zdarma nebo za úplatu.
Je zřejmé, že uplatňování těchto práv také umožňuje živý přenos a/nebo přenos pořadu a generálních zkoušek ze záznamu
a/nebo celý či částečný přenos pořadu a generálních zkoušek na vyžádání nebo jiné zpřístupnění (využití na vyžádání zdarma
nebo za úplatu) živého vysílání (audio i audiovizuálního) tanečního vystoupení v pořadu (včetně vysílání generálních zkoušek),
pomocí některého z výše uvedených prostředků.
b) Práva týkající se veřejných vystoupení: toto jsou celosvětová výlučná práva na dobu neurčitou prezentovat vysílání pořadu
a následné nahrávky (včetně generálních zkoušek), a to zcela nebo zčásti, a všechny sestřihy národních kol (pokud existují),
na bázi živého vysílání nebo vysílání se záznamu na všech veřejných místech (jako kina, divadla a veřejná vystoupení), ať už
za účastnický poplatek nebo bez něho, v neomezeném počtu.
c)
práva na DVD kompilace a digitální vydávání: Toto jsou celosvětová práva nutná vydávání audiovizuálních nahrávek
pořadu (i generálních zkoušek) včetně všech tanců předváděných v pořadu a během generálních zkoušek jakožto součásti
DVD (nebo podobných nosičů) EYD a jiných produktů digitálních médií, ať už jednotlivě nebo vcelku. DVD a jiné produkty
digitálních médií EYD mají vydat po celém světě stálé služby EBU Permanent Services nebo třetí strana jmenovaná jenom
stálými službami EBU.
d) Práva k sestřihům: Toto jsou nevýlučná celosvětová práva na dobu neurčitou vkládat zvukové nahrávky nebo videonahrávky
vysílání vybraného tance jako část pořadu nebo část generálních zkoušek i jakékoli části pořadu,vcelku nebo části, do
jakýchkoli jiných mediálních služeb nebo produktů EYD poskytovaných zúčastněnými vysílateli a/nebo EBU jménem jejích
členů i do jiného audiovizuálního díla nebo jiných mediálních služeb poskytovaných třetími stranami.
e) Práva týkající se sestřihu z národního kola: Toto jsou celosvětová nevýlučná práva na dobu neurčitou, vkládat sestřihy z
vysílání každého národního kola vysílaného v televizi, které by mohli režírovat zúčastnění vysílatelé,vcelku nebo zčásti, do
pořadu, aby mohlo být vysíláno a/nebo zpřístupněno jiným způsobem (včetně možnosti na vyžádání) pomocí jakýchkoli
technických prostředků (včetně internetu). Pokud programy národního kola vysílané v televizi obsahují vystoupení celebrit,

kvůli kterým není možné očistit práva v potřebném rozsahu podle této smlouvy, potom vystoupení této celebrity nebudou do
vysílání zahrnuta.
f)
Komentátoři: toto jsou práva používat komentáře komentátorů ve všech médiích (včetně internetu) a/nebo na jakoukoli
podporu, včetně samostatného soundtracku na DVD (nebo podobných nosičích).
g) Propagační materiál: Toto jsou práva používat, množit, tisknout a zveřejňovat jméno, podobu, hlas, fotografie a životopis
všech umělců a jiných majitelů práv v souvislosti s propagací, vysíláním a/nebo komerčním využitím pořadu všemi prostředky a
ve všech médiích, ať už známých teď nebo vyvinutých později, po neomezenou dobu. To zahrnuje použití fotografií pořízených
na zkouškách a audiovizuálních materiálů ze "zákulisí" pro potřeby DVD, oficiálních webových stránek EYD nebo jiných
mediálních produktů EYD a použití záběrů nebo jiných filmů a fotografií, pořízených na generálních zkouškách a/nebo během
tiskových konferencí pro některé z výše uvedených účelů.
h) Tiskové konference: Toto je příslib umělců, že souhlasí s účasti na tiskových konferencích, pokud to od nich bude žádat EBU,
a příslib povolit použití jakékoli nahrávky, která zde vznikla, ve všech médiích (včetně internetu) bez časového omezení a
použití takovýchto materiálů na DVD EYD.
i)
Souhlasy: Soutěžící nebo tam, kde je to vhodné,jejich rodiče/doprovázející osoby budou požádáni každým ze zúčastněných
vysílatelů, aby dali souhlas k použití nahrávky jakéhokoli vystoupení, které se konalo v průběhu týdne konání akce, všemi
prostředky a ve všech médiích,ať už známých nebo vyvinutých později, na neomezenou dobu. K takovému použití musí dojít
mimo jiné na internetu a může být součásti DVD EYD a může se také vztahovat k propagaci vysílání a/nebo komerčnímu
využití EYD jakoukoli ze stran zapojených do EYD.
Všichni soutěžící (nebo tam, kde je to vhodné, jejich rodiče nebo doprovázející osoby) budou požádáni zúčastněnými vysílateli
z dotyčné země, aby dali souhlas k:
K tomu, že se nechají filmovat během týdne konání akce, s ohledem na zahrnutí materiálů filmovaných jako vsuvky do
pořadu (pro použití podrobně popsané v současných pravidlech) a/nebo v programech na EYD, které mají vysílat jakákoli
média pomocí jakýchkoli prostředků (včetně webové stránky EYD);
Využití množení, tisku a zveřejňování jména, podoby, hlasu, fotografií a životopisů soutěžícího v souvislosti s propagací,
vysíláním a/nebo komerčním využitím EYD.
Souhlasy, které mají být získány podle tohoto odstavce, mají být uděleny pro celosvětové využití pomocí všech prostředků a ve
všech médiích, ať už známých nebo vyvinutých později,a na neomezenou dobu.

2.3.2)
Záruka/odškodnění
Všichni zúčastnění vysílatele zajistí, aby nesli výhradní odpovědnost za svůj vztah s umělci a dalšími stranami v souvislosti se
svým národním kolem a aby nedocházelo ke vzniku nároků týkajících se organizace, přípravy nebo vysílání EYD ze strany EBU
nebo jakýchkoliv jejích členů. Aniž jsou dotčeny případné sankce, které mohou být uplatněny podle článku 2.6, každý zúčastněný
vysílatel odškodní všechny ostatní příslušné organizace a EBU proti všem nárokům, ať už vzniklým ze strany autorů, skladatelů,
umělců, vydavatelů, režisérů, manažerů, hlavních vlastníků nahrávek doprovodné hudby nebo jakýchkoli jiných osob nebo jednotek
v souvislosti s choreografií a/nebo některým z vysílání nebo jiných využití doprovodné hudby a vystoupení tanečníků podle těchto
pravidel.
2.4
Využívání/udělení práv
2.4.1
Povinnosti zúčastněných vysílatelů týkající se vysílání
a)
Vysílání pořadu
Každý zúčastněný vysílatel musí vysílat pořad buď živě, nebo ze záznamu v plném rozsahu na jednom ze svých hlavních
národních pozemních kanálů. Vysílání pořadu je povinné.
b)
Znělka a logo Eurovize
Všichni vysílatelé budou vysílat znělku a logo Eurovize a příslušné logo EYD na začátku a na konci pořadu. Její trvání bude
podléhat schválení stálých služeb EBU.
2.4.2)
Práva zúčastněných vysílatelů
a)
Udělení práv
Všem zúčastněným vysílatelům budou udělena tato práva na jejich vlastním území:
(i)
Pro pořad:
Kromě neustálého dodržování těchto pravidel (včetně opatření týkajících se značky a sponzorování/marketingu, pokud existuje),
výhradní právo:
•
•
Vysílat na lineární bázi (živě nebo ze záznamu) neomezeně do příští EYD, (vystoupení celebrit možná budou muset být
vyňata pro vysílání ze záznamu, které se koná 30 dnů po pořadu, v tomto případě bude výkonný supervizor EBU informovat
zúčastněné vysílatele)
na jejich hlavním nebo vedlejším pozemním kanálu(včetně nezkráceného, nezměněného a simultánního
převzatého vysílání kabelem nebo satelitem);
na rádio, digitální nebo satelitní kanály, které jsou plně v jejich vlastnictví (v souladu s pravidly EBU o sdílení
signálu Eurovize);
na webové stránce, která je výhradně v jejich vlastnictví, jenom národní verze a za předpokladu,že online
přenos je nezměněný, nezkrácený a paralelní s vlastními národními vysíláními zúčastněných vysílatelů pořadu
na jejich pozemních kanálech. Každý přenos bude navíc dodržovat rozsah povolený vnitrostátními právními
předpisy, s týmiž požadavky na sponzorování jako ostatní vysílání (pozemní, kabelové a satelitní);
prostřednictvím mobilních telefonů za předpokladu, že se takovéto vysílání skládá ze simultánního,
nezměněného a nezkráceného převzatého vysílání národních vysílání zúčastněných vysílatelů pořadu na
jejich pozemních kanálech.
na jejich všestranně zaměřených kanálech v jejich 100% vlastnictví paralelně s národními vysíláními
zúčastněných vysílatelů pořadu na jejich pozemních kanálech bez jakýchkoli redakčních změn (např. včetně
komentáře). Takovýto všestranně zaměřený mezinárodní kanál nebude obsahovat žádná okna zaměřená na
příslušnou zemi nebo skupinu zemí. Nebude obsahovat ani reklamu zaměřenou na konkrétní stát nebo
skupinu států a její program bude nejméně z 80 % shodný s původním programem a bude co nejvíce
odpovídat původnímu časovému harmonogramu. Kanál musí dále vysílat ve stejném jazyce (jazycích) jako
národní programová služba.
Zpřístupnit na nelineární bázi maximálně na 30 dnů po vysílání pořadu
na jejich obvyklé dodatečné služby v jejich výhradním vlastnictví na streamování na vyžádání (bez možnosti
stahovat) nebo pro dočasné stahování (jako podle obecné politiky zúčastněných vysílatelů) pomocí jakýchkoli
prostředků (včetně mobilních telefonů a internetu).
Národní verze nebo editované verze jsou povolené, pokud není narušena celistvost soutěže a pokud nejsou vystřižena taneční
vystoupení.

(ii)
Pro sestřihy z pořadu
Nevýlučné právo používat sestřihy z pořadu (kromě některých vystoupení celebrit) v jakémkoli z jejich programů pro použití
jakýchkoli médií následovně:
-
V průběhu 12 měsíců po dni konání pořadu, neexistuje žádné omezení v celkové délce trvání zařazení sestřihů, pokud
není použita více než jedna minuta ukázek z jakéhokoli vystoupení a není vyřazeno žádné vystoupení celebrity.
-
Tato práva jsou poté bez jakéhokoliv časového omezení omezena na celkovou dobu trvání v délce osm minut (přičemž
ukázka z každého vystoupení nesmí přesáhnout jednu minutu).
Nevýlučné právo, v mezích stanovených podle tohoto pododstavce, prodávat jakýkoli záznam z pořadu za účelem zařazení do
jakéhokoli televizního programu jakékoli třetí strany pouze v rámci jejího území. Jakékoli porušení tohoto pravidla může vyústit v
diskvalifikaci zúčastněného vysílatele z pořadu a/nebo v odepření vstupu do vysílání a/nebo vyloučení z dalších vydání pořadu.
Zúčastnění vysílatelé, kteří si přejí začlenit jakýkoli materiál z pořadu jiný než výše zmíněné sestřihy do jakéhokoli ze svých
programů, by měli napřed získat písemný souhlas EBU.
b)
Porušování třetími stranami
Každý zúčastněný vysílatel má neomezenou možnost uplatňovat/dovolávat se všech práv, a zvláště autorského práva a vedlejších
práv, která mu náležejí v rámci jeho národní legislativy, kromě práv platných v rámci EBU, s ohledem na zabraňování nebo
zakazování neoprávněného užití jeho vlastního vysílání pořadu nebo jakýchkoli částí takovýchto vysílání, jako jednotlivých scén
nebo obrázků nepovolanými třetími stranami na jeho území.
2.4.3)
a)
Práva a povinnosti EBU
Udělení práv
EBU výhradně řídí veškerý centralizovaný marketing a využití EYD. EBU bude vlastnit zejména (a lze předpokládat, že bude
udělovat) následující převoditelná práva na celosvětové bázi:
Pro pořad
Právo po neomezenou dobu a v neomezeném počtu:
•
Vysílat na lineární bázi (v přímém přenosu/živě nebo ze záznamu) a umožňovat přístup na nelineární bázi, vcelku nebo zčásti,
na internetu a/nebo přes mobilní telefony a/nebo jiná přenosná zařízení (včetně jakýchkoli a všech oficiálních platforem EYD
jako například oficiální webová stránka EYD, Facebooková stránka akce, účet na Twitteru, kanály YouTube a podobné
platformy, atd.)
b)
Distribuce/Udělování licencí
Aniž jsou dotčeny ostatní předpisy v tomto odstavci, všechna vysílací a jiná práva k tomuto pořadu, jakékoli záznamy nafilmované
během akce a EYD (včetně práv v tomto formátu) výhradně vlastní EBU, aby je mohla centrálně spravovat jménem zúčastněných
vysílatelů. Výkonný supervizor EBU bude v případě potřeby ve spolupráci s agentem zodpovědný za koordinaci všech prodejů
materiálů z pořadu (včetně záznamů nafilmovaných v průběhu akce), vcelku nebo zčásti, nezúčastněným vysílatelům ze zemí, kde
třetí strany mohou získat práva, aby získal finanční prospěch pro zúčastněné vysílatele a hostitelského vysílatele. EBU bude mít
právo si ponechat 15% příjmů vzniklých z takovýchto prodejů.
Není-li použito žádné pravidlo z tohoto odstavce, nesmějí nezúčastnění vysílatelé vysílat žádný materiál z pořadu (zkoušky,
přípravy, atd.) bez předchozího písemného souhlasu EBU, a aniž by EBU zaplatili případné poplatky za práva. Žádná komerční
nebo nekomerční jednotka nebude používat logo nebo jiné charakteristické prvky EYD nebo pořadu bez předchozího písemného
souhlasu EBU.
i)
Pro pořad
Televize
Nezúčastnění televizní vysílatelé ze zemí, kde je využití těchto práv možné, mohou získat právo vysílat pořad na svém území,
pokud zaplatí poplatek za práva. Ve státech, kde je využití těchto práv možné, mají nezúčastnění členové EBU právo první volby
týkající se nákupu programů pro své území a toto právo uplatí do lhůty stanovené EBU. Nezúčastnění vysílatelé ze zemí, kde je
využití těchto práv možné, se s ohledem na to, jaké vybavení mají k dispozici, mohou také dožadovat práva vyslat do pořadu
komentátora, a/nebo produkční tým.
Přístup ke zprávám
Jakýkoli vysílatel, který nemá žádná audiovizuální mediální práva, na žádost obdrží od EBU nový přístup ke zprávám z pořadu v
celkové délce (nebo, pokud o to požádá, tak i ke generální zkoušce), zdarma pro využití v pravidelném vysílání všeobecných zpráv
do 24 hodin od skončení pořadu.

(ii)
Pro sestřihy
EBU bude mít právo udělovat licence v souvislosti se všemi sestřihy z pořadu a/nebo z jakýchkoli záznamů nafilmovaných v
průběhu akce třetím stranám, aby je mohly přidat do jakýchkoli vizuálních děl nebo mediálních produktů a služeb. EBU má také
právo prodávat jakékoli záznamy z pořadu jakékoli třetí straně v rámci území zúčastněného vysílatele, pokud výkonný supervizor
EBU obdrží žádost přímo od této třetí strany nebo pokud se žádost vztahuje na více než jedno území.
2.5)
Financování
2.5.1)
Náklady financování produkce a inscenace pořadu ponese hostitelský vysílatel a zúčastnění vysílatelé.
2.5.2)
Celkový rozpočet produkce pořadu se obvykle blíží 400,000 €. Celkový konečný rozpočet produkce pořadu navrhne
hostitelský vysílatel, po poradě s výkonným supervizorem EBU a schválí ho Řídící skupina.
2.5.3)
Minimální částka, kterou je nutné zajistit pro účely konání EYD, je uvedena v harmonogramu akce („celkový
příspěvek”). Tento celkový příspěvek bude financován jednotlivým účastnickými poplatky splatnými zúčastněnými vysílateli tak, jak
je stanoveno v platném systému EBU. Z celkového skutečně vybraného příspěvku bude mít EBU právo odečíst své administrativní
náklady a náklady na koordinaci, náklady na oficiální webovou stránku i náklady vztahující se k cenám pro vítěze. Celkový
příspěvek snížený o náklady EBU bude dále označován jako „příspěvek na produkci”.
2.5.4)
Pro účely financování příspěvku uvedeného v článku 2.5.3) výše bude nutné, aby všichni zúčastnění vysílatelé
uhradili svůj konečný účastnický poplatek EBU před uplynutím lhůty pro úhradu (viz Harmonogram akce). Nezaplatí-li vysílatel
příspěvky včas, může být diskvalifikován a/nebo mu může být odepřen přístup do soutěže.
2.5.5)
Hostitelský vysílatel nebude muset platit žádné účastnické poplatky, ale bude platit celkovou částku zbývajícího
rozpočtu určeného pro produkci pořadu, tj. po odečtení příspěvku na produkci.
2.5.6) Náklady na příjem vysílání z eurovizní sítě dále uhradí všichni zúčastnění vysílatelé a ostatní vysílatelé, kteří mají zájem o
příjem vysílání, a to ve shodě se standardními fakturačními postupy provozní divize EBU.
2.5.7) Veškeré výdaje vzniklé kterémukoliv zúčastněnému vysílateli v souvislosti s jeho vstupem do pořadu, jako např. poplatky,
cestovní náklady, náklady na stravování jeho delegace, uhradí v plné výši příslušný zúčastněný vysílatel.
2.6)
Diskvalifikace a sankce
2.6.1
Diskvalifikace
a)
Důvody pro diskvalifikaci:
Tanec může být diskvalifikován z následujících důvodů:
(i)
Pokud existuje důkaz, že umělec, člen delegace nebo komentátor nesplnil požadavky výkonného supervizora EBU nebo
hostitelského vysílatele a může tím způsobit narušení akce a/nebo produkce/přenosu vysílání.
ii)
Pokud umělec / umělci při plánovaném vystoupení postupují jinak, než jak tomu bylo na generálních zkouškách, a tím
způsobí narušení akce a/nebo produkce/přenosu vysílání.
(iii)
Pokud se zúčastněná organizace nebo umělec /(umělci) nějakým způsobem pokusí porušit stávající pravidla v jakémkoli
stádiu přípravy akce EYD včetně národního kola, nebo se něco takového chystá udělat při samotném pořadu.
Pokud má zúčastněný vysílatel po uplynutí lhůty pro odstoupení, ale nejpozději do 15. března roku konání EYD vůči EBU
jednu nebo více nezaplacených faktur, které jsou starší než 240 dní, pokud člen neuhradí do 15 března roku konání EYD
všechny své dluhy vůči EBU, které jsou starší než 90 dnů.
(iv)

b)
Postup
V případě diskvalifikace z důvodů uvedených v 2.6.1) a) (i) do (iii), rozhodne o diskvalifikaci Řídící skupina, na základě
doporučení stálých služeb EBU. Pokud se diskvalifikační procedura týká země reprezentované členem Referenční
skupiny, nebude tento člen smět hlasovat o rozhodnutí o diskvalifikaci nebo se účastnit porad.
(i)
Pokud je o diskvalifikaci tance rozhodnuto do 15 března roku konání EYD, bude zúčastněný vysílatel po získání
písemného souhlasu od Řídící skupiny, mít právo navrhnout jiný tanec a předložit veškeré související materiály k
datu stanovenému Řídící skupinou. Pokud by Řídící skupina odmítla schválit účast jiného tance, bude mít
zúčastněný vysílatel právo odvolat se proti rozhodnutí Řídící skupiny předsedovi televizního výboru do dvou týdnů
ode dne oznámení rozhodnutí.
Pokud je o diskvalifikaci tance rozhodnuto po 15.březnu roku konání EYD, ale před pořadem, dotyčný zúčastněný
vysílatel se nebude účastnit, ale bude povinen zaplatit konečný účastnický poplatek. Navzdory povolenému času
bude mít zúčastněný vysílatel právo odvolat se proti rozhodnutí l předsedovi Televizního výboru a pokud předseda
televizního výboru nebude k zastižení, tak k výkonnému supervizorovu EBU, a to do dvou týdnu od data oznámení
rozhodnutí.
Každé rozhodnutí učiněné v souladu s výše zmíněným postupem bude konečné a závazné a pak už nebude existovat žádný
opravný prostředek.
(ii)
V případě diskvalifikace z důvodů uvedených výše v 2.6.1) a) (iv), učiní rozhodnutí o diskvalifikaci výkonný supervizor EBU.
Do dvou týdnu od data oznámení tohoto rozhodnutí se zúčastněný vysílatel může odvolat k Výkonné radě EBU ,aby učinila
konečné a závazné rozhodnutí. Odvolání bude zasláno doporučeným dopisem prezidentovi EBU a bude uvádět postřehy a
poznámky zúčastněného vysílatele.
2.6.2)
Sankce
a)
Důvody k sankcím
Zúčastněný vysílatel může být sankcionován,a dokonce vyloučen z následujících pořadů,pokud:
i)
nedodržuje stávající pravidla.
ii) odstoupí z pořadu po uplynutí lhůty pro odstoupení.
b)
Postup
Jakékoli sankce vyhlásí televizní výbor na základě doporučení Referenční skupiny.
Sankce budou úměrné poškození nebo újmě způsobené EBU, hostitelskému vysílateli, zúčastněným vysílatelům a/nebo
organizaci nebo pověsti EYD a nahradí způsobenou újmu.
Kromě toho může být zúčastněný vysílatel, který se dopustil porušení, povinen uhradit pokutu ve výši 5 až 10 % (v závislosti na
závažnosti porušení) svého konečného účastnického poplatku. Nikoho nebude možné vyloučit pro více než tři po sobě jdoucí
vydání EYD.
Zúčastněný vysílatel bude mít právo odvolat se proti sankcím k Výkonné radě EBU.
2.7)
Odložení, přesun nebo zrušení pořadu
Zúčastnění vysílatelé berou na vědomí a přijímají skutečnost, že pořad může být odložen a/nebo přesunut do jiného města nebo
země, zejména, ale ne pouze:
a) z důvodů vyšší moci (např. přírodních neštěstí nebo katastrof, válečných činů, terorismu, požáru, povodně, výbuchu přerušení
dodávky veřejných služeb nebo občanských nepokojů nebo nepořádku, rozhodnutí regulatorního nebo jiného kompetentního
úřadu, epidemie, veřejného zdraví nebo skutečné a bezprostřední hrozby vzniku čehokoliv z výše uvedeného, včetně
závažných porušení bezpečnosti účastníků, marketingových partnerů nebo diváků),

b)
z důvodů jiných činů nebo událostí, které jsou mimo přiměřenou kontrolu EBU nebo hostitelského vysílatele a/nebo
c)
z objektivních závažných okolností jiných než důvodů vyšší moci, pokud je podle rozumného přesvědčení EBU,
pravděpodobné, že ovlivnily vysílání nebo příjem signálu pořadu a/nebo plynulý provoz akce EYD, a/nebo pořadu a/nebo
bezpečnost soutěžících a jejich delegací, diváků nebo marketingových partnerů, které na zvoleném místě nadměrně
komplikují organizaci a produkci pořadu. Pro účely těchto pravidel budou tyto události považovány za vyšší moc. EBU jakožto
organizátor akce bude mít bezvýhradní právo přesunout EYD do jiného města nebo země.
V případě takovéhoto odložení a/nebo přesunu, budou práva a povinnosti zúčastněných vysílatelů pro odložený pořad stejná jako v
případě, že by se pořad konal v původně plánovaných termínech, a závazek účastnit se pořadu zůstává v platnosti ve všech svých
ustanoveních. Pokud je pořad odložený a/nebo přesunutý a/nebo se koná jen zčásti, nebudou mít zúčastnění vysílatelé právo
požadovat žádnou úhradu nebo odškodnění.
Pokud pořad zruší EBU, musí být takovéto rozhodnutí o zrušení podpořeno doporučením Řídící skupiny, závazek EBU (v rozsahu,
který není omezen důvody vyšší moci) bude ve všech případech omezen na úhradu částky příspěvku, kterým zúčastnění vysílatelé
přispěli do rozpočtu produkce pořadu (v rozsahu, v jakém už byl tento příspěvek zaplacen k datu zrušení) nižší než režijní náklady
EBU.
EBU není v žádném případě zodpovědná (bez ohledu na to, jestli byl pořad zrušen, odložen nebo se konal jen zčásti) za
poškození, náhradu, úhradu nebo odškodnění jakékoli druhu ušlého výdělku, ať už přímého nebo nepřímého (např. ušlého zisku)
včetně ušlých reklamních nebo jiných komerčních příjmů.
ČLÁNEK 3 - CENTRALIZOVANÉ VYUŽITÍ
EBU je jediným majitelem práv Eurovizní soutěže mladých tanečníků. Všechna práva v EYD a v pořadu výhradně vlastní a
spravuje na centrální úrovni EBU, která je zodpovědná za zisky zúčastněných vysílatelů a hostitelského vysílatele po poradě s
Řídící skupinou, za marketing všech práv na komerční využití na celosvětové úrovni, mezi které bude patřit (mimo jiné ):
Sponzorování akce
Sponzorování vysílání programu pro veškerá vysílání pořadu
Sponzoři uvedení na obrazovce (sponzoři uvedení na grafických světelných tabulích, včetně identifikace poskytovatelů
služeb na obrazovce)
Sponzorování veškerého dění mimo obrazovku
Korporátní sponzoři, VIP a vstřícnost médií
dodavatelé
podpora prodeje a udělování licencí
výstavy
gala večeře
Sponzorování oficiální internetové stránky a práva vztahující se na obsah internetových stránek
veškerý prodej vysílacích práv nezúčastněným vysílatelům
S těmito právy může obchodovat EBU nebo marketingový agent, kterého EBU jmenuje (dále agent EBU), a takto vytvořené příjmy
budou použity při produkci EYD.
Hostitelský vysílatel a zúčastnění vysílatelé budou spolupracovat s výkonným supervizorem EBU na jakémkoli centralizovaném
marketingovém programu, který může být realizován.
Výkonný supervizor EBU bude informovat zúčastněné vysílatele do konce ledna, jestli byl tento centralizovaný
sponzorský program realizován. Marketingoví partneři, které může jmenovat EBU, budou označeni jako "mezinárodní
sponzoři ".
Každý zúčastněný vysílatel poskytne na žádost výkonného supervizora EBU kompletní informace,v jednom nebo dvou oficiálních
jazycích EBU (v angličtině a francouzštině), o právní úpravě sponzorování a směrnic z oblasti reklamy na svém území i jakýchkoli
jiných relevantních interních regulačních opatřeních, která jsou relevantní pro dodávání různých komerčních prvků pořadu (včetně
možnosti vystavovat billboardy a zahrnovat do pořadu sponzory uvedení na obrazovce ) Každý zúčastněný vysílatel bude
neprodleně informovat výkonného supervizora EBU, pokud je pravděpodobné, že by některé právní nebo regulační ustanovení v
jeho zemi nebo některé z jeho vnitřních směrnic mohly bránit realizaci centralizovaných marketingových aktivit, které by měly být
vykonávány ve vztahu k EYD.
3.1)
Centralizované sponzorování akce
Pouze EBU má právo jmenovat marketingové partnery pro akci EYD (bez ohledu na to, zda je nebo není realizován centralizovaný
sponzorský program).
To lze dělat ve spolupráci s agentem EBU. Po poradě s výkonným supervizorem EBU a agentem EBU (pokud existuje) má pouze
hostitelský vysílatel právo zkoumat národní marketingové příležitosti ve své zemi a ty nesmějí být v rozporu s hlavním
mezinárodním sponzorováním nebo dalšími výlučnými smlouvami. Hostitelský vysílatel bude mít právo jmenovat maximálně čtyři
partnery a nebude udělovat žádná práva mimo své národní území. Kromě toho, práva udělená hostitelským vysílatelem svému
národnímu partnerovi budou sekundární povahy (tj. přednost z hlediska viditelnosti dostanou vždy mezinárodní sponzoři).
Zúčastněným vysílatelům však nesmějí být v žádném případě udělována sponzorská práva s ohledem na akci EYD v jejich státě
kromě případů uvedených v článku 3.1.2 a).

V případě realizace sponzorského programu budou zúčastnění vysílatelé spolupracovat s EBU a s hostitelským vysílatelem s
ohledem na centralizovaný marketingový program a budou aktivně propagovat všechna takováto opatření vztahující se k akci EYD.
Každý zúčastněný vysílatel bude chránit výlučnost mezinárodních sponzorů a v této souvislosti nesmí dovolit žádné třetí straně,
aby se jakýmkoli způsobem spojila s akcí EYD.
3.2)
Centralizovaný sponzorský program
Do uplynutí lhůty pro sponzorování si všichni zúčastnění vysílatelé rezervují veškerá práva pro sponzorský program ve svých
zemích na základě výhradních práv pro EBU a nebudou před tímto datem uzavírat žádné smlouvy o sponzorském programu.
Nejpozději jeden měsíc po uplynutí lhůty pro sponzorování bude výkonný supervizor EBU informovat zúčastněné vysílatele zda se
na jejich území vztahuje celoevropská sponzorská smlouva.
a) Zúčastnění vysílatelé nacházející se v zemích, kde neplatí smlouva s celoevropským mezinárodním sponzorským programem,
nebudou moci individuálně požívat práv sponzorského programu k pořadu. Budou moci volně uzavírat smlouvy o sponzorském
programu, ale pouze ve vztahu k vysílání pořadu (bez ohledu na to, zda byl nebo nebyl jmenován sponzor pro mezinárodní akci).
Kromě toho nebudou udělovat práva pro sponzorský program společnostem nebo partnerům, kteří jsou v konkurenčním vztahu s
mezinárodními sponzory, kteří mohli být jmenováni nebo kteří nabízejí výrobky nebo služby, které by mohly být v konkurenčním
vztahu s výrobky nebo službami mezinárodních sponzorů. Než bude prodán jakýkoli balíček sponzorského programu, zažádají
zúčastnění vysílatelé o předchozí písemný souhlas stálých služeb EBU. Stálé služby EBU si vyhrazují právo odmítnout dát
souhlas, pokud takovéto sponzorování působí v rozporu s mezinárodními sponzory, a zúčastnění vysílatelé nebudou prodávat
takovéto balíčky. Kromě toho se žádný národní sponzor nebude smět spojit s akcí EYD nebo prezentovat své národní sponzorství
způsobem, který by mohl vést širokou veřejnost k přesvědčení nebo by mohl působit dojmem, že sponzor je partner spojený s akcí
EYD.
b) Zúčastnění vysílatelé nacházející se v zemích, kde neplatí smlouva s celoevropským mezinárodním sponzorským programem,
budou spolupracovat s EBU, hostitelským vysílatelem a agentem EBU a budou aktivně propagovat takovéto dohody. V těchto
zemích nebudou zúčastnění vysílatelé moci udělovat práva ke sponzorskému programu žádnému národnímu sponzorovi a během
nebo po vysílání pořadu nebudou smět být obsaženy žádné jiné billboardy než billboardy poskytnuté stálými službami EBU nebo
agentem EBU. Marketingoví partneři / dodavatelé nebo agenti EBU's Agent, poskytnou jménem EBU relevantní materiál. To se
vztahuje pouze k pořadu a bude to zahrnovat mimo jiné:
3.2.1)
Umístění sponzorských billboardů na obrazovku/Mezinárodní sponzorování
Tam, kde to vyžadují stálé služby EBU a kde platí příslušné mediální zákony a předpisy, musí každý zúčastněný vysílatel
respektovat všechny dohody o sponzorování, včetně rozmístění a vysílání billboardů, sloganů, krátkých popěvku a značkových
trailerů atd., pro oficiální marketingové partnery nebo dodavatele kolem vysílání pořadu a jakékoli jiné mezinárodní programy
vztahující se EYD, které mohou být vytvořeny.
Každý zúčastněný vysílatel bude dodržovat instrukce stálých služeb EBU ohledně umísťování sponzorských billboardů na
obrazovku. Pouze zúčastnění vysílatelé, kteří skutečně umístili sponzorské billboardy na své obrazovky v souladu s instrukcemi
EBU,budou mít právo na podíl z takto vzniklých příjmů. EBU nebo její agent jmenuje monitoringovou společnost, aby potvrdila
správné vysílání sekvencí mezinárodního sponzorování.
Materiály pro sponzorování vysílání (reklamy/billboardy) bude vyrábět centrálně EBU/agent EBU a budou distribuovány s
instrukcemi těm zúčastněným vysílatelům, kteří budou provádět sekvence mezinárodního sponzorování. Sponzorské materiály
mezinárodního sponzorského vysílání musejí být umístěny nejblíže pořadu, po sloganech, které je jasně oddělují od předchozích
programů a/nebo komerčních přestávek.

3.2.2)
Sponzoři uvedení na obrazovce
Jména sponzorů na obrazovku může ve všech případech vkládat jen EBU nebo hostitelský vysílatel, jak tomu může být v případě
mezinárodního signálu. Žádný zúčastněný vysílatel nebude smět zahrnout žádná jména sponzorů zobrazovaných na obrazovce
během vysílání pořadu bez předchozího písemného souhlasu EBU. Pouze zúčastnění vysílatelé kteří skutečně vysílali
mezinárodní signál se jmény sponzorů na obrazovce, budou mít právo na podíl z takto vzniklých příjmů.
3.3)
Nabídka komerční doby vysílání
Až do skončení lhůty pro sponzorování musí každý zúčastněný vysílatel schopný nabídnout komerční vysílací čas před, během a
po pořadu Show tuto lhůtu nabídnout na základě prvního odmítnutí oficiálním marketingovým partnerům nebo dodavatelům EYD.
Jakýkoli komerční vysílací čas, který zůstává k dispozici, musí být potom nabídnut oficiálnímu marketingovému partnerovi /
oficiálním marketingovým partnerům na základě prvního odmítnutí. Žádným oficiálním marketingovým partnerům nebo
dodavatelům nesmějí být nikdy účtovány větší částky než jakémukoli jinému inzerentovi za tentýž komerční vysílací čas.
Pokud se mezinárodní sponzor rozhodne nekoupit některý nebo žádný vysílací čas, může ho zúčastněný vysílatel bez omezení
prodat celý nebo zčásti jiné společnosti za předpokladu, že druhá společnost nebude jednat v rozporu s mezinárodním sponzorem.
Než zúčastnění vysílatelé uzavřou jakoukoli smlouvu o komerčním vysílacím čase, musejí požádat o radu stálé služby EBU, aby se
předešlo případným neshodám.
3.4)
Podpora prodeje
EBU vlastní licenční práva a práva na podporu prodeje k EYD a vyhrazuje si právo udělovat partnerovi pro podporu prodeje
výhradní práva na podporu prodeje vztahující se na sportovní oblečení, módní konfekci a jednotlivé propagační výrobky. Příjem
vzniklý z takovýchto prodejů bude zahrnut do centralizovaného marketingového příjmu, a bude následně rozdělen. Zúčastnění
vysílatelé, kteří mají v úmyslu prodávat produkty podpory prodeje kromě těch, které jsou uvedené výše, na svém území jsou
povinni si vyžádat předchozí písemný souhlas výkonného supervizora EBU za účelem zabránění vzniku možných střetů s
partnerem z oblasti podpory prodeje.

Příloha 1
Povinnosti hostitelského vysílatele
Povinnosti hostitelského vysílatele jsou popsány v samostatném souboru pravidel nazvaném smlouva s hostitelským vysílatelem.
Následující body vyjadřují hlavní body hostitelského vysílatele vůči zúčastněným vysílatelům.
1) Produkce pořadu
a)
Hostitelský vysílatel zajistí kompletní produkci živého nepřerušovaného televizního programu v dohodnutém termínu a v
dohodnutém čase. Vysílání bude trvat přibližně 90 minut a bude na nejvyšší úrovni a v souladu s redakčními standardy.
Konečné rozhodnutí o všech redakčních záležitostech budou činit stálé služby EBU. Hostitelský vysílatel zajistí dodání signálu
produkce do Eurovizní sítě. Mezinárodní signál který má být dodán, musí být z čistého zdroje.
b)
Hostitelský vysílatel po poradě s výkonným supervizorem EBU navrhne produkční rozpočet pro EYD a pro pořad, Produkční
rozpočet poté schválí Řídící skupina.
c) Hostitelský vysílatel ve spolupráci s výkonným supervizorem EBU jmenuje organizační výbor a sdělí jména osob jmenovaných
do všech vyšších pozic. V žádné fázi před přípravami EYD a pořadu nebude mít hostitelský vysílatel právo vstupovat do
jakýchkoli jednání o možném sdílení zodpovědnosti za produkci se třetími stranami bez předchozího písemného souhlasu
EBU.
d) Hostitelský vysílatel nebude ve prospěch zúčastněných vysílatelů a pořadu určovat provozní pořadí pořadu ani pořadí
vystoupení soutěžících v pořadu. Hostitelský vysílatel bude poskytovat podrobný harmonogram zkoušek.
e)
Hostitelský vysílatel vynaloží veškeré úsilí, aby splnil požadavky zúčastněných vysílatelů týkající se tančení jejich sólových
tanců, kde je to možné a pokud požadavek není v rozporu s kreativním pojetím inscenace akce, a pod podmínkou, že
zúčastnění vysílatelé informují hostitelského vysílatele způsobem uvedeným v harmonogramu (dodání).
f)
Řídící skupina je zodpovědná za tance a za to, že taneční vystoupení jsou v souladu se stávajícími pravidly, zatímco
hostitelský vysílatel zajistí, aby byla podniknuta všechna potřebná opatření k zajištění nepřetržitého a nerušeného vystoupení
umělců během natáčení pořadu.
g)
Mezinárodní komentátoři jmenovaní do pořadu musejí být nestranní a neměli by být nikdy žádným způsobem zainteresováni
ve skládání doprovodné hudby, a/nebo ve vytváření choreografie jakéhokoli z tanců účastnících se EYD.
h)
Hostitelský vysílatel musí dát k dispozici minimálně vysílacích kabin, za které bude účtována přijatelná tržní cena.
i)
Hostitelský vysílatel musí během pořadu poskytnout minimálně jednu komerční přestávku těm zúčastněným vysílatelům, kteří
ji chtějí využít. O přesném počtu takovýchto přestávek a o jejich délce rozhodne výkonný supervizor EBU ve spolupráci s
hostitelským vysílatelem nejpozději do poloviny dubna před konáním pořadu.
2)
Organizace akce
a) Hostitelský vysílatel určí vhodné místo pro organizaci EYD. To podléhá schválení výkonného supervizora EBU po poradě s
Řídící skupinou. Pokud je místo schváleno, bude hostitelský vysílatel zodpovědný za jeho rezervaci po celou dobu akce.
b)
Hostitelský vysílatel zajistí dostatečné ubytovací kapacity v hotelu (nejméně 100 pokojů) pro delegace zúčastněných vysílatelů
za rozumné ceny. Hostitelský vysílatel (nebo jmenovaný majitel cestovní kanceláře) bude mít právo žádat za pokoje platbu
předem ve výši 50%.
c)
Hostitelský vysílatel zajistí, aby byla učiněna veškerá potřebná a přiměřená opatření k zajištění bezpečnosti a ochrany všech
soutěžících a všech členů jejich delegací za všech okolností po celou dobu trvání akce v hostitelském městě. Za tímto účelem
předloží hostitelský vysílatel ve spolupráci s místními úřady výkonnému supervizorovi EBU podrobný bezpečnostní plán.
d) Hostitelský vysílatel vyřídí všechny formality ohledně dovozu a vývozu materiálu a vybavení potřebných pro soutěž. Pokud si
delegace přeje přivézt do hostitelské země nějaké speciální vybavení, musí tak učinit na své vlastní náklady a hostitelský
vysílatel o tom musí být informován do data uvedeného v harmonogramu akce.
e)
V průběhu celého týdne trvání akce, musí hostitelský vysílatel organizovat společenský program.

3) Záruky
a)
Všichni účastníci, fanoušci a mezinárodní tisk musejí mít zaručené právo na svobodu projevu, shromažďování a kontakt s
občany hostitelské země v souladu s evropskými standardy.
b)
Všichni účastníci (včetně organizátorů, partnerů a delegací), všichni fanoušci, kteří mohou prokázat, že si pořídili lístek, a
všichni novináři, kteří od EBU získali akreditaci pro účast na akci ("akreditovaní novináři"), musejí být schopni si dostatečně
dopředu pořídit vstupní vízum na celou dobu trvání akce.
c)
Všichni účastníci, fanoušci a akreditovaní novináři budou mít volný přístup ke všem veřejným zařízením a budou se moci
pohybovat po hostitelském městě a zemi bez jakéhokoli povolení nebo omezení, ale v plném souladu s pravidly a podmínkami
jejich akreditace.
d) Všichni účastníci, fanoušci a akreditovaní novináři mají právo hovořit nebo pořizovat rozhovory, rovněž s úmyslem zveřejnění,
se všemi občany hostitelského města a země.
e)
Pokud je ve městě zvoleno vyhrazené místo, všichni účastníci, fanoušci, akreditovaní novináři a občané hostitelské země
budou mít na toto místo volný přístup.
)
Vláda hostitelské země zaručí svobodu projevu v souladu se článkem 10 Evropské úmluvy o lidských právech a v souladu s
precedenčním právem Evropského soudu pro lidská práva všem účastníkům, fanouškům, akreditovaným novinářům a
jednotlivým občanům země, kteří dávají rozhovory.
g)
Hostitelský vysílatel pojistí EBU proti jakýmkoli nárokům vznášeným ze strany zúčastněných vysílatelů ohledně jakéhokoli
porušení jeho povinností podle těchto pravidel.
4)
Rozhodnutí
Výkonný supervizor EBU, jednající jménem EBU, bude vynášet konečná rozhodnutí v jakémkoli sporu mezi zúčastněnými
vysílateli a hostitelským vysílatelem.

Příloha 2
Role Řídící skupiny (ŘS)
pro Eurovizní soutěž mladých tanečníků
(ESMT)
Řídící skupina je výkonnou odbornou komisí jmenovanou Hudební a taneční divizí EBU pro účely reprezentování zájmů
zúčastněných vysílatelů a vynášení rozhodnutí jejich jménem v rámci organizace a produkce EYD. Rozhodnutí, která vynese
Řídící skupina, budou pro zúčastněné vysílatele. Řídící musí vynášet rozhodnutí v obecném zájmu EYD a ne v zájmu
některého z účastníků.
Složení Řídící skupiny se mění z roku na rok. Složení Řídící skupiny je uvedeno v harmonogramu akce. Řídící skupina spolu s
výkonným supervizorem EBU bude zodpovědná za:
•
schvalování složení poroty;
•
•
•
•
•
•
schvalování provozního pořadí a scénáře pořadu
vytváření a schvalování pravidel EYD a zajišťování toho, aby byla plně dodržována;
schvalování rozvoje a budoucího formátu EYD;
schvalování všech relevantních změn ve formátu a produkci pořadu;
schvalování produkčního rozpočtu EYD;
dohlížení hostitelského vysílatele na celoroční přípravu. Řídící skupina se za tímto účelem sejde čtyřikrát až pětkrát před
začátkem týdne konání akce nebo je možné organizovat telefonní konference;
rozhodování v případě sporu mezi zúčastněnými vysílateli a hostitelským vysílatelem, čímž se rozumí případ, kdy není
možné dospět k žádné dohodě, bude mít poslední slovo výkonný supervizor EBU a toto rozhodnutí bude závazné pro
všechny strany.
•
Nepodaří-li se dosáhnout dostatečné shody, rozhodne řídící skupina prostou většinou hlasů, přičemž každý člen Řídící skupiny
bude mít jeden hlas. V případě nerozhodného výsledku hlasování bude rozhodující hlas předsedajícího.
Příloha 3
Povinnosti EBU
1)
Výkonný supervizor EBU bude úzce spolupracovat s hostitelským vysílatelem, aby podpořil všechny aspekty národního
plánování a produkce.
2)
EBU zaručí, aby mezinárodní vysílání pořadu neporušilo žádné národní zákony. EBU bude dále zodpovědná za zajišťování
toho, aby zúčastnění vysílatelé udělovali práva týkající se sponzorování a inzerce marketingovým partnerům a dodavatelům,
pokud existují.
3)
Stále služby EBU budou zodpovědné za marketing veškerých práv na komerční využití ve prospěch zúčastněných vysílatelů a
hostitelského vysílatele ve spolupráci s agentem EBU (pokud byl jmenovaný).
4)
EBU bude zodpovědná z všechny aspekty týkající se značky EYD a ponese náklady související s touto značkou. Zvolenou

upoutávka využita pro komerční, propagační a obchodní účely.

Výkonný supervizor EBU bude zodpovědný za dohlížení na hlasování v průběhu pořadu, za všechna rozhodnutí vyžadovaná
v průběhu hlasování a za udílení všech potřebných instrukcí mezinárodním moderátorům a personálu obsluhujícímu světelné
tabule.

SECTION 1 - THE EUROVISION YOUNG DANCERS
1.1)
Description
1.1.1)
EBU Coproduction
The Eurovision Young Dancers (the "EYD") is an international coproduction by EBU Members in the field of the
fusion of classical and modern dance which is carried out under the auspices of the European Broadcasting Union
(the "EBU") as part of the television programme exchange known as Eurovision.
Only Members of the EBU are eligible to participate in the EYD and are authorized to apply. The maximum number
of participating broadcasting organisations is mentioned under the Schedule.
Active Members accepted to participate in the EYD shall be referred hereafter to as the "Participating
Broadcasters".
1.1.2)
Content/Format
The EYD shall consist of one Show where Contestants entered by the Participating Broadcasters to represent their
countries shall perform successively dances in front of a Jury who shall judge their performances and a live
audience.
First the 14 dancers shall each perform a solo dance. Once all the dancers have performed their solo dance, they
shall be split into two groups (each group composed of seven dancers maximum) and the two groups shall both
perform the same group dance. The choreography of the group dance shall be elaborated by a choreographer
specially invited for the occasion (the "Choreographer"). Finally, the two best dancers, as chosen by the Jury shall
perform a final dance.
The Show shall be a state-of-the-art, world-class television production. It shall be recorded, produced and
transmitted by the Host Broadcaster (see the Event Schedule) and shall be made available over the Eurovision
satellite network for broadcast by the Participating Broadcasters.
The main title of the Show is the "Eurovision Young Dancers", followed by the year during which it takes place. It
shall be used by all broadcasters, although they may instead use a translation into their national language, subject to
the approval of the EBU Executive Supervisor. If the translation is approved, the main title need not be used.
Broadcasters are also permitted to include a minor title under the main title, using the name by which the EYD has
been known in recent years in their respective countries.
The running order of the Show and the order of appearance of the solo dances shall be decided by the Host
Broadcaster, subject to the approval of the EBU Executive Supervisor and the EYD Steering Group (a group of
representatives of EBU Members). The allocation of the dancers in the group dance shall be decided by the
Choreographer, in consultation with the Steering Group. The Show shall be presented on stage, in English, by an
international presenter. National commentary by commentators appointed by each of the Participating Broadcasters
may be added to the international version of the Show for broadcast in their respective countries, if so requested by
the Commentators Deadline.
The EYD is a non-political entertainment programme. It shall in no case be used to convey any direct or indirect
political message of any kind.
1.1.3)
Selection process of the Contestants to participate in the Show
Each Participating Broadcaster shall submit a dancer as detailed below to participate in the EYD by the
Contestant's Deadline together with the materials listed in the Delivery Schedule Sheet. The national selection is
organized under the sole responsibility of the Participating Broadcaster in question.
The national selections may be televised if so wished by the Participating Broadcasters. If the national selection is
televised, the winner thereof shall be entered as the contestant of the country of the Participating Broadcaster.
If the national selection is not televised, the Participating Broadcaster shall submit proposals for two possible
dancers to participate in the EYD. The Choreographer shall then decide discretionally whom of the two dancers
proposed shall be retained for participating in the EYD. The decision shall be communicated by the Registration
Deadline and shall be final and binding.

Criteria of eligibility
1.2.1)
Contestants
a) All contestants proposed for participation in the EYD must be aged from 16 to 21 in the year of the EYD.
b) Contestants shall be either citizens of the country of the Participating Broadcaster by whom he/she is entered in
the EYD or shall have been resident in that country for at least the two years preceding the EYD in which he/she
takes part.
c) Only solo dancers not professionally engaged are allowed to be entered. Contestants should be part of a
recognised dance institution and possess the basic classical/contemporary ballet skills.
d) Prize-winners of previous editions of the EYD are not allowed to participate in the EYD or in future editions
thereof.
e) The finalists in the EYD shall not be allowed to take part in the future editions of the EYD.
1.2.2)
Performances
All dances to be performed in the Show are subject to the prior approval of the EBU Executive Supervisor and of the
Steering Group.
a) Each Contestant shall perform during the Show one solo dance. The maximum length allowed shall be 1 minute
30 seconds. The choice of the music and of the style for the solo dance is free. A broad musical range and
different styles of dances are encouraged. The quality of the music to be used for the dance needs to enable a
high level of performance in line with the expectations of an international top quality television entertainment
programme.
The EBU Executive Supervisor, after consultation with the Steering Group and the Executive Producer, reserves
the right to request modifications to the performance (such as to shorten the performance in case it exceeds the
authorized duration, and/or to change the music and/or to make modifications to the choreography is required by
the Choreographer).
Each Participating Broadcaster hereby accepts that the acceptance of the solo dances in the Show remain
subject to the final approval of the EBU Executive Supervisor and of the Steering Group.
b) The group dance shall be performed by the Contestants who shall be divided into two groups of seven dancers.
The choreography thereof being created by the Choreographer. This group dance shall not be made known to
the Contestants before the Event Week and shall be rehearsed by the Contestants during such Week.
c) The final dance shall be performed only by the two dancers having obtained the most points from the Jury. The
final dance will comprise both solo and group dance elements.
1.3)
Jury
1.3.1)
Composition
There shall be a Jury to be appointed by the Host Broadcaster to vote in the Show. The Jury shall comply with the
following criteria:

It shall be composed of three persons.
They shall be professionals in the dance field and should originate from different sectors of dance so as to
cover different style of dances. They shall be nationals of different countries so as to ensure diversity.
There shall be a balance between the members to ensure sufficient representativeness in terms of gender,
age and background.
None of the members of the Jury shall be connected in any way with any of the participating dances entered
and/or artists performing in the EYD, so as to ensure complete independence in their votes and impartiality.
The final composition of the Jury shall be approved by the Steering Group.
1.3.2)
Voting Process
At the beginning of the Event Week, the EBU Executive Supervisor, the Host Broadcaster and the Choreographer
shall organize a meeting with the members of the Jury to brief them on the voting process and to establish the
objectives of the EYD. The Jury shall be present at the Dress Rehearsal and during the Show.
After the presentation of each performance of the solo dances and the group dances in the Show, each member of
the Jury shall express in the Show his/her impression on the performance so as to increase the public and the
viewers' understanding of the selection process.
In addition, the members of the Jury shall allocate the points on the basis of the following criteria:

Quality of the dance performance and artistic expression
Flexibility for a dancer to adapt to new styles of dance (to be used for the group dance)
Abstentions shall not be allowed. Each member shall award points to each dancer out of ten. However at that stage,
the points allocated shall not be made known to the public. The EBU Executive Supervisor shall be responsible for
collecting the voting sheets of all jury members after all the solo dances and the group dances have been performed.
The two dancers who have obtained the most points at the end of these two dance rounds shall be declared finalists
of the EYD and they shall perform, as the final dance in the Show, a duel dance together.
The members of the Jury shall then allocate points to each of the dancers for that particular performance according
to the same procedure as the one mentioned above. The dancer who obtains the most points from the Jury shall be
declared the winner of the EYD.
1.3.3)
Procedure in case of a tie
Should two or more dancers receive exactly the same number of points from the Jury, the members of the Jury shall
conduct further deliberations to determine which dancers shall be selected as finalists. In case no agreement can be
found, the finalists shall be designated after consultations with the Choreographer. The same procedure shall apply
in case of a tie between the finalists to determine the winner of the EYD.
SECTION 2 - LEGAL AND FINANCIAL PROVISIONS
2.1)
Application process
2.1.1)
Eligibility of Members
Only television broadcasters which are Members of the EBU are eligible to participate in the EYD and are authorized
to apply.
2.1.2)
Procedure
By the Communication Deadline (see the Event Schedule), the EBU shall indicate to the EBU Members interested
in participating in the EYD what would be the amount of their participation fees, such amount being established in
consultation with the Steering group.
All EBU Members wishing to participate in the EYD must complete the confirmation of participation form attached
hereto and return it by the Application Deadline (see the Event Schedule) as per the indications mentioned therein.
Any EBU Member accepted as a Participating Broadcaster may withdraw without incurring any financial penalty until
the Withdrawal Deadline (see the Event Schedule). Without prejudice to any sanction, which may be applied as per
the provisions of Section 2.6 below, if after the Withdrawal Deadline a Participating Broadcaster withdraws or is
disqualified for non-compliance with these Rules, it shall remain liable for paying 100% of its final participation fee.
The final participation fees shall be established by the EBU Executive Supervisor and shall be communicated to the
Participating Broadcasters on the Notification Deadline (see the Event Schedule) at the latest.
In any of the above-mentioned circumstances the EBU Executive Supervisor remains free to decide whether or not
to replace a Participating Broadcaster which is disqualified or has withdrawn by another EBU Member if this is still
compatible with the schedule for preparing the Show.
2.2)
Participating Broadcasters' commitments
By entering a dance for the EYD and signing the confirmation form for participation, each Participating Broadcaster:
a) accepts the present Rules (including to comply with all requirements and deadlines specified in the attached
Schedules) , which apply to the present Eurovision Young Dancers as a whole; and
b) confirms that its commitment to participate in the present Eurovision Young Dancers shall remain valid in all its
provisions even if a modification occurs to the host city and/or to the host country and/or if the organization and
production thereof is ensured by a host broadcaster other than the one mentioned in the Event Schedule; and
c) undertakes that it shall not engage in any action or behaviour, or allow any person under its control or for which it
is responsible under the present Rules to engage in such action or behaviour, which could bring the EYD or the
EBU into disrepute; and

d) undertakes to propose contestants in compliance with the present Rules by the Contestant's Deadline and to
organize a national selection process as it deems fit and under its sole responsibility; and
e) undertakes to appoint a Head of Delegation by the Head of Delegation's Deadline, who shall act as the point of
contact between the EBU Executive Supervisor and/or the Host Broadcaster and who shall as such be fully
responsible for all aspects of his/her organization's participation, and in particular to:
-
monitor all aspects of the national entry, including delivering the material requested by the EBU Executive
Supervisor and the Host Broadcaster in due time;
ensure that the present Rules are respected;
be (i) responsible for his or her national delegation, which shall consist of a maximum of 15 accredited
persons and (ii) in charge of the personal security of its contestant and (iii) in charge of supervision thereof
during the EYD; and
-
f) shall be responsible for its country's applications for accreditation for journalists and fans, in accordance with the
instructions given by the EBU; and
g) shall ensure that:
-
its delegation and artists arrive in due time in the EYD city to be able to participate in the first rehearsal on
stage (the detailed rehearsal schedule to be provided by the Host Broadcaster in due time) and stay until
the end of the Event Week (see exact date on the Event Schedule)
its delegation stays at one of the official hotels appointed by the Host Broadcaster and/or the EBU;
its Contestant is accompanied by a personal coach (for example a family member or a teacher) at all times
during the Event. The Head of Delegation shall be responsible for ensuring that the personal coach of his
Contestant does not unduly intervene in the production process.
h) shall ensure that its commentators respect the spirit and fairness of the competition. The commentators shall not
make any gestures or speeches of a political, commercial or similar nature or use swearing or other unacceptable
language, and/or make any sexist, racist or otherwise unduly discriminatory comments about the artists or
dances. Commentators shall refrain from talking during the performance of the dances. The commentators shall
be neutral and shall in no case have been involved in the creation of any choreography of any dance participating
in the EYD; and
i)
undertakes to make every effort to promote its national selection process and the EYD
-

in its national media, including the promotional trailer for the EYD and/or news coverage
in a national EYD Website dedicated to its national selection or a dedicated webpage within its main
website (not compulsory). Within the limits of any relevant national rules and regulations, it shall also
establish, from that national website or dedicated page, a link to the official website of the EYD www.youngdancers.tv
In addition, each Participating Broadcaster shall publish on its website the rules regarding its national
selection process in order to ensure transparency. After the national selection each Participating
Broadcaster shall also publish a complete account of the execution of these rules and criteria.
acknowledges that during the Event Week, the EBU Executive Supervisor shall be entitled to take last-minute
decisions should the production so require and to interpret the present Rules, provided that such decisions are
reported to the Steering Group thereafter.
2.3
Rights acquisition
2.3.1
Rights, authorizations and undertakings to be obtained by each Participating Broadcaster
As a condition for participating in the EYD, and with the purpose of promoting the EYD, each Participating
Broadcaster must ensure that the music writer(s), composer(s), artist(s), master owner of the (audio) recordings
and any other possible right owner(s) of the selected accompanying music/recordings, any author, choreographer
of the dance and any possible right holder in relation to the accompanying music or the dance will grant the
transferable rights listed hereafter (unless permission to use any such rights is obtained from a collecting
society):
a) Broadcasting Rights: These are the worldwide exclusive rights, unlimited in time, to record and broadcast the
live (both audio and audiovisual) performance of the dance at the Show (including each Dress Rehearsal) and to
broadcast a recording thereof, an unlimited number of times, for simultaneous reception by the public, in private
and public places by any technical means (such as terrestrial transmitters, satellite, wire, cable, fibre, telephone
lines, broadband, the Internet and mobile telephony, or any combination thereof (including simultaneous,
unabridged and unchanged retransmission via such means), in whatever technical standard (such as analogue,
digital or high definition), for reception and display on any type of device (such as television sets, giant screens,

video walls, computer screens, hand-helds, portable devices, and mobile phones), and irrespective of the mode
of financing of the service, such as free of charge or against payment.
It is understood that the exercise of these rights also allows the live and/or deferred and/or on-demand
transmission of the Show and of the Dress Rehearsals, in whole or in part, or otherwise making-available (ondemand use free of charge or against payment) of the live (both audio and audiovisual) performance of the dance
at the Show (including at any of the Dress Rehearsals), via any of the above-mentioned means.
b) Public Performance Rights: these are the worldwide exclusive rights, unlimited in time, to present the
broadcast of the Show and recordings thereof (including the Dress Rehearsals), in whole or in part, and any
national selection extracts (if any), on a live or deferred basis in any public places (such as cinemas, theatres and
public exhibitions), whether or not against an entrance fee, an unlimited number of times.
c) DVD compilations and Digital Releases Rights: These are the worldwide rights necessary for releasing the
audiovisual recording of the Show (as well as the Dress Rehearsals) including all the dances as performed in the
Show and during the Dress Rehearsals as parts of DVDs (or similar carriers) of the EYD and other digital media
products on an unbundled or bundled basis. The DVD and other EYD digital media products are to be released
throughout the world by the EBU Permanent Services, or by a third party appointed only by the EBU Permanent
Services.
d) Extract Rights: These are the non-exclusive worldwide rights, unlimited in time, for incorporating a sound or
video recording of the broadcast performance of the selected dance, as part of the Show or as part of the Dress
Rehearsals as well as any part of the Show, in whole or in part, into any other media services or EYD products
provided by the Participating Broadcasters and/or the EBU on behalf of its Members, as well as into any
audiovisual work or other media services provided by third parties.
e) National Selection Extract Rights: These are the worldwide non-exclusive rights, unlimited in time, for
incorporating extracts from the broadcast of any televised national selection which could be produced by the
Participating Broadcasters, in whole or in part, into the Show for broadcast and/or otherwise making available
(including on-demand) via any technical means (including the Internet). If the televised national selection
programmes contain celebrity acts for which it is not possible to clear the rights to the extent required hereunder,
then such celebrity acts shall not be incorporated.
f) Commentators: these are the rights to use commentators' commentaries in any media (including the Internet)
and/or on any support, including as a separate soundtrack on DVD (or similar carriers).
g) Promotional material: These are the rights to use, reproduce, print and publish the name, likeness, voice,
photographs and biography of all artists and other right owners in connection with the promotion, broadcast
and/or commercial exploitation of the Show by all means and in all media, whether now known or hereafter
developed, for an unlimited period of time. This includes the use of photographs taken at the rehearsals and any
"behind the scenes" audiovisual material for the DVD, the official EYD website or other EYD media products and
the use of the footage, or other films or photographs, made at the Dress Rehearsals and/or during press
conferences for any of the aforementioned purposes.
h) Press conferences: This is the undertaking to be obtained from the artists that they agree to take part in press
conferences if so requested by the EBU and to authorize the use of any recording thereof on any media
(including the Internet) without limitation in time and the inclusion of such material in the EYD DVD.
i) Authorizations: The Contestants or where appropriate, their parents/guardians, shall be required by each
Participating Broadcaster to authorize the use of the recording of any performance taking place during the Event
Week by all means and in all media, whether now known or hereafter developed, for an unlimited period. Such
use shall be made inter alia on the Internet and may be included in the EYD DVD and may also relate to the
promotion broadcast and/or commercial exploitation of the EYD by any party involved in the EYD.
All Contestants (or where appropriate, their parents or guardians) shall be required by the Participating
Broadcaster of the country concerned to authorize:
ü To be filmed throughout the Event Week, with a view to include the material filmed as inserts in the Show
(for use as detailed under the present Rules) and/or in programmes on the EYD to be broadcast on any
media via any means (including on the EYD website);
ü The use, reproduction, printing and publishing of the name, likeliness, voice, photographs and biographies
of the Contestant in connection with the promotion, broadcast and/or commercial exploitation of the EYD.
The authorizations to be obtained under the present paragraph shall be granted for worldwide exploitation by all
means and in all media, whether now known or hereafter developed and for an unlimited period of time.

2.3.2)
Guarantee/indemnification
Each Participating Broadcaster shall ensure that its relationship with the artists and other parties with respect to its
national selection process is entirely under its own responsibility and does not give rise to any claim concerning the
organization, preparation or broadcast of the EYD by the EBU or any of its Members. Without prejudice to any
sanction which may be applied under Section 2.6, each Participating Broadcaster shall indemnify all other
organizations concerned and the EBU against any claims whatsoever arising from authors, composers, artists,
publishers, producers, agents, managers, master owners of the recordings of the accompanying music or any other
persons or entities in respect of the choreography and/or any of the broadcasts or other uses of the accompanying
music and the performances of the dances pursuant to the present Rules.
2.4
Exploitation/Grant of rights
2.4.1
Broadcasting obligations of the Participating Broadcasters
a)
Broadcast of the Show
Each Participating Broadcaster shall broadcast the Show either on a live or a deferred basis in its entirety on one
of its main national terrestrial channels. Broadcast of the Show is compulsory.
b)
Eurovision signature tune and logo
All broadcasters shall transmit the Eurovision signature tune and logo and the relevant EYD logo at the start and at
the end of the Show. The duration thereof shall be subject to the approval of the EBU Permanent Services.
2.4.2)
Participating Broadcasters' rights
a)
Grant of Rights
All Participating Broadcasters shall be granted the following rights, on their own territory:
(i)
For the Show:
Subject to continued compliance with these Rules (including the provisions relating to branding and
sponsorship/marketing, if any), the exclusive right, to:

Broadcast on a linear basis (live or deferred) an unlimited number of times until the next EYD, (the celebrity act
may have to be excluded for deferred broadcasts taking place 30 days after the Show, in which case the EBU
Executive Supervisor shall inform the Participating Broadcasters)

on their main or secondary terrestrial channel (including unabridged, unchanged and simultaneous
retransmission thereof via cable and/or satellite);
on their own wholly-owned radio, digital or satellite channels (in accordance with the EBU Rules on
the Sharing of the Eurovision Signal);
on a wholly-owned website, only the national version and provided that the webcast is unchanged,
unabridged and simultaneous with the broadcasts of the Participating Broadcasters’ own national
broadcasts of the Show on their terrestrial channels. In addition, any webcast shall comply, to the
extent allowed by national laws, with the same sponsorship requirements as the other
transmissions (terrestrial, cable and satellite);
via mobile phones, provided that such transmission consists of the simultaneous, unchanged and
unabridged retransmission of the broadcasts of the Participating Broadcasters' own national
broadcast of the Show on their terrestrial channels;
on their 100%-owned international generalist channels simultaneously with the broadcasts of the
Participating Broadcasters' own national broadcasts of the Show on their terrestrial channels
without any editorial changes (i.e. including commentary). Any such international generalist
channel shall have no windows aimed at a particular country or group of countries. Nor shall it
contain any advertising aimed at a particular country or group of countries, and its programming
shall be at least 80% identical in content and to a large extent in time of scheduling. Furthermore,
the channel must be broadcast in the same language(s) as the national programme service.
Make available on a non-linear basis for a maximum of 30 days after the broadcast of the Show
ü
on their wholly-owned customary catch-up service for on-demand streaming (without the possibility
to download) or for temporary download (as per the general policy of the Participating
Broadcaster) via any means (including mobile phones and the Internet).

National versions or edited versions are permitted as long as the integrity of the Show is not impaired and dance
performances are not cut.
(ii)
For the Extracts from the Show
The non-exclusive right to use extracts from the Show (excluding any celebrity acts) in any of their programmes for
use on any media as follows:
-
During the 12 months following the date of the Show, no limitation in the total duration of the inclusion of
extracts as long as no more than one minute from any performance is used and any celebrity act is
excluded.
-
Thereafter, without any limitation in time, these rights are limited to eight minutes' total duration (and no
more than one minute per performance).
The non-exclusive right, within the limits specified under this sub-paragraph, to sell any footage from the Show for
inclusion in any television programme to any third party within their territory only. Any breach of this rule may result in
the disqualification of the Participating Broadcaster's entry from the Show and/or denial of access to the
transmission, and/or exclusion from subsequent editions.
Participating Broadcasters wishing to insert any material from the Show, other than the extracts mentioned above, in
any of their programmes should obtain the prior written permission of the EBU.
b)
Third-party infringements
Each Participating Broadcaster remains unconditionally free to invoke any or all rights, and particularly copyright and
neighbouring rights, which it enjoys under its national legislation, in addition to the rights held by the EBU, with a
view to preventing or prohibiting the unauthorized use of its own broadcasts of the Show or any parts of such
broadcasts, such as individual scenes or images, by unauthorized third parties on its territory.
2.4.3)
EBU's rights and obligations
a)
Grant of rights
The EBU is in exclusive control of all centralized marketing and exploitation of the EYD. In particular, the EBU shall
hold (and shall be deemed to be granted) on a worldwide basis, the following transferable rights:
For the Show
The right, for an unlimited period of time and for an unlimited number of times, to:
·
Broadcast on a linear basis (live or deferred) and make available on non-linear basis, in whole or in part, on the
Internet and/or via mobile phones and/or any portable devices (including on any and all official EYD Platforms
(such as, the present list not being exhaustive, the Official Website of the EYD, Event's Facebook Page, Twitter
Account, YouTube Channel and similar platforms, etc.)
b)
Distribution/Licensing
Without prejudice to the other rules in this Section, all broadcasting and other rights to the Show, any footage filmed
during the Event and the EYD (including the rights in the format) are exclusively owned by the EBU, to be managed
centrally by the EBU on behalf of the Participating Broadcasters. The EBU Executive Supervisor shall, in cooperation
with an agent if needed, be responsible for coordinating all sales of the Show (including footage filmed during the
Event), in whole or in part, to non-participating broadcasters from countries where rights remain available and to third
parties, for the financial benefit of Participating Broadcasters and the Host Broadcaster. The EBU shall be entitled to
retain 15% of the revenue generated by such sales.
Unless any rule in this Section applies, non-participating broadcasters are not allowed to broadcast any material from
the Show (rehearsals/preparations, etc.) without the prior written permission of, and without possible payment of a
rights fee to, the EBU. No commercial or non-commercial entity shall use the logo or other distinctive elements of the
EYD or the Show without the prior written permission of the EBU.
(i)
For the Show
ü
Television
Non-participating television broadcasters from countries where rights remain available may acquire the right to
broadcast the Show on their territory against possible payment of a rights fee. In countries where rights remain
available, non-participating EBU Members shall have a first option, to be exercised within a deadline set by the EBU,

to purchase the programmes for their territory. Depending on the facilities available, non-participating broadcasters
from countries where rights remain available may also request the right to send a commentator, and/or a production
team, to the Show.
ü News access
Any broadcaster which does not hold any audiovisual media rights shall be granted, upon request to the EBU, a total
of two minutes' news access from the Show (or, if requested, from any Dress Rehearsal), free of charge for use in
regularly-scheduled general news bulletins broadcast within 24 hours of the Show.
(ii)
For Extracts
The EBU shall be entitled to grant licences with respect to any extracts from the Show and/or from any footage
filmed during the Event to third parties for inclusion in any audiovisual works or media products or services. The EBU
is also entitled to sell any footage from the Show to any third party within a Participating Broadcaster's territory if the
EBU Executive Supervisor receive a request direct from such a third party or if the request covers more than one
territory.
2.5)
Funding
2.5.1)
The cost of funding the production and staging of the Show shall be borne by the Host Broadcaster and
the Participating Broadcasters.
2.5.2)
The total production budget for the Show usually approximate 400,000 €. The total final production
budget for the Show shall be proposed by the Host Broadcaster, in consultation with the EBU Executive Supervisor,
and approved by the Steering Group.
2.5.3)
The minimum amount which shall be funded for the EYD to take place is indicated in the Event
Schedule (the "Total Contribution"). This Total Contribution shall be funded by the individual participation fees
payable by the Participating Broadcasters as determined by the EBU system in force. From the total contribution
actually collected, the EBU shall be entitled to deduct its administration and coordination costs, the costs for the
Official Website as well as the costs related to the prizes for the winners. The Total Contribution minus the EBU
costs shall be referred to hereafter as the "Production Contribution".
2.5.4)
To fund the contribution mentioned under paragraph 2.5.3) above, all Participating Broadcasters shall
be required to pay their final participation fee to the EBU by the Payment Deadline (see the Event Schedule).
Failure to pay in due time may result in a broadcaster being disqualified and/or access to the Show being denied.
2.5.5)
The Host Broadcaster shall not be required to pay any participation fee but shall pay the totality of the
remaining budget for the production of the Show, i.e. after deduction of the Production Contribution.
2.5.6)
In addition, the cost of receiving the transmission over the Eurovision Network shall be paid by all the
Participating Broadcasters and by other broadcasters wishing to receive the transmissions, in accordance with the
standard EBU Operations billing practices.
2.5.7)
All expenses incurred by each Participating Broadcaster in relation to its own entry, such as fees, as
well as travel and subsistence costs for its delegation, shall be the full responsibility of that Participating Broadcaster.
2.6)
Disqualification and sanctions
2.6.1)
Disqualification
a)
Grounds for disqualification:
A dance may be disqualified for the following reasons:
(i)
If there is evidence that an artist, a member of the delegation or a commentator has not complied with the
requests of the EBU Executive Supervisor, the Host Broadcaster and may therefore cause disruption to the
event and/or the broadcast productions/transmissions.
(ii)
If the artist(s) depart(s) from the planned performance as performed at the dress rehearsals, and thereby
cause(s) disruption to the event and/or the broadcast productions/transmissions.
(iii)
If a participating organization or artist(s) has in any way attempted to breach the present Rules at any stage
of the preparation of the EYD event, including the national selection process, or is about to do so during the
Show itself.

(iv)
if a Participating Broadcaster has, after the Withdrawal Deadline but not later than 15 March of the EYD year,
one or more unpaid invoices vis-à-vis the EBU which are more than 240 days old, unless the Member settles,
before 15 March of the EYD year, all its debts to the EBU which are older than 90 days.
b) Procedure
(i)
In case of disqualification on the basis of the grounds listed under 2.6.1) a) (i) to (iii), the decision to enact
disqualification is taken by the Steering Group, on the recommendation of the EBU Permanent Services. If
the disqualification procedure concerns a country represented by a member of the Reference Group, that
member shall not be allowed to vote on the disqualification decision or to take part in the deliberations.
ü If disqualification of a dance is decided upon before 15 March of the EYD year, the Participating
Broadcaster shall, subject to the written agreement of the Steering Group, be entitled to propose another
dance and to submit all related material by the date specified by the Steering Group. Should the
Steering Group refuse to approve the participation of another dance, the Participating Broadcaster shall
have the right to appeal against the decision of the Steering Group to the Chairman of the Television
Committee within two weeks of the date of notification of the decision.
ü If disqualification of a dance is decided upon after 15 March of the EYD year, but before the Show, the
Participating Broadcaster concerned shall not present its entry but shall be liable to pay its final
participation fee. However, time permitting, the Participating Broadcaster shall have the right to appeal
against the decision to the Chairman of the Television Committee and, if he cannot be reached, to the
EBU Executive Supervisor, within two weeks of the date of notification of the decision.
Any decision taken in accordance with the above-mentioned procedure shall be final and binding, and no legal
remedy shall be possible.
(ii)
In case of disqualification on the basis of the ground listed under 2.6.1) a) (iv) above, the decision to enact
disqualification is taken by the EBU Executive Supervisor. Within two weeks of the date of notification of such
decision the Participating Broadcaster may appeal to the EBU Executive Board for final and binding decision.
Any appeal shall be notified by registered letter to the President of the EBU and shall contain the Participating
Broadcaster's observations and comments.
2.6.2)
Sanctions
a)
Grounds for sanctions
A Participating Broadcaster may be sanctioned, and even excluded from subsequent Shows, if it:
(i) does not comply with the present Rules.
(ii) withdraws from the Show after the Withdrawal Deadline.
b)
Procedure
Any sanctions shall be pronounced by the Television Committee, following a recommendation by the Reference
Group.
Sanctions shall be proportionate to the damage or prejudice caused to the EBU, the Host Broadcaster, the
Participating Broadcasters and/or the organization or the reputation of the EYD and shall compensate for the
prejudice caused.
In addition, the Participating Broadcaster at fault may be required to pay a fine of from 5 to 10% (depending on
the seriousness of the breach) of its final participation fee. No exclusion shall be for more than three successive
editions of the EYD.
The Participating Broadcaster shall have the right to appeal against sanctions to the EBU Executive Board.
2.7)
Postponement, transfer or cancellation of the Show
The Participating Broadcasters acknowledge and accept that the Show may be postponed and/or transferred to
another city or country, in particular but not only:
a) for reasons of force majeure (for example, but not limited to, natural disasters or catastrophes, acts of war,
terrorist activity, fire, flood, explosion, failure of public utilities or civil commotion or disorder, decision of any
regulatory or other competent authority, epidemics, public health, or the genuine and immediate threat of any of
the foregoing, including serious threats to the safety of participants, marketing partners or spectators) and/or

b) for any other act or event beyond the reasonable control of the EBU or the Host Broadcaster and/or
c) for objective major circumstances other than reasons of force majeure if they are, in the reasonable opinion of the
EBU, likely to affect the signal transmission or signal reception of the Show and/or the smooth operation of the
EYD event, and/or of the Show and/or the security of the contestants and their delegations, spectators or
marketing partners which therefore make the organization and the production of the Show unduly difficult at the
selected venue. For the purposes of the present Rules, such circumstances shall be regarded as force majeure.
The EBU as the organizer of the Event shall be unilaterally authorized to transfer the EYD to another city or
country.
In case of such postponement and/or transfer, the rights and obligations of the Participating Broadcasters for the
postponed Show shall be the same as if the Show had taken place on the originally scheduled dates and the
commitment to participate in the Show shall remain valid in all its provisions. If the Show is postponed and/or
transferred and/or partially held, the Participating Broadcasters shall not be entitled to claim any reimbursement
and/or compensation.
If the Show is cancelled by the EBU, such cancellation decision to be supported by a recommendation by the
Steering Group, the EBU's liability (to the extent that it is not limited by force majeure reasons) shall in all cases be
limited to the reimbursement of the amount of the Participating Broadcasters' contribution to the Show's production
budget (to the extent that such contribution has already been paid by the date of the cancellation) less the EBU's
overhead costs.
In no case (irrespective of whether the Show is cancelled, postponed or partially held) shall the EBU be liable for any
damage, indemnity, reimbursement or compensation of any kind, loss whether direct or indirect (e.g. loss of profit)
including loss of any advertising or other commercial revenue.
SECTION 3 - CENTRALIZED EXPLOITATION
The EBU is the sole right holder of the Eurovision Young Dancers. All rights in the EYD and the Show are exclusively
owned and managed on a centralized basis by the EBU, which shall be responsible for the benefit of the
Participating Broadcasters and the Host Broadcaster, in consultation with the Steering Group, for the marketing of all
commercial exploitation rights on a world-wide basis, which shall include (the following list not being exhaustive):

All sales of broadcasting rights to non-participating broadcasters
Those rights may be marketed by the EBU or in conjunction with a marketing agent yet to be appointed by the EBU,
(the "EBU's Agent") and the revenue generated therefrom shall be used in the production of the EYD.
The Host Broadcaster and the Participating Broadcasters shall cooperate with the EBU Executive Supervisor on any
centralized marketing programme which may be implemented.
The EBU Executive Supervisor shall inform the Participating Broadcasters by mid-January whether such
centralized sponsorship programme is implemented. The marketing partners which may be appointed by the
EBU shall be referred to as the "International Sponsors".
Each Participating Broadcaster shall provide, at the request of the EBU Executive Supervisor, full information, in one
of the two official languages of the EBU (English and French), on the legal sponsorship and advertising guidelines in
its territory as well as any relevant internal regulatory measures which are relevant to the delivery of the various
commercial elements of the Show (including possibility to display billboards and to include on-screen credits in the
Show). Each Participating Broadcaster shall promptly notify the EBU Executive Supervisor whether any legal or
regulatory provisions in its country or any of its internal guidelines are likely to prevent it from implementing the
centralized marketing activities to be carried out in relation to the EYD.
3.1)
Centralized Event Sponsorship
Only the EBU has the right to appoint marketing partners for the EYD event (irrespective of whether or not a
centralized sponsorship programme is implemented).

This may be done in cooperation with the EBU's Agent. In consultation with the EBU Executive Supervisor and the
EBU's Agent (if any), only the Host Broadcaster shall be entitled to explore national marketing opportunities in its
country and they shall not be in conflict with the main international sponsorship or other exclusive arrangements. The
Host Broadcaster shall have the right to appoint a maximum of four partners and shall not grant any rights outside its
national territory. In addition, the rights granted by the Host Broadcaster to its national partner shall be of a
secondary nature (i.e. precedence in terms of visibility shall always be given to the International Sponsors).
However, in no case shall the Participating Broadcasters be allowed to grant sponsorship rights in relation to the
EYD event in their country other than according to clause 3.1.2 a) hereunder.
If implemented, the Participating Broadcasters shall cooperate with the EBU and the Host Broadcaster with respect
to the centralized marketing programme and shall actively promote any such arrangements in relation to the EYD
event.
Each Participating Broadcaster shall protect the exclusivity of the International Sponsors and in this context must not
allow any third party whatsoever to associate itself with the EYD event.
3.2)
Centralized Programme sponsorship
Until the Sponsorship Deadline, all Participating Broadcasters shall reserve all programme sponsorship rights in
their countries on an exclusive basis for the EBU and shall not enter into any programme sponsorship agreements
before that date. One month after the expiry of the Sponsorship Deadline at the latest, the EBU Executive Supervisor
shall inform the Participating Broadcasters whether their territory is covered by the pan-European sponsorship
agreement.
a) The Participating Broadcasters located in the countries where there is no agreement with a pan-European
programme International Sponsor shall be entitled to handle the programme sponsorship rights for the Show
individually. They shall be free to enter into programme sponsorship arrangements, but only in relation to the
transmission of the Show (irrespective of whether or not an International Event Sponsor has been appointed). In
addition, they shall not grant programme sponsorship rights to companies or partners which are in competition with
International Sponsors who may have been appointed or which offer products or services which may be in
competition with the products or services of the International Sponsors. Participating Broadcasters shall seek the
prior written approval of the EBU Permanent Services before any programme sponsorship package is sold. The EBU
Permanent Services reserve the right to refuse to give approval if such sponsorship operates in conflict with the
International Sponsors, and the Participating Broadcasters shall refrain from selling any such package. In addition,
no national sponsor shall be allowed to associate itself with the EYD event, or to present its national sponsorship in a
way which may lead the general public to believe, or may give the impression, that the sponsor is a partner of, or
associated with, the EYD event.
b) The Participating Broadcasters located in the countries where there is an agreement with a pan-European
programme International Sponsor shall cooperate with the EBU, the Host Broadcaster and the EBU's Agent and
shall actively promote such arrangements. In those countries, Participating Broadcasters shall not be allowed to
grant programme sponsorship rights to any national sponsor, and no billboards other than those supplied by the EBU
Permanent Services and/or the EBU's Agent shall be included before, during or after the transmission of the Show.
The relevant material shall be provided by the marketing partners/suppliers, or by the EBU's Agent, on behalf of the
EBU. This relates to the Show only and shall include among others:
3.2.1)
On-screen inclusion of sponsors billboards/International sponsorship
Where requested by the EBU Permanent Services and subject to the relevant media laws and regulations, each
Participating Broadcaster shall honour all sponsorship arrangements, including the placement and the broadcasting
of billboards, bumpers, stings and branded trailers, etc, for the official marketing partners and suppliers in and
around transmissions of the Show, and any other international programmes related to the EYD that may be
produced.
Each Participating Broadcaster shall comply with the EBU Permanent Services' instructions regarding the on-screen
inclusion of sponsors' billboards. Only the Participating Broadcasters having actually included the sponsors'
billboards on their screen in accordance with the EBU's instructions shall be entitled to receive a share of the
revenue generated therefrom. A monitoring company shall be assigned by the EBU/the EBU's Agent to confirm the
correct transmission of the International Sponsorship sequences.
The broadcast sponsorship materials (creatives/billboards) shall be produced centrally by the EBU/the EBU's Agent
and distributed with instructions to those Participating Broadcasters who will be carrying International Sponsorship
sequences. The International Sponsor broadcast sponsorship materials must be placed closest to the Show, after
bumpers clearly separating them from previous programmes and/or commercial breaks.

3.2.2)
On-screen credits
In all cases, on-screen credits can be inserted only by the EBU or by the Host Broadcaster as the case may be in the
international signal. No Participating Broadcaster shall be allowed to include any on-screen credits during any
transmission of the Show without the prior written authorization of the EBU. Only the Participating Broadcasters
having actually transmitted the international signal with on-screen credits shall be entitled to receive a share of the
revenue generated therefrom.
3.3)
Offer of commercial air-time
Up to the Sponsorship Deadline each Participating Broadcaster able to offer commercial air-time before, during and
after the Show must offer it on a first-refusal basis to the official marketing partners or suppliers of the EYD.
Subsequently, any commercial air-time which remains available must be offered to the official marketing partner(s),
on a first-refusal basis. No official marketing partners or suppliers must ever be charged more than any other
advertiser for the same commercial air-time.
If an International Sponsor decides not to buy any or all of the commercial air-time, the Participating Broadcaster is
free to sell any or all of it to another company, provided that the latter does not operate in conflict with the
International Sponsor. The advice of the EBU Permanent Services must be sought by Participating Broadcasters
before any commercial air-time sales agreements are entered into, in order to prevent possible conflicts.
3.4)
Merchandising
The EBU owns the merchandising and licensing rights to the EYD and reserves the right to grant exclusive
merchandising rights in relation to sportswear, fashion apparel and single promotional products to a merchandising
partner. The revenue generated by such merchandising sales shall be included in the centralized marketing revenue
to be shared. Consequently, Participating Broadcasters wishing to market merchandising products other than those
mentioned above on their territory shall seek the prior written authorization of the EBU Executive Supervisor in order
to prevent possible conflicts with the merchandising partner.

Annexe 1
Duties of the Host Broadcaster
The obligations of the Host Broadcaster are outlined in a separate set of rules entitled the Host Broadcaster
Agreement. The following points reflect the main duties of the Host Broadcaster vis-à-vis the Participating
Broadcasters.
1) Production of the Show
a) The Host Broadcaster shall ensure the complete production of a live uninterrupted television programme on the
agreed date and with the agreed timing, lasting approximately 90 minutes in accordance with top-level quality
and editorial standards. The final decision on all editorial matters shall be taken by the EBU Permanent Services.
The Host Broadcaster shall ensure the delivery of the signal of the production to the Eurovision network. The
international signal to be delivered shall be a clean feed.
b) The Host Broadcaster, in consultation with the EBU Executive Supervisor, shall propose a production budget for
the EYD and the Show, to be approved by the Steering Group.
c) The Host Broadcaster shall, in cooperation with the EBU Executive Supervisor, appoint an organizing committee
and indicate the names of the persons for all major positions. At no stage before the preparations of the EYD and
the Show shall the Host Broadcaster be entitled to enter into any negotiations on a possible sharing of production
responsibilities with third parties without prior written approval by the EBU.
d) The Host Broadcaster shall, for the benefit of the Participating Broadcasters and of the Show determine the
running order of the Show as well as the order of appearance of the Contestants in the Show. The Host
Broadcaster shall provide a detailed rehearsal schedule.
e) The Host Broadcaster shall make every effort to meet the requests of the Participating Broadcasters in relation to
the performance of their solo dances, where feasible and insofar as the request does not conflict with the creative
concept of staging the event and on condition that information is given by the Participating Broadcasters to the
Host Broadcaster as indicated in the Delivery Schedule.
f) The Steering Group is responsible for the dances and their performance being in accordance with the present
Rules, while the Host Broadcaster shall ensure that all necessary measures are taken to guarantee the
uninterrupted and undisturbed performance by the artists during the recording of the Show.
g) The international presenters to be appointed for the Show shall be neutral and shall not have been involved in
any manner whatsoever in the composition of the accompanying music, and/or in the creation of the
choreography of any dance participating in the EYD
h) The Host Broadcaster shall make available a minimum of ten commentary booths, for which an acceptable
market rate may be charged.
i)
The Host Broadcaster shall provide for at least one commercial break during the Show for those Participating
Broadcasters wishing to use it. The exact number of such breaks and the duration thereof shall be decided by the
EBU Executive Supervisor in cooperation with the Host Broadcaster by no later than mid-April before the Show
takes place.
2) Organization of the Event
a) The Host Broadcaster shall identify a suitable venue for organizing the EYD, subject to the approval of the EBU
Executive Supervisor in consultation with the Steering Group. Should that venue be approved, the Host
Broadcaster shall be responsible for booking it for the entire period of the event.
b) The Host Broadcaster shall ensure that sufficient hotel accommodation (at least 100 rooms) is available for the
Participating Broadcasters' delegations at reasonable European prices. The Host Broadcaster (or the designated
travel agent) shall be entitled to ask for 50% pre-payment of the rooms.
c) The Host Broadcaster shall ensure that all necessary and appropriate measures are taken to ensure the safety
and security of all the contestants and all the members of their delegations at all times throughout the entire
period of the event, in the host city. To that end, the Host Broadcaster shall present a detailed security plan in
cooperation with the local authorities, to be approved by the EBU Executive Supervisor.
d) The Host Broadcaster shall deal with all import and export formalities for material and equipment needed for the
event. If a delegation wishes to bring any special equipment into the host country, this shall be done at its own
expense, and the Host Broadcaster must be notified thereof by the date mentioned in the Event Schedule.

e) Throughout the Event Week, the Host Broadcaster shall organize a social programme.
3) Warranties
a) All participants, fans and international press must be guaranteed the right of free expression, assembly and
contact with the citizens of the host country, in accordance with European standards.
b) All participants (including organizers, partners and delegations), all fans able to demonstrate that they have
acquired a ticket, and all journalists given accreditation to the event by the EBU ("accredited journalists") must be
able to acquire sufficiently in advance an entrance visa for the entire duration of the event.
c) All participants, fans and accredited journalists shall have free access to all public facilities and shall be able to
move around in the host city and country without any authorization or restriction, but in full compliance with the
terms and conditions of their accreditation.
d) All participants, fans and accredited journalists shall have the right to talk with or interview, also with the purpose
of publication, all citizens of the host city and country.
e) If a dedicated place in the host city is decided upon, all participants, fans, accredited journalists and the citizens
of the host country shall have free access to such place.
f) The Government of the host country guarantees freedom of expression, in accordance with Article 10 of the
European Convention on Human Rights and in line with the case-law of the European Court of Human Rights, to
all participants, fans, accredited journalists and the individual citizens of the country who give interviews.
g) The Host Broadcaster shall indemnify the EBU against any claims whatsoever from other Participating
Broadcasters in respect of any breach of its obligations pursuant to the present Rules.
4) Decisions
The EBU Executive Supervisor, acting on behalf of the EBU, shall take the final decision in any dispute between
the Participating Broadcasters and the Host Broadcaster.

The Role of the Steering Group (SG)
for the Eurovision Young Dancers (EYD)
The SG is the executive Expert Committee appointed by the EBU Music and Dance Bureau to represent the
interests of the Participating Broadcasters and take decisions on their behalf in the frame of the organization and
production of the EYD. The decisions taken by the SG shall be binding upon the Participating Broadcasters. The
SG is required to take decisions in the general interest of the EYD, and not in the interest of some of the
participants.
The composition of the SG varies from a year to another and its composition is mentioned in the Event Schedule.
The SG together with the EBU Executive Supervisor shall be responsible for:

approving the composition of the Jury;
approving the running order and the script of the Show
establishing and approving the Rules of the EYD and ensuring that they are fully respected;
approving the development and future format of the EYD;
approving all relevant changes in the format and the production of the Show;
approving the production budget of the EYD;
overseeing the yearly preparation by the Host Broadcaster. To that end, the SG shall meet four to five times
before the start of the Event Week or, alternatively, the telephone conferences can be organized;
moderating in case of a dispute between the Participating Broadcasters and the Host Broadcaster, it being
understood that in case no agreement can be found, the EBU Executive Supervisor shall have final word
which shall be binding upon all Parties.
In case of lack of unanimity, the SG shall decide by a simple majority vote, with each member of the Group having
one vote. In case of equal voting, the vote of the Chairperson shall be decisive.

Annexe 3
Duties of the EBU
1) The EBU Executive Supervisor shall work closely with the Host Broadcaster to support all aspects of the national
planning and production.
2) The EBU shall ensure that the international transmission of the Show does not breach any national laws. The
EBU shall also be responsible for ensuring that the Participating Broadcasters grant the agreed sponsorship and
advertising exposure to the marketing partners and suppliers, if any.
3) The EBU Permanent Services shall be responsible for the marketing of all commercial exploitation rights for the
benefit of the Participating Broadcasters and the Host Broadcaster, in liaison with the EBU's Agent (if appointed).
4) The EBU shall be responsible for all aspects of the branding of the EYD and shall bear the cost of such branding.
The branding chosen shall be approved by the Steering Group.
5) The EBU Permanent Services shall, in cooperation with the EBU's Agent, be responsible for collating market
information on the Show to help boost the possibilities for pan-European sponsorship of subsequent editions.
6) The EBU shall create and administer the official website of the EYD. The cost of establishing and maintaining the
website shall be paid by the EBU.
7) The EBU may, in cooperation with the EBU's Agent, be responsible for the creation of an international highlights
tape of the EYD to be used for commercial, promotional and sales purposes.
8) The EBU Executive Supervisor shall be responsible for overseeing voting throughout the Show, for any decisions
required in the course of the voting and for giving any necessary instructions to the international presenters and
the scoreboard operator(s).
9) The EBU Permanent Services shall be responsible for managing the archives of the EYD and of the Show.
