Recognition of professional qualifications, (Commission proposal for a directive)
Uznávání profesních kvalifikací (návrh Komise na směrnici)
• Commission assessment concerning the Council common position and the
proposal from the European Parliament
The Commission takes the view that the common position of the Council reflects overall the
key elements of its initial proposal and of the amendments of the European Parliament. With
regard to the provision of services, the Commission regrets that the common position does
not further facilitate the conditions imposed on the service provider, but accepts the principle
of control by the host Member State. The Commission finds that in view of the current level of
administrative cooperation between the Member States, the common position strikes an
acceptable balance between making the provision of services easier and enabling the host
Member State to verify the services provided on its territory. The Commission therefore
supports the common position adopted by the Council by qualified majority.

• Posouzení Komise zaměřené na společný postoj Rady a návrh Evropského
parlamentu
Komise zaujímá názor, že uvedený společný postoj Rady odráží celkové klíčové prvky jejího
výchozího návrhu a změn navržených Evropským parlamentem. S ohledem na poskytování
služeb Komise lituje, že tento společný postoj již dále neulehčuje podmínky kladené na
poskytovatele služeb, ale přijímá zásadu kontroly hostitelským členským státem. Komise
dochází k názoru, že ve světle současné úrovně administrativní spolupráce mezi členskými
státy tento společný postoj zdůrazňuje přijatelnou rovnováhu mezi usnadněním poskytování
služeb a umožněním členskému státu, aby prováděl ověřování služeb poskytovaných na
jeho území. Komise z tohoto důvodu podporuje společný postoj přijatý Radou
prostřednictvím kvalifikované většiny.

• The European Parliament has started its first reading on the Service Directive
Mrs. Gebhardt from the Committee on Internal Market and Consumer Protection is the
leading rapporteur. In addition eight other Committees will give their opinion.

• A working party on the Services Directive was set up at the European Parliament
The draft directive - also known as the Bolkestein directive - is regarded as one of the most
important issues coming up before MEPs in the European Parliament's current term of office.
The working party is intended to make it easier for MEPs and political groups to cooperate
and exchange information.

• V Evropském parlamentu byla vytvořena pracovní skupina pro směrnici o službách
Návrh směrnice – která je rovněž známa jako Bolkesteinova směrnice – se považuje za
jednu z nejvýznamnějších věcí, jež bude předložena poslancům Evropského parlamentu
v současném funkčním období. Účelem této pracovní skupiny je usnadnit spolupráci a

•The European Economic and Social Committee’s opinion calls for the scope of the
Services Directive to be clarified
The EESC has adopted a series of proposals setting out concrete indications on how the
debate should proceed and what changes are needed to the draft Directive. The Committee
draws attention to: the need to produce the assessments of the proposed Directive
necessary to address the concerns of the interests of organised civil society across Europe
as well as the need to set out more clearly the scope of the Directive and the distinctions
between different types of services.

• Stanovisko Evropského hospodářského a sociálního výboru požaduje vyjasnění
předmětu aplikace směrnice o službách
Evropský hospodářský a sociální výbor přijal řadu návrhů, jež vytyčují konkrétní směry, jimiž
by se měla ubírat debata a které naznačují, jaké změny je třeba provést v návrhu směrnice.
Výbor upozorňuje na následující aspekty: potřeba vytvořit posouzení navrhované směrnice
nezbytná pro řešení obav spojených se zájmy organizované občanské společnosti napříč
Evropou, jakož i potřeba jasněji stanovit předmět aplikace této směrnice a rozlišení mezi
různými typy služeb.

• Results of a study on the economic impact of the proposal for a directive on services
This report presents the economy wide effects of reducing barriers according to the Service
Directive. Reducing barriers to service provisions intensifies competition and forces firms to
cut prices to the benefit of consumers, governments and business. The calculation shown in
this study shows that the Service Directive would yield economic gains to all Member States.

• Výsledky studie o hospodářském dopadu návrhu na směrnici o službách
Tato zpráva představuje vlivy odstraňování překážek podle směrnice o službách s dosahem
na celou ekonomiku. Odstraňování překážek, jež brání v poskytování služeb, povede
k zesílení hospodářské soutěže a bude vyvíjet tlak na firmy, aby snižovaly ceny ku
prospěchu spotřebitelů, státního a podnikového sektoru. Výpočty uvedené v této studii
naznačují, že směrnice o službách by měla znamenat ekonomický přínos pro všechny
členské státy.

• Disagreement in the Commission over the Services Directive
According to news papers, the European Commission agreed on 2 March to water down
proposals to open up Europe's market in services in an attempt to defuse the political row
about the directive. It was said, for example, that the “country of origin” principle should be
rewritten. The move follows strong opposition towards the directive by France, Germany and
the European Parliament.

• Neshoda v Komisi ohledně směrnice o službách
Podle zpráv z tisku se Evropská komise 1. března dohodla, že zeslabí návrhy na otvírání
evropského trhu se službami ve snaze zmírnit politické napětí, jež panuje kolem této
směrnice. Bylo například řečeno, že by mělo dojít k přepsání zásady „země původu“. Tento
posun sleduje silný odpor vůči této směrnici, který vychází z Francie, Německa a
Evropského parlamentu.

3rd Money laundering Directive
3. směrnice o praní špinavých peněz
• The European Parliament has started its first reading
Mr. Nassauer from the Committee on Civil Liberties, Justice and Home Affairs is the lead
rapporteur. In addition five other Committees will give their opinion. In recognition of
concerns that the Second Money Laundering Directive has yet to be properly implemented,
Nassauer proposes that member states should be given two years rather than one to
transpose the directive, and that the commission should report on the implementation of the
directive on a two-yearly rather than three-yearly basis.

• Evropský parlament zahájil její první čtení
Hlavním zpravodajem je pan Nassauer z Výboru občanských svobod, spravedlnosti a
vnitřních záležitostí. Kromě toho poskytne svá stanoviska ještě pět dalších výborů. Při
vědomí toho, že je stále ještě nutné zajistit řádné provedení 2. směrnice o praní špinavých
peněz, pan Nassauer navrhuje, že by členské státy měly mít lhůtu dvou let namísto jednoho
roku pro provedení této směrnice a že Komise by měla vydávat zprávu o provedení směrnice
jednou za dva roky namísto tříletého cyklu.
