Zadavatel obdržel následující dotaz k zadávacím podmínkám, který tímto zodpovídá.
Dotaz:
Lhůta pro vydání formálního potvrzení Úřadu veřejné správy (daňový úřad) naší
země o neexistenci nedoplatku na spotřební daní je minimálně 30 dní. Ačkoliv
jsme požádali o vydání výše uvedeného potvrzení brzy po vyhlášení zadávacího
řízení, obávám se, že je pravděpodobnější, že potvrzení nám daňovým úřadem
nebude vystaveno včas před koncem lhůty pro podání nabídek (28. dubna
2015).
Za výše uvedené situace bych potřeboval vědět, zda byste přijali jako platné
naše podání nabídky (v rámci termínu 28. dubna 2015) bez tohoto formálního
potvrzení, ale s čestným prohlášením, že naše společnost nemá daňový
nedoplatek na spotřební dani (v souladu s § 53 odst. 3 písm. b) zákona č.
137/2006 Sb., o veřejných zakázkách).
Bude naším místopřísežným prohlášením předat výše uvedené potvrzení co
nejdříve, jakmile nám bude vystaveno daňovým úřadem.
Silně věřím, že přijmete tento náš návrh, takže nebudeme vyloučení za
zadávacího řízení kvůli byrokratické záležitosti.
Odpověď:
Obecně v případě, že dodavatel nepředloží kompletní nabídku se všemi
požadovanými dokumenty prokazujícími splnění kvalifikace, potom taková
nabídka nebude považována formálně za platnou/správnou nabídku.
Nicméně hodnotící komise má právo oficiálně vyžádat uchazeče o doplnění
nabídky (pouze dokumenty související s kvalifikací) v navíc poskytnuté
lhůtě. Upozorňujeme, že v této fázi zadávacího řízení není možné oznámit

nebo předpokládat žádné rozhodnutí hodnotící komise, jelikož všechny
úkony jsou na jejím uvážení.
Konkrétně k tomuto dotazu upozorňujeme na článek 3.3.1 písm. f)
zadávací dokumentace:

the bidder’s registered office, place of business or residence;
1. According to Section 53, paragraph 3 (b) of the Act, the
bidder must submit as evidence of this basic qualification a
certificate from the competent tax authority and an
affidavit stating that the bidder is not in arrears with
excise tax payments. The certificate and affidavit must
explicitly confirm that the bidder meets this basic
qualification requirement;
2. The affidavit must be submitted in original and bidders may
use an affidavit attached hereto as Annex No. 2. Other
documents constituting the evidence of this basic
qualification may be attached to the bid as uncertified copies.
The winner of the tender may be required to submit originals
or certified copies before entering into the contract;

In English:
The Contracting Authority received a question regarding the tender conditions from one
of the potential suppliers interested in this tender. The answer to the question is provided
hereby.
Question:
The time taken from the Public Administration (tax authority) of our nation to
issue the formal certificate stating that the company is not in arrears with
excise tax payments is at least 30 days. Even though we have made request for
the issuing of the a.m. certificate soon after the tender call emission, I’m afraid
that it’s rather sure that the certificate will be not made available to us by the
tax authority in time for the tender presentation deadline (April 28 th 2015).
In the a.m. condition I would need to know if you would accept as valid our
tender submission (within April 28th) without the a.m. formal certificate, but
including our signed affidavit with the statement that the company is not in
arrears with excise tax payments (according to Act No. 137/2006, Section 53,
paragraph 3 (b)).
It will be our solemn commitment to transmit the a.m. formal certificate to you
as soon as it will be made available by the tax authority.
I strongly hope that you will accept such a proposal of ours, so that we will be
not excluded from the tender selection due to a bureaucratic issue.
Answer:
In general in case a contractor does not submit a complete bid with all
required documents demonstrating qualification meeting, then such a bid
will not be considered formally as a valid/correct bid. Nevertheless
evaluation commission has a right to officially request a bidder to complete
its bid (only documents related to qualification) in an extra given period of

time. Please note that at this phase of the tender procedure it is not
possible to notify or assume any decision of the evaluation commission as
all acts are in its discretion.
