Amb el suport de 2 EDITORIAL Una de les temàtiques al voltant de la qual ha girat el programa Mercator-Legislació durant aquest any ha estat l’estudi i seguiment del procés d’adaptació legislatiu a la Unió Europea per part dels estats candidats a integrar-s’hi. La nostra atenció s’ha fixat , específicament en el camp dels drets lingüístics i de les polítiques de protecció i promoció de les dites llengües regionals i minoritàries 1 Un exemple interessant és el cas de la República Txeca, de la qual publiquem en aquest Butlletí la llei sobre minories així com el seu decret d’aplicació. Es tracta de la Llei 273/2001, de 10 de juliol, que estableix i regula els drets dels membres de les minories nacionals i introdueix esmenes a altres lleis per tal de garantir-ne el seu exercici. L’aprovació d’aquesta llei sorgeix dins del context d’una crítica internacional forta respecte a la llei txeca de ciutadania i, més en concret, respecte a la situació en la qual es troba el poble roma dins d’aquest estat. Això passa al moment en què l’acció de govern té com a primer objectiu la incorporació d’aquesta república a la Unió Europea. L’entrada, d’aquí a poc, d’aquests estats a la Unió ens aportarà noves perspectives i experiències molt diverses que hem de saber comprendre, tant pel que fa a allò que ens és comú com en el que ens distingeix. Tal com ja hem presentat en dossiers anteriors (núm. 10) sobre Hongria 2 i sobre Eslovènia3m(núm.7) , creiem que tenim nombrosos elements nous que segurament enriquiran les nostres anàlisis i precisions sobre els drets i les polítiques lingüístiques a la futura Unió. Cal també esperar, en aquesta conjuntura, com es defineixen les polítiques de la mateixa Unió, en conjunció amb el nou compromís europeu de garantir la diversitat lingüística. El present Butlletí es completa amb un document produït en el marc de la primera institució mundial que s’ocupa de la cultura. Es tracta d’una declaració aprovada fa uns mesos a la 31ª Conferència General de la Unesco, anomenada “Declaració Universal sobre la Diversitat Cultural”. Si bé no és un document específic sobre llengües, i malgrat que ni tan sols presenta un contingut que ens pugui ajudar a fer una interpretació més favorable per a la protecció de la diversitat lingüística, sí que estableix un model que esperem pugui concretar-se en el terreny lingüístic, dintre de la línia de la Declaració Universal dels Drets Lingüístics, text aprovat fa sis anys a Barcelona per més de cent organitzacions no governamentals i encara posat a discussió en la mateixa Unesco. Lamentem, en aquest cas, no haver pogut publicar el dossier corresponent (núm. 11). An interesting case is that of the Czech Republic, of which we publish in the present Bulletin the act on minorities as well as its regulation decree. The Act 273/2001, of July 10th, establishes and regulates the rights of members of national minorities and introduces amendments to other acts in order to guarantee its application. The approval of this act occurred within a context of strong international criticism as regards the Czeck act on citizenship, more specifically in relation to the nowadays situation of the Roma population in this state; at the same time, all this much happens when the government’s main objective is the incorporation of the republic into the European Union. The soon accession of these countries to the Union will contribute new perspectives and diverse experiences which we should comprehended either in relation to common issues as, on the other hand, to those which somehow make us different. Thus, as we have presented in our previous Dossier (number 10) on Hungary2, and in Dossier n. 7 on Slovenia3 , we believe that we have new elements available which will surely enrich our analysis on language rights and policies in the future Union. At this juncture it is important to appraise how EU policies themselves are defined, in conjunction with the new European undertaking to ensure linguistic diversity. This Bulletin comes complete with a new document issued in the international framework, that is a declaration approved some months ago in the Unesco’s 31st General Conference, called “Universal declaration on Cultural Diversity”. Although this is not specifically a language-related document, and despite the fact that its contents do not even allow a more favourable interpretation as regards the protection of language rights, it does establish a model which we hope will be implemented in the linguistic field by means of a Universal Declaration of Linguistic Rights –a text approved six years ago in Barcelona by more than one hundred non-governmental organizations, and still under discussion in the Unesco itself. We are sorry that due to technical questions we are not able to publish in the present bulletin its corresponding dossier, which we postpone until its next issue. 1 For further information we refer to “Dossiers” n. 1, 7 and 10, included in preceding Mercator-Bulletins (n. 39, 45 and 49, respectively): http://www.troc.es/ciemen/mercator/index-gb.htm 2 “Hungary or the inherited diversity” by Sergi Vilaró, Mercator-Legislation centre (CIEMEN, Barcelona) 3 “The protection of ethnic minorities in Slovenia: the case of the Italian community” by Miran Komac, Institute for Ethnic Studies (Ljubljana). 4 Sbírka zákon u c . 273/2001 Cástka 104 - rozeslána dne 2. srpna 2001 ZÁKON ze dne 10. cervence 2001 o právech príslušníku národnostních menšin a o zmene ne kterých zákon u PREAMBULE Parlament C eské republiky jako demokratického a právního státu, maje na zreteli právo na národnostní a etnickou identitu jako soucást lidských práv, respektuje identitu príslušníku národnostních menšin jako jednotlivcu i skupiny projevující se zejména vlastní kulturou, tradicemi ci jazykem, maje na zreteli vytvárení multikulturní spolecnosti a usilujíc o harmonické soužití národnostních menšin s vetšinovým obyvatelstvem, zarucuje príslušník u m národnostních menšin právo na úcinnou úcast v kulturním, spolecenském a hospodárském živote a ve verejných záležitostech, zvlášte tech, které se týkají národnostních menšin, chráne práva príslušníku národnostních menšin v souladu s mezinárodními smlouvami o lidských právech a základních svobodách, jimiž je Ceská republika vázána, s Ústavou a s Listinou základních práv a svobod, se usnesl na tomto zákone Ceské republiky: CÁST PRVNÍ O PRÁVECH PRÍSLUŠNÍKU NÁRODNOSTNÍCH MENŠIN HLAVA I ÚVODNÍ USTANOVENÍ §1 P r edm e t úpravy (1) Tento zákon upravuje práva príslušníku národnostních menšin a pusobnost ministerstev, jiných správních úradu a orgánu územních samosprávných celku (dále jen „orgány verejné správy“)ve vztahu k nim. 2) Ustanovení zvláštních právních predpisu , která upravují práva príslušníku národnostních menšin, nejsou tímto zákonem dotcena. §2 5 Vymezení základních pojmu (1) Národnostní menšina je spolecenství obcanu Ceské republiky žijících na území soucasné Ceské republiky, kterí se odlišují od ostatních obcanu zpravidla spolecným etnickým puvodem, jazykem, kulturou a tradicemi, tvorí pocetní menšinu obyvatelstva a zároven projevují vuli být považováni za národnostní menšinu za úcelem spolecného úsilí o zachování a rozvoj vlastní svébytnosti, jazyka a kultury a zároven za úcelem vyjádrení a ochrany zájmu jejich spolecenství, které se historicky utvorilo. (2) Príslušníkem národnostní menšiny je obcan Ceské republiky, který se hlásí k jiné než ceské národnosti a projevuje prání být považován za príslušníka národnostní menšiny spolu s dalšími, kterí se hlásí ke stejné národnosti. HLAVA II PRÁVA PRÍSLUŠNÍKU NÁRODNOSTNÍCH MENŠIN §3 Výkon práv príslušníku národnostních menšin (1) Príslušník u m národnostních menšin se zarucuje jednotlive nebo spolecne s jinými p r íslušníky národnostní menšiny výkon jejich práv stanovených tímto zákonem, zvláštními právními predpisy ci mezinárodními smlouvami o lidských právech a základních svobodách, kterými je Ceská republika vázána. (2) Výkon práv príslušníku národnostních menšin nesmí být omezován nebo znemožnován. §4 Svobodná volba p r íslušnosti k národnostní menšin e (1) Z príslušnosti k národnostní menšine nesmí nikomu vzejít žádná újma. (2) Orgány verejné správy nevedou evidenci príslušník u národnostních menšin. Získávání, zpracovávání a používání osobních údaju ohledne príslušnosti k národnostní menšine se rídí 3 ustanoveními zvláštních právních predpisu . Údaje o p r ihlášení se k národnosti získané t e mito orgány pri scítání lidu nebo podle jiného zvláštního zákona, které umožnují urcení príslušnosti k národnostní menšine , nesmejí být použity pro jiný úcel, než pro který byly shromáždeny a uloženy, a po statistickém zpracování musejí být zniceny. §5 Právo na sdružování príslušníku národnostní menšiny Príslušníci národnostní menšiny se mohou sdružovat v národnostních sdruženích i v politických stranách a v politických hnutích za podmínek a zpusobem stanoveným zvláštními právními 4 predpisy . 3 Zákon c . 101/2000 Sb., o ochrane osobních údaju a o zmene nekterých zákonu , ve znení pozdejších predpisu. 4 Zákon c . 83/1990 Sb., o sdružování obcanu , ve znení pozdejších predpisu . Zákon c . 221/1999 Sb., o vojácích z povolání, ve znení zákona c . 155/2000 Sb. 6 §6 Právo ú c asti na r ešení záležitostí týkajících se národnostní menšiny (1) Príslušníci národnostních menšin mají právo na aktivní úcast v kulturním, spolecenském hospodárském živote a ve verejných záležitostech, zvlášte pak tech, které se týkají národnostních menšin, jejichž jsou príslušníky, a to na úrovni obce, kraje i na celostátní úrovni. (2) Právo podle odstavce 1 vykonávají príslušníci národnostních menšin zejména prostrednictvím 5 výboru pro národnostní menšiny, zrizovaných podle zvláštních právních predpisu , a Rady vlády pro národnostní menšiny (dále jen „Rada“). (3) Vláda zrizuje jako svuj poradní a iniciativní orgán pro otázky týkající se národnostních menšin a jejich príslušníku Radu. Vjejím cele stojí clen vlády. (4) Cleny Rady jsou zástupci národnostních menšin a zástupci orgánu verejné moci s tím, že nejméne polovinu clenu Rady tvorí zástupci národnostních menšin, kte r í byli navrženi sdruženími príslušníku národnostních menšin. (5) Do pusobnosti Rady patrí a) zajiš t ovat prípravu opatrení vlády, která se týkají práv príslušníku národnostních menšin v Ceské republice, b) vyjadrovat se k návrhum zákonu , k návrhum narízení vlády a k opat rením, týkajícím se práv príslušníku národnostních menšin, pred jejich predložením vláde, c) pripravovat pro vládu souhrnné zprávy o národnostní situaci na území Ceské republiky, d) pripravovat pro vládu nebo pro ministerstva ci jiné správní úrady doporucení k zajištení potreb príslušníku národnostních menšin, zejména v oblastech školství, kultury a médií, používání materského jazyka, spolecenského a kulturního života, e) spolupracovat s orgány územních samosprávných celku pri praktickém zabezpec ování národnostní politiky státu, f) navrhovat rozdelování financních prostredku vynakládaných ze státního rozpoctu na podporu aktivit príslušníku národnostních menšin. (6) Podrobnosti o složení Rady, zpusobu jmenování clenu Rady a o cinnosti Rady stanoví statut Rady, který schvaluje vláda. §7 Právo na užívání jména a p r íjmení v jazyce národnostní menšiny Príslušníci národnostních menšin mají právo na užívání svého jména a príjmení v jazyce 6 národnostní menšiny za podmínek stanovených zvláštním právním predpisem 5 Zákon c . 128/2000 Sb., o obcích (obecní zrízení), ve znení zákona c. 273/2001 Sb. Zákon c . 131/2000 Sb., o hlavním m este Praze, ve znení pozdejších predpisu . 6 Zákon c . 301/2000 Sb., o matrikách, jménu a príjmení a o zmene nekterých souvisejících zákonu . 7 §8 Právo na vícejazy c né názvy a ozna c ení (1) Príslušníci národnostních menšin, které tradicne a dlouhodobe žijí na území Ceské republiky, mají právo, aby název obce, v níž žijí, názvy jejích cástí, ulic, jiných verejných prostranství, ozna cení budov orgánu verejné správy a volebních místností byly uvedeny rovnež v jazyce národnostní menšiny. (2) Podmínky pro výkon práva podle odstavce 1 a zpusob uvádení vícejazycných názvu a 7 oznacení stanoví zvláštní právní predpis §9 Právo na užívání jazyka národnostní menšiny v ú r edním styku a p r ed soudy Príslušníci národnostních menšin, které tradicne a dlouhodobe žijí na území Ceské republiky,mají právo na užívání jazyka národnostní menšiny v úredním styku a pred soudy. Podmínky pro výkon 8 tohoto práva upravují zvláštní právní predpisy §10 Právo na užívání jazyka národnostní menšiny ve v e cech volebních 9 Za podmínek stanovených zvláštními právními predpisy mají príslušníci národnostních menšin, které tradicne a dlouhodobe žijí na území Ceské republiky, právo na zverejnení oznámení o dobe a míste konání voleb a na další informace pro volice v jazyce národnostních menšin. § 11 Právo na vzd e lávání v jazyce národnostní menšiny (1) Príslušníci národnostních menšin, které tradicne a dlouhodobe žijí na území Ceské republiky, mají právo na výchovu a vzdelávání ve svém materském jazyce ve školách, predškolních 10 zarízeních a školských za rízeních za podmínek, které stanoví zvláštní právní predpisy 7 Zákon c . 128/2000 Sb., ve znení zákona c . 273/2001 Sb. 8 § 18 zákona c . 99/1963 Sb., obcanský soudní rád, ve znení zákona c . 30/2000 Sb. § 7 zákona c . 335/1991 Sb., o soudech a soudcích. § 2 zákona c . 141/1961 Sb., o trestním rízení soudním (trestní rád), ve znení pozdejších predpisu . § 33 zákona c .182/1993 Sb., o Ústavním soudu. § 12 zákona c . 563/1991 Sb., o úcetnictví. § 46a zákona c . 202/1990 Sb., o loteriích a jiných podobných hrách, ve znení zákona c . 149/1998 Sb. § 3 zákona c . 337/1992 Sb., o správe daní a poplatku , ve znení zákona c . 35/1993 Sb. a zákona c . 255/1994 Sb..- 5 Zákon c . 152/1994 Sb., o volbách do zastupitelstev v obcích a o zmene a doplnení nekterých dalších zákon u , ve znení pozdejších predpisu . Zákon c . 29/1984 Sb., o soustave základních škol, stredních škol a vyšších odborných škol (školský zákon), ve znení pozdejších predpisu . 8 (2) Príslušníci národnostních menšin podle odstavce l mohou za podmínek stanovených (8) zvláštními právními predpisy z r izovat a) soukromé školy s vyucovacím jazykem národnostní menšiny nebo s výukou jazyka národnostní menšiny jako vyucovacího predmetu, b) soukromá predškolní zarízení a soukromá školská zarízení. § 12 Právo na rozvoj kultury p r íslušník u národnostních menšin (1) Príslušníci národnostních menšin mají právo na zachování a rozvíjení svého jazyka, kultury a tradic a na jejich respektování. (2) Stát vytvárí podmínky pro zachování a rozvoj kultury, tradic a jazyku príslušníku národnostních menšin, které tradicne a dlouhodobe žijí na území Ceské republiky; podporuje zejména programy zamerené na divadla, muzea, galerie, knihovny, documentacní cinnost a další aktivity pr íslušník u národnostních menšin. Za tím úcelem poskytuje dotace ze státního rozpoctu; podmínky a zpusob poskytování dotací stanoví vláda narízením. §13 Právo na rozši r ování a p r ijímání informací v jazyce národnostní menšiny (1) Príslušníci národnostních menšin mají právo na rozširování a prijímání informací v jazyce svých národnostních menšin. (2) Stát podporuje pro zachování a rozvoj kultury, tradic a jazyku vydávání periodického i neperiodického tisku vydávaného v jazycích národnostních menšin, které tradicne a dlouhodobe žijí na území Ceské republiky, a rozhlasové a televizní vysílání v jazycích národnostních menšin, které tradicne a dlouhodobe žijí na území Ceské republiky. Za tímto úcelem poskytuje dotace ze státního rozpoctu; podmínky a zpusob poskytování dotací stanoví vláda narízením. V § 49 se na konci odstavce 1 tecka nahrazuje cárkou a doplnují se písmena d) a e), která znejí: „d) omezuje nebo znemožnuje príslušníku národnostní menšiny výkon práv príslušníku národnostních menšin, e) pusobí jinému újmu pro jeho príslušnost k národnostní menšine nebo pro jeho etnický puvod, pro jeho rasu, barvu pleti, pohlaví, sexuální orientaci, jazyk, víru nebo náboženství, pro jeho politické nebo jiné smýšlení, c lenství nebo c innost v politických stranách nebo politických hnutích, odborových organizacích nebo jiných sdruženích, pro jeho sociální puvod, majetek, rod, zdravotní stav anebo pro jeho stav manželský nebo rodinný.“. 2. V § 49 odst. 2 se za slovy „1 000 Kc “ spojka „a“ nahrazuje cárkou a na konci textu se doplnují slova „a za prestupek podle odstavce 1 písmeno d) a e) pokutu do 5 000 K c “. C ÁST T R ETÍ Zmena zákona o obcích § 15 Zákon c . 128/2000 Sb., o obcích (obecní zrízení), se mení takto: 1. V § 29 odst. 2 se císlice „20“ nahrazuje císlicí „10“ a císlice „50“ se nahrazuje císlicí „40“. 2. V § 117 odst. 3 vete první se císlice „15“ nahrazuje císlicí „10“, na konci ve ty druhé se tecka nahrazuje stredníkem a doplnuje se text „vždy však príslušníci národnostních menšin musí tvorit nejméne polovinu všech clenu výboru.“. C ÁST C TVRTÁ Zmena zákona o krajích § 16 V § 78 odst. 2 zákona c . 129/2000 Sb., o krajích (krajské z r ízení), se c íslice „10“ nahrazuje císlicí „5“, slova „ke stejné národnosti jiné než ceské“ se nahrazují slovy „k národnosti jiné než ceské“ a na konci vety druhé se tecka nahrazuje stredníkem a doplnuje se text „vždy však príslušníci národnostních menšin musí tvorit nejméne polovinu všech clenu výboru.“. C ÁST PÁTÁ Zmena zákona o hlavním meste Praze § 17 V § 78 odst. 2 zákona c . 131/2000 Sb., o hlavním meste Praze, se ve vete první císlice „15“ nahrazuje císlicí „5“, na konci vety druhé se tecka nahrazuje st r edníkem a doplnuje se text „vždy však príslušníci národnostních menšin musí tvorit nejméne polovinu všech clenu výboru.“. Špidla v.r. 12 § 117 odst. 3 zákona c . 128/ 2000 Sb., o obcích (obecní zrízení), ve znení zákona c . 273/2001 Sb.". 11 12 traducció no oficial Llei 273/2001 de 10 de juliol de 2001 sobre els drets dels membres de les minories nacionals, amb esmenes d’altres lleis PREÀMBUL El Parlament de la República Txeca com a parlament d’un estat democràtic i de ple dret, considerant el dret a la identitat nacional i ètnica com part dels drets humans; tot respectant la identitat dels membres de les minories nacionals com a individus i com a grup, representada de manera especial per mitjà de la seva pròpia cultura, tradicions i llengua; tot considerant la creació d’una societat multicultural i amb la intenció de facilitar la convivència harmoniosa de les minories nacionals amb la població majoritària; garantint als membres de les minories nacionals el dret a participar activament en la vida cultural, social, econòmica i en els afers públics, especialment aquells que afectin les minories nacionals; tot protegint els drets dels membres de les minories nacionals de conformitat amb els convenis internacionals sobre drets humans i drets fonamentals als quals la República Txeca està obligada legalment, i amb la Constitució i la Carta de Drets i Llibertats ha determinat emetre per mitjà d’una resolució aquesta Llei de la República Txeca: PART I DRETS DELS MEMBRES DE LES MINORIES NACIONALS CAPÍTOL I DISPOSICIONS INTRODUCTÒRIES Article 1 – Subjecte d’esmena (1) Aquesta llei regula els drets dels membres de les minories nacionals i les responsabilitats dels ministeris, d’altres autoritats administratives i organismes d’administracions d’autogovern regionals (d’ara endavant, “organismes d’administració pública”) que hi tinguin relació. (2) Les disposicions de les regulacions específiques que regulen els drets de les minories nacionals no es veuran perjudicades per aquesta llei. Article 2 – Definició de conceptes bàsics (1) Una minoria nacional és una comunitat de ciutadans de la República Txeca que viuen en el territori de l’actual República Txeca i que en general difereixen dels altres ciutadans per compartir un mateix origen ètnic, llengua, cultura i tradicions; representen una minoria de ciutadans a la vegada que mostren la seva voluntat de ser considerats una minoria nacional amb l’afany de preservar i desenvolupar la seva pròpia identitat, llengua i cultura i els quals, al mateix temps, expressen i preserven els interessos de la seva comunitat, que ha estat formada al llarg de la història. 13 (2) El membre d’una minoria nacional és un ciutadà de la República Txeca que professa un origen ètnic diferent del txec i que desitja ser considerat un membre d’una minoria nacional conjuntament amb d’altres que professin el mateix origen ètnic. CAPÍTOL II DRETS DELS MEMBRES DE LES MINORIES NACIONALS Article 3 - Exercici dels drets de les minories nacionals (1) Es garanteix als membres de les minories nacionals de manera individual o conjunta amb altres membres d’una minoria nacional la capacitat d’exercir els seus drets, determinats per aquesta llei, i les regulacions específiques o convenis internacionals sobre drets humans i llibertats fonamentals als quals la República Txeca està obligada legalment. (2) L’exercici dels drets de les minories nacionals no pot resultar restringit ni denegat. Article 4 – Lliure elecció de la pertinença a una minoria nacional (1) La pertinença a una minoria nacional no ha de representar cap prejudici per a ningú. (2) Els organismes de l’administració pública no duen cap registre dels membres de les minories nacionals. L’obtenció, el tractament i l’ús de les dades relatives a la pertinença a una minoria 1) nacional compleixen amb les disposicions de les regulacions específiques. Les dades que fan referència al professió de l’origen ètnic obtingudes durant els censos, o d’acord amb alguna altra llei especial que permeti determinar la pertinença a una minoria nacional, no podran ser utilitzades per cap altre raó que no sigui per la que aquestes hagin estat recollides i guardades, així com han de ser destruïdes després del seu tractament estadístic. Article 5 – Dret d’associació dels membres de les minories nacionals Els membres de les minories nacionals podran associar-se en associacions nacionals i en partits i moviments polítics sota les condicions i de la manera que es determini per mitjà de les disposicions 2) de les regulacions específiques. Article 6 – Dret de participació en els afers que afectin una minoria nacional (1) Els membres d’una minoria nacional tenen el dret de participar activament en la vida cultural, social i econòmica i en els afers públics, especialment en aquells que afectin les minories nacionals a les quals pertanyin tant a nivell de comunitat, regional o d’àmbit estatal. (2) Els membres d’una minoria nacional exerceixen el seu dret d’acord amb el paràgraf 1, especialment per mitjà de comitès per a les minories nacionals establerts d’acord amb les 3) regulacions específiques i amb el Consell per a les Minories Nacionals (d’ara endavant, “el Consell”). 1) Llei 101/2000 sobre la protecció de dades personals amb esmenes d’altres lleis, segons esmenes. Llei 221/1999 sobre els soldats regulars, amb esmenes de la Llei 155/2000. 3) Llei 128/2000 sobre les Comunitats (governs locals), amb esmenes de la Llei 273/2001. Llei 129/2000 sobre les Regions (governs regionals), amb esmenes de la Llei 273/2001. Llei 131/2000 sobre la capital Praga, amb esmenes. 2) 14 3) El govern estableix el Consell com a organisme consultiu i responsable dels afers que afectin les minories nacionals i els seus membres. Al seu capdavant hi haurà un membre del govern. (4) Els membres del Consell són representants de les minories nacionals i de les autoritats públiques, almenys la meitat d’ells hauran de ser representants de les minories nacionals i designats per associacions de membres de minories nacionals. (5) El Consell té competència per a) disposar la preparació de les mesures governamentals que afectin els drets dels membres de les minories nacionals a la República Txeca. b) expressar opinions al voltant de projectes de llei, regulacions del govern i mesures que afectin els drets dels membres de minories nacionals abans que aquestes siguin transmeses al govern; c) preparar els informes globals del govern sobre la situació de les minories nacionals al territori de la República Txeca. d) preparar les recomanacions del govern, els ministeris o altres autoritats administratives per tal de satisfer les necessitats dels membres de les minories nacionals, especialment en l’àmbit del sistema educatiu, la cultura i els mitjans de comunicació, l’ús de la llengua materna i la vida social i cultural. e) cooperar amb els organismes d’autogovern local en l’aplicació pràctica de les polítiques de l’estat en relació a les minories nacionals; f) proposar la distribució d’ajuts financers provinents dels pressupostos de l’estat per al sosteniment de les activitats dels membres de les minories nacionals. (6) Els detalls relatius a la composició del Consell i a la forma de designació dels seus membres i les seves activitats es determinaran per mitjà de normes del Consell i ratificades pel govern. Article 7 – El dret a fer servir el nom i cognom en la llengua de la minoria nacional Els membres de les minories nacionals tenen dret a fer servir el seu nom i cognom en la llengua de 4) la seva minoria nacional sota les condicions establertes per disposició legal especial. Article 8 – Dret als noms i denominacions plurilingües (1) Els membres de les minories nacionals que hagin viscut tradicionalment i durant un llarg període de temps en el territori de la República Txeca tenen dret a disposar del nom de la comunitat en la que viuen, dels noms dels seus barris, carrers i espais públics, així com dels serveis en els edificis de les autoritats públiques i col·legis electorals, en la llengua de la minoria nacional juntament amb la llengua txeca. (2) Les condicions per a l’exercici d’aquests drets d’acord amb el paràgraf 1 així com la forma de 5) denominar els noms plurilingües s’estableixen per mitjà de disposicions legals específiques. Article 9 – Dret a fer servir la llengua d’una minoria nacional en documentació oficial i en les declaracions i audiències davant d’un tribunal Els membres de les minories nacionals que hagin viscut tradicionalment i durant un llarg període de temps en el territori de la República Txeca tenen dret a fer servir la llengua d’una minoria nacional 4) 5) Llei 301/2000 sobre els registres, noms i cognoms, amb esmenes d’altres lleis. Llei 128/2000 sobre les Comunitats (governs locals), amb esmenes de la Llei 273/2001. 15 en la documentació oficial i en les declaracions i audiències davant d’un tribunal. Les condicions 6) per a l’exercici d’aquest dret s’estableixen per mitjà de disposicions legals específiques. Article 10 – Dret a fer servir la llengua d’una minoria nacional durant les eleccions 7) Sota les condicions establertes per mitjà de disposicions legals específiques , els membres de les minories nacionals que hagin viscut tradicionalment i durant un llarg període de temps en el territori de la República Txeca tenen dret a fer pública la notificació sobre els termes i el lloc de les eleccions, o bé qualsevol altra informació dirigida als votants, en la llengua de les minories nacionals. Article 11 – Dret a l’educació en la llengua d’una minoria nacional (1) Els membres de les minories nacionals que han viscut tradicionalment i durant un llarg període de temps en el territori de la República Txeca tenen dret a la formació i a l’educació en la seva llengua materna a les escoles i institucions escolars i pre-escolars sota les condicions establertes 8) per mitjà de disposicions legals específiques. (2) D’acord amb el paràgraf 1 i sota les condicions establertes per mitjà de disposicions legals específiques, es permetrà als membres de minories nacionals d’establir a) escoles privades en la que es faci servir la llengua de la minoria nacional com a llengua d’ensenyament o s’hi ensenyi la llengua de la minoria nacional com a assignatura; b) institucions escolars o pre-escolars privades. Article 12 – Dret al desenvolupament de la cultura dels membres de les minories nacionals (1) Els membres de les minories nacionals tenen dret a mantenir i desenvolupar la seva llengua, cultura i tradicions i el dret a que se les respecti. (2) L’estat s’encarrega de crear les condicions prèvies per tal de mantenir i desenvolupar la cultura, les tradicions i les llengües dels membres de les minories nacionals que hagin viscut tradicionalment i durant un llarg període de temps en el territori de la República Txeca; dóna suport de manera especial a aquells programes especialitzats en els teatres, museus, galeries, biblioteques, documentació i altres activitats dels membres de les minories nacionals. Amb aquest objectiu, concedirà ajuts financers provinents del Pressupost; les condicions i la forma de la concessió d’ajuts s’estableixen per mitjà d’un decret del govern. 6) Article 18 de la Llei 99/1963 sobre el Codi de Procediments Civils, segons esmenes de la Llei 30/2000. Article 7 de la Llei 335/1991 sobre Tribunals i Jutges. Article 2 de la Llei 141/1961 sobre el Codi Penal, amb esmenes. Article 33 de la Llei 182/1993 sobre el Tribunal Constitucional. Article 12 de la Llei 563/1991 sobre Comptes. Article 46a de la Llei 202/1990 sobre loteries i jocs, esmenada per la Llei 149/1998. Llei 564/1990 sobre l’administració de l’estat i l’administració pròpia en el sistema educatiu, segons esmenes. 16 Article 13 – Dret a difondre i rebre informació en la llengua de la minoria nacional (1) Els membres de les minories nacionals tenen dret a difondre i rebre informació en la seva llengua. (2) Amb l’objectiu de mantenir i desenvolupar la cultura, les tradicions i les llengües, l’estat dóna suport a la publicació periòdica i no periòdica de materials impresos i a emissions de ràdio i televisió en les llengües de les minories nacionals que hagin viscut tradicionalment i durant un llarg període de temps en el territori de la República Txeca. Amb aquest propòsit concedirà ajuts financers provinents del Pressupost; les condicions i la forma de la concessió d’ajuts s’estableixen per mitjà d’un decret del govern. (3) La creació i difusió d’emissions de ràdio i televisió relacionades amb els membres de minories nacionals i executades per operadors autoritzats, s’estableixen per mitjà de disposicions legals 9) específiques. PART II L’esmena de la Llei d’Infraccions Article 14 La Llei 200/1990 d’Infraccions, esmenada per la Llei 337/1992, la Llei 344/1992, la Llei 359/1992, la Llei 67/1993, la Llei 290/1993, la Llei 134/1994, la Llei 82/1995, la Llei 279/1995, la Llei 289/1995, la Llei 112/1998, la Llei 168/1999, la Llei 360/1999, la Llei 29/2000 la Llei 121/2000, la Llei 132/2000, la Llei 151/2000, la Llei 258/2000, la Llei 361/2000, la Llei 370/2000, el Dictamen del Tribunal Constitucional N. 52/2001, la Llei 164/2001, la Llei 254/2001, la Llei 265/2001 i la Llei 274/2001 és esmenada de la següent manera: 1. A l’Article 49, al final del paràgraf 1, el punt final se substitueix per una coma, i s’esmenen els subparàgrafs d) i e) de la següent manera: “d) restringeix o exclou l’exercici dels drets dels membres de les minories nacionals a un membre d’una minoria nacional; e) perjudica a una altra persona per la seva pertinença a una minoria nacional o origen ètnic, raça, color, sexe, orientació sexual, llengua, religió, opinions polítiques o d’altre tipus, pertinença o activitat en partits o moviments polítics, sindicats o altres associacions, origen social, propietat, naixement, condicions de salut, estat civil o familiar.” (...) PART III L’esmena de la Llei sobre les Comunitats Article 15 La Llei 128/2000 sobre les Comunitats (governs locals) és esmenada de la següent manera: 1. A l’Article 29, paràgraf 2, el número “20” se substituteix pel número “10” i el número “50” se substitueix pel número “40”. 2. A l’Article 117, paràgraf 3, el número “15” de la primera frase se substituteix pel número “10”; al final de la segona frase el punt i final se substituteix per un punt i coma seguit del text “però els 9) Llei 483/1991 sobre la Televisió Txeca, segons esmenes. PART IV L’esmena de la Llei sobre les Regions Article 16 A l’Article 72, paràgraf 2, de la Llei 129/2000 sobre les Regions (governs nacionals), el número “10” és substituït pel número “5” i les paraules “el mateix origen ètnic tret del txec” són substituïdes per les paraules “origen ètnic tret del txec”; al final de la segona frase el punt i final és substituït per un punt i coma i el text “però els membres de les minories nacionals sempre han de representar com a mínim la meitat de la totalitat dels membres del comitè”. (2) The provisions of special legal regulations which regulate rights of members of national minorities are not prejudiced by this act. §2 Definition of basic concepts 21 (1) A national minority is a community of citizens of the Czech Republic who live on the territory of the present Czech Republic and as a rule differ from other citizens by their common ethnic origin, language, culture and traditions; they represent a minority of citizens and at the same time they show their will to be considered a national minority for the purpose of common efforts to preserve and develop their own identity, language and culture and at the same time express and preserve interests of their community which has been formed during history. (2) The member of a national minority is a citizen of the Czech Republic who professes other than Czech ethnic origin and wishes to be considered a member of a national minority in common with the others who profess the same ethnic origin. CHAPTER II RIGHTS OF MEMBERS OF NATIONAL MINORITIES §3 Exercise of rights of members of national minorities (1) Members of national minorities individually or in common with other members of a national minority are guaranteed to be able to exercise their rights determined by this act, special legal regulations or international conventions on human rights and fundamental freedoms by which the Czech Republic is bound. (2) Exercise of rights of national minorities must not be restricted or ruled out. §4 Free choice of membership of a national minority (1) The membership of a national minority must not cause loss to anyone. (2) The public administration bodies do not keep records of members of national minorities. Procuring, processing and using personal data concerning the membership of a national minority 1) comply with provisions of special legal regulations. The data on professing ethnic origin procured by these bodies during the census or according to another special act that enables the determination of the membership of a national minority must not be used for any other purpose than that for which they have been collected and stored and after statistical processing they must be destroyed. §5 Right of association of members of a national minority Members of a national minority can associate in national associations and political parties and 2) movements under conditions and in a way determined by special legal regulations. §6 Right of participation in dealing with matters concerning a national minority (1) Members of a national minority have the right to their active participation in cultural, social and economic life and public affairs, especially those concerning national minorities whose members they are, and this at the level of community, region and state as a whole. 22 (2) Members of a national minority exercise their right according to paragraph 1 especially by 3) means of committees for national minorities established according to special legal regulations and the government´s Council for National Minorities (thereafter „the Council“). (3) The government establishes the Council as its consultative and initiative body for matters concerning national minorities and their members. At the head of it is a member of the government. (4) Members of the Council are representatives of national minorities and public authorities; at least half of them must be representatives of national minorities nominated by associations of members of national minorities. (5) The Council is competent to a) arrange for the preparation of governmental measures concerning the rights of members of national minorities in the Czech Republic; b) express opinions on motions for bills, governmental regulations and measures con-cerning the rights of members of national minorities before their submission to the government; c) prepare for the government overall reports on the situation of national minorities on the territory of the Czech Republic; d) prepare for the government, ministries or other administrative authorities recom-mendations for satisfying the needs of members of national minorities especially in the field of the education system, culture and media, using their mother tongue, and social and cultural life; e) cooperate with local self-government bodies in the practical application of state policy relating to national minorities; f) propose the distribution of finances expended from the Budget for the support of activities of members of national minorities. (6) Details concerning the composition of the Council and the way of nomination of its members and its activities are determined in rules of the Council sanctioned by the government. §7 Right of using name and surname in the language of a national minority Members of national minorities have the right to use their name and surname in the language of 4) their national minority under conditions determined by a special legal regulation. §8 Right of multilingual names and denominations (1) Members of national minorities living tradionally and for a long time on the territory of the Czech Republic have the right to have the name of a community in which they live, the names of its parts, streets and public places as well as the functions of buildings of public authorities and electoral rooms posted in the languge of the national minority as well as in the Czech language. (2) Conditions for exercise of this right according to paragraph 1 and the way of denomination of 5) multilingual names are determined in a special legal regulation. §9 Right of using the language of a national minority in official documentation and discourse and hearing before a court 23 Members of national minorities living traditionally and for a long time on the territory of the Czech Republic have right to use the language of a national minority in official documentation and discourse and hearing before a court. Conditions for exercise of this right are determined in special 6) legal regulations. § 10 Right of using the language of a national minoritiy during elections 7) Under conditions determined by special legal regulations members of national minorities living traditionally and for a long time on the territory of the Czech Republic have the right to publicise the notice of the term and place of elections and other information for voters in the language of national minorities. § 11 Right of education in the language of a national minority (1) Members of national minorities living traditionally and for a long time on the territory of the Czech Republic have the right of upbringing and education in their mother tongue at schools, pre-school 8) and school institutions under conditions determined by special legal regulations. (2) Members of national minorities according to paragraph 1 are allowed under conditions 8) determined by special legal regulations to establish a) private schools using the language of a national minority as the teaching language or teaching the language of a national minority as a school subject; b) private pre-school and school institutions. § 12 Right of the development of culture of members of national minorities (1) Members of national minorities have the right to maintain and develop their language, culture and traditions and the right to respect for them. (2) The state creates preconditions for maintaining and developing culture, traditions and languages of members of national minorities living traditionally and for a long time on the territory of the Czech Republic; it supports especially such programmes which are specialised in theatres, museums, galleries, libraries, documentation and other activites of members of national minorities. For this purpose it provides grants from the Budget; conditions and the way of providing grants are determined in a government decree. § 13 Right of spreading and receiving information in the language of a national minority (1) Members of national minorities have the right to spread and receive information in their language. (2) For the purpose of maintaining and developing culture, traditions and languages the state supports publishing periodical and non-periodical printed matter and radio and television broadcasting in the languages of national minorities living traditionally and for a long time on the territory of the Czech Republic. For this purpose it provides grants from the Budget; conditions and the way of providing grants are determined by a government decree. 24 (3) Creating and disseminating radio and television broadcasting related to members of national 9) minorities and implemented by legitimate operators are determined by special legal re-gulations. (2) Dotace na cinnosti uvedené v odstavci l jsou poskytovány fyzickým nebo právnickým osobám v 13 souladu se zvláštním právním predpisem §2 Vymezení pojm u Pro úcely tohoto narízení se rozumí a) poskytovatelem ústrední orgán státní správy, který vyhlašuje a uskute cn uje výberové 13 Zákon c . 218/2000 Sb., o rozpoctových pravidlech a o zmene nekterých souvisejících zákonu (rozpoctoba pravidla), ve znení pozdejších predpisu . 29 dotacní rízení a rozhoduje o úcelovém poskytování dotací na aktivity príslušníku národnostních menšin nebo na cinnosti ve prospech príslušníku národnostních menšin, b) žadatelem ten, kdo se podáním projektu uchází o poskytnutí dotace, c) príjemcem ten žadatel, v jehož prospech bylo o poskytnutí dotace poskytovatelem rozhodnuto a jenž je realizátorem projektu, d) projektem popis cinnosti se zamerením na aktivity príslušníku národnostních menšin nebo cinnosti ve prospech národnostních menšin, a to v oblasti 1. uchování, rozvoje a prezentace kultur národnostních menšin, 2. rozširování a prijímání informací v jazycích národnostních menšin ci v prevážné míre v jazycích národnostních menšin nebo o národnostních menšinách ve spolecnosti, 3. vzdelávání v jazycích národnostních menšin a multikulturní výchovy, nebo 4. podpory integrace príslušníku romské komunity, e) výberovým dotacním rzením proces zahrnující vyhlášení výb e rového dotacního rízení, dále prijímání žádostí o poskytnutí dotace a prihlášek projektu , hodnocení projektu , 14 navržení výše financní cástky na jejich realizaci a vydání rozhodnutí o poskytnutí dotace . [...] CÁSTD RUHÁ ZVLÁŠTNÍ CÁST Podpora uchování, rozvoje a prezentace kultur národnostních menšin § 14 (1) Cílem podpory je uchování a rozvoj kultur príslušník u národnostních menšin žijících v Ceské republice, studium, rozbory a dokumentace národnostních kultur a lidových tradic menšin, porozumení a tolerance ve spolecnosti, poznání historie, tradic a kultur r u zných etnik, zlepšení komunikace mezi vetšinovou spolecností a menšinami. Poskytovatelem dotací na tyto aktivity je Ministerstvo kultury. (2) Financní prostredky na podporu aktivit uvedených v odstavci 1 navrhne Ministerstvo kultury jako specifický závazný ukazatel Podpora kulturních aktivit národnostních menšin ve své kapitole státního rozpoctu na každý rozpoctový rok. § 15 Dotace mohou být poskytnuty na projekty pro a) divadla, b) muzea, c) galerie, 14 §14 odst. 3 zákona c . 218/2000 Sb., 30 d) knihovny, e) dokumentacní cinnost, f) vydávání neperiodických publikací, g) vydávání periodických publikací, pokud nejde o dotace podle § 17 h) další aktivity príslušníku národnostních menšin, zejména um e lecké, kulturne vzdelávací akce, studium, rozbory a dokumentace národnostních kultur a lidových tradic národnostních menšin, publikacní cinnost, multietnické akce. Podpora rozširování a prijímání informací v jazycích národnostních menšin § 16 (1) Cílem podpory ze státního rozpo c tu je vytvá r et podmínky pro rozširování a prijímání informací v jazycích národnostních menšin c i v prevážné míre v jazycích národnostních menšin, jakož i informací o národnostních menšinách ve spole c nosti. Poskytovatelem dotací pro tento ú c el je Ministerstvo kultury. (2) Financní prostredky na podporu aktivit uvedených v odstavci 1 navrhne Ministerstvo kultury jako specifický závazný ukazatel Podpora rozširování a prijímání informací v jazycích národnostních menšin ve své kapitole státního rozpoctu na každý rozpoctový rok. § 17 Podpora projektu se zam er ením na rozširování a prijímání informací se týká a) periodického tisku vydávaného v jazycích národnostních menšin ci v prevážné míre v jazycích národnostních menšin nebo informací o národnostních menšinách ve spolecnosti, b) provozování rozhlasového nebo televizního vysílání v jazycích národnostních menšin ci v prevážné míre v jazycích národnostních menšin nebo informací o národnostních menšinách ve spolecnosti. […] Podpora vzd e lávání v jazycích národnostních menšin a multikulturní výchovy § 19 (1) Cílem podpory je vytvá r et podmínky pro napl n ování státní politiky v oblasti vzdelávání v jazycích národnostních menšin a multikulturní výchovy. Podpora projektu multikulturní výchovy detí a mládeže smeruje k posilování v e domí obecné lidské sounáležitosti, k výchove k demokratickému obcanství, poznávání historie a kultury jiných národu , ke vzájemné toleranci a proti rasismu a xenofobii. Poskytovatelem dotací ze státního rozpoctu na tyto aktivity je Ministerstvo školství, mládeže a telovýchovy. (2) Financní prostredky na podporu aktivit uvedených v odstavci 1 navrhne Ministerstvo školství, mládeže a t e lovýchovy jako specifický závazný ukazatel Podpora vzdelávání v jazycích národnostních menšin a multikulturní výchova ve své kapitole státního rozpoctu na každý rozpoctový rok. 31 § 20 Podpora projektu se zamerením na vzdelávání v jazycích národnostních menšin, mimoškolních a volnocasových aktivit detí a mládeže príslušníku národnostních menšin a projektu multikulturní výchovy se týká a) jazykového vzdelávání detí a mládeže príslušníku národnostních menšin, b) spolecensko-kulturních, sportovních a dalších vzdelávacích aktivit pro d e ti a mládež príslušníku národnostních menšin a vetšinové spole c nosti ve vztahu k menšinovým spolecnostem, c) dokumentace, rozboru , výzkumu a tvorby vzdelávacích programu v oblasti národnostne menšinového vzdelávání. Podpora projektu integrace príslušníku romské komunity § 21 (1) Cílem podpory je vyrovnávání podmínek príslušníku romské komunity, zvlášte v oblasti vzdelávání a sociální s durazem na zamezení spolecenského vylucování príslušníku romské komunity, postavení romských žen a zajištení spoluúcasti Romu pri zavádení integracních programu , vytvárení duvery, porozumení a tolerance ve spolecnosti, Poznan historie a tradic romské kultury, zlepšení komunikace mezi romskou komunitou a vetšinovou spolecností. Poskytovatelem dotací na projekty integrace príslušníku romské komunity jsou. Ministerstvo školství, mládeže a telovýchovy, Ministerstvo kultury a Ministerstvo práce a sociálních vecí. (2) Financní prostredky na podporu aktivit uvedených v odstavci 1 navrhnou príslušná ministerstva jako specifický závazný ukazatel Podpora projektu integrace príslušníku romské komunity ve svých kapitolách státního rozpoctu na každý rozpoctový rok. § 22 Dotace v oblasti podpory projektu integrace príslušníku romské komunity jsou poskytovány právnickým osobám. § 23 Zamerení podpory projektu v oblasti integrace príslušníku romské komunity se Thika a) podpory integrace príslušníku romské komunity, zejména v oblasti spolecenských a kulturních aktivit a vzdelávání, b) podpory vzd e lávání romských žáku a studentu , c) podpory rozvoje poskytování zvláštních sociálních služeb. PART 1 GENERAL PART §1 The subject of legislation (1) This Decree amends the conditions and way of providing grants from the State Budget for the activities of members of national minorities, preservation and development of culture, traditions and languages of members of national minorities, dissemination and acceptance of information in languages of members of national minorities that have been living on the territory of the Czech Republic as well as their education and the support of integration of members of the Roma community (hereinafter „grants“). (2) Grants for activities mentioned in Clause 1 are provided to natural or legal persons in accordance with a special legislation regulation.1) §2 The definition of concepts For the purposes of this Decree a) a provider is a state administration authority that announces and implements a competitive grant procedure and decides grants provided to members of national minorities for a certain purpose or activity for the benefit of members of national minorities, b) an applicant is a person who applies for a grant by the submission of a project; c) an acceptor is an applicant for whose benefit a provider decides to provide a grant and who implements a project; d) a project is the description of activity aimed at the activities of members of national minorities or activities for the benefit of members of national minorities in the field of 35 1. the preservation, development and presentation of cultures of national minorities,.2 2. the dissemination and acceptance of information in languages of national minorities or largely in languages of national minorities or information on national minorities in society, 3. education in languages of national minorities and multicultural upbringing, or 4. the support of integration of members of the Roma population, e) competitive granting procedures including the announcement of a competitive granting procedure, acceptance of applications for grants and offers of projects, evaluation of projects, proposals of amounts for their implementation and issuance of decisions on grants.2) […] PART 2 SPECIAL PART The support of preservation, development and presentation of cultures of national minorities § 14 (1) The aim of the support is to preserve and develop the cultures of members of national minorities living in the Czech Republic as well as to study, analyse and demonstrate national cultures and folk traditions of minorities by documentation, understanding and tolerance in society, knowledge of history, traditions and culture of various ethnic groups and improvement of communication between the majority and minorities. A provider of grants for these activities is the Ministry of Culture. (2) The Ministry of Culture proposes financial means for the support of activities mentioned in Clause 1 as a specific binding index ‘The Support of Cultural Activities of National Minorities’ within its chapter of the State Budget for every budget year. § 15 It is possible to provide grants for projects concerning a) theatres, b) museums, c) galleries, d) libraries, e) documentation, f) issuance of non-periodical publications, g) issuance of periodical publications out of the grants according to § 17. h) other activities of members of national minorities, especially artistic, cultural and edu-cational ones, study, analyses and documentation of national cultures and folk traditions of national minorities, publications and multi-ethnic activities. The support of dissemination and acceptance of information in languages of national minorities. § 16 36 (1) The support from the State Budget is aimed at creating conditions for the dissemination and acceptance of information in languages of national minorities or largely in languages of national minorities and information on national minorities in the society. The provider of grants for this purpose is the Ministry of Culture. (2) The Ministry of Culture proposes financial means for the support of activities mentioned in Clause 1 as a specific binding index ‘The Support of Dissemination and Acceptance of Information in Languages of National Minorities’ in its chapter of the State Budget for every budget year. § 17 The support of projects aimed at the dissemination and acceptance of information relates to a) periodical publications issued in languages of national minorities or largely in languages of national minorities or information on national minorities in society, b) radio or television broadcasting in languages of national minorities or largely in languages of national minorities or information on national minorities in society. […] The support of education in languages of national minorities and multicultural upbringing § 19 (1) The aim of the support is to create conditions for the realisation of state policy in the field of education in languages of national minorities and multicultural upbringing. The support of projects focused on the multicultural upbringing of children and young people is aimed at strengthening the awareness of human solidarity, upbringing to democratic citizenship, knowledge of history and culture of other nations, mutual tolerance and the fight against racism and xenophobia. The provider of grants for these activities from the State Budget is the Ministry of Education, Youth and Sports. (2) The Ministry of Education, Youth and Sports proposes financial means for the support of activities mentioned in Clause 1 as a special binding index ‘The Support of Education in Languages of National Minorities and Multicultural Upbringing’ in its chapter of the State Budget for every budget year. § 20 The support of projects aimed at education in languages of national minorities, out-of-school and leisure activities of children and young people from members of national minorities and projects aimed at multicultural upbringing relates to a) language courses for children and young people from members of national minorities, b) sociocultural, sportive and other educational activities of children and young people from members of national minorities, c) documentation, analyses, research and elaboration of educational programmes in the field of education of national minorities. The support of projects aimed at the integration of members of the Roma community § 21 37 (1) The aim of the support is to create equal conditions for members of the Roma community, especially in the field of education and welfare laying stress on prevention of the social discrimination of members of the Roma community, situation of Roma women, assurance of the participation of members of the Roma community in the application of integration programmes, atmosphere of trust, understanding and tolerance in society, knowledge of history and traditions of the Roma population, improvement of communication between the Roma community and the majority. Providers of grants for projects aimed at the integration of members of the Roma population are the Ministry of Education, Youth and Sports, Ministry of Culture and Ministry of Labour and Social Affairs. (2) Respective ministries propose financial means for the support of activities mentioned in Clause 1 as a specific binding index ‘The Support of Projects for the Integration of Members of the Roma Community’ in their chapters of the State Budget for every budget year. § 22.9 Grants for the support of projects aimed at the integration of members of the Roma community are provided to legal persons. § 23 The support of projects in the field of the integration of members of the Roma community relates to the support of a) integration of members of the Roma community, especially in the field of social and cultural activities and education, b) education of Roma pupils and students, c) development of providing special social services. PART 1- PART GENERAL Article 1- El subjecte de legislació (1) Aquest decret modifica les condicions i el procediment per a la concessió d’ajuts del pressupost de l’estat per a les activitats dels membres de les minories nacionals, la preservació i desenvolupament de la cultura, les tradicions i les llengües dels membres de les minories nacionals, la difusió i l‘acceptació de la informació en les llengües dels membres de les minories nacionals que hagin viscut dins el territori de la República Txeca, així com per a la seva educació i el suport cap a la integració dels membres de la comunitat roma (d’ara en davant, “ajuts”). (2) Els ajuts per a les activitats esmentades en el paràgraf 1 es concediran a persones naturals o 1 jurídiques d’acord amb les regulacions de la legislació especial. Article 2 En relació als objectius d’aquest decret, a) el proveïdor és una autoritat de l’administració de l’estat que anuncia i duu a terme els procediments d’una convocatòria d’ajuts, i decideix quines són els ajuts atorgats a membres de les minories nacionals per a un objectiu o activitat concrets, en benefici de membres de les minories nacionals, b) un sol·licitant és la persona que sol·licita un ajut mitjançant la presentació d’un projecte; c) l’acceptant és el sol·licitant a benefici del qual el proveïdor decideix atorgar un ajut, i qui realitza el projecte; d) un projecte és la descripció de l’activitat adreçada a les activitats de membres de minories nacionals, o activitats a benefici de membres de minories nacionals, en els camps de 1. la preservació, desenvolupament i introducció a les cultures de les minories nacionals, 2. la difusió i acceptació d’informació en llengües de minories nacionals, o majoritàriament en llengües de minories nacionals, o informació al voltant de les minories nacionals en la societat, 1 Llei 218/2000 sobre normativa pressupostària i esmenes d’algunes lleis (normativa pressupostària), modificada per successives regulacions. 41 3. l’ensenyament en llengües de minories nacionals i educació en la multiculturalitat, o 4. el suport a la integració de membres de la comunitat roma, e) els procediments d’una convocatòria d’ajuts inclouen l’anunci dels procediments del concurs, l’acceptació de les sol·licituds d’ajuts i ofertes de projectes, l’avaluació dels projectes, la proposta 2 dels imports per a la seva realització i la publicació de les decisions respecte als ajuts. [...] PART 2 – PART ESPECIAL El suport a la preservació, desenvolupament i introducció a les cultures de minories nacionals Article 14 (1) L’objectiu d’aquest suport és preservar i desenvolupar les cultures dels membres de les minories nacionals que visquin a la República Txeca, així com estudiar, analitzar i exposar les cultures i tradicions populars de les minores per mitjà de la documentació, la comprensió i la tolerància en la societat, el coneixement de la història, les tradicions i cultura dels diversos grups ètnics i la millora de la comunicació entre la majoria i les minories. El proveïdor d’ajuts per a aquestes activitats és el Ministeri de Cultura. (2) El Ministeri de Cultura proposarà els mitjans financers per al suport de les activitats esmentades en el pàràgraf 1, en un índex específic de compliment obligatori, “El Suport a les Activitats Culturals de les Minories Nacionals” dins el capítol del Pressupost de l’estat per a cada any pressupostari. Article 15 És possible atorgar ajuts per projectes relacionats amb: a) teatres b) museus c) galeries d) biblioteques e) documentació f) producció de publicacions no periòdiques g) producció de publicacions periòdiques a partir dels ajuts especificats en l’article 17 h) altres activitats de membres de minories nacionals, en especial les artístiques, culturals i educatives, l’estudi, anàlisi i documentació al voltant de les cultures nacionals i les tradicions populars de les minories nacionals, les publicacions i activitats multiètniques. El suport a la difusió i acceptació d’informació en llengües de minories nacionals Article 16 (1) El suport des del pressupost de l’estat s’adreça a crear les condicions per a la difusió i l’acceptació d’informació en llengües de minories nacionals, o sobretot en llengües de minories nacionals i informació sobre les minories nacionals en la societat. El proveïdor dels ajuts per a aquest objectiu és el Ministeri de Cultura. 2 Article 14/3 de la Llei 218/2000. 42 Article 17 El suport als projectes adreçats a la difusió i acceptació d’informació guardarà relació amb: a) les publicacions periòdiques editades en llengües de minories nacionals, o sobretot en llengües de minories nacionals, o amb informació al voltant de les minories nacionals en la societat, b) les emissions de ràdio i televisió en llengües de minories nacionals, o sobretot en llengües de minories nacionals, o informació al voltant de les minories nacionals en la societat. [...] El suport a l’ensenyament en llengües de minories nacionals i educació multicultural Article 19 (1) L’objectiu del suport és crear les condicions per a la realització de la política estatal en el camp de l’ensenyament en llengües de minories nacionals i l’educació multicultural. El suport als projectes adreçats a l’educació multicultural de nens i joves té per objectiu el reforçament de la conscienciació de la solidaritat humana, l’educació per a la ciutadania democràtica, el coneixement de la història i la cultura d’altres nacions, la tolerància mútua i la lluita contra el racisme i la xenofòbia. El proveïdor d’ajuts per a aquestes activitats, a través dels pressupostos de l’estat, és el Ministeri d’Educació, Joventut i Esports. (2) El Ministeri d’Educació, Joventut i Esports proposarà els mitjans financers per al suport de les activitats esmentades en el pàràgraf 1, en un índex específic de compliment obligatori, “El Suport a l’Ensenyament en llengües de Minories Nacionals i a l’Educació Multicultural”, dins el capítol del Pressupost de l’estat per a cada any pressupostari. Article 20 El suport als projectes adreçats a l’ensenyament en llengües de minories nacionals, activitats extraescolars i de lleure d’infants i gent jove pertanyents a minories nacionals, i als projectes dirigits a l’educació multicultural, guardaran relació amb: a) cursos de llengua per a infants i gent jove pertanyents a minories nacionals, b) activitats socioculturals, esportives i educatives per a infants i gent jove pertanyents a minories nacionals, c) documentació, anàlisis, recerca i elaboració de programes educatius en el camp de l’educació de les minories nacionals. El suport a projectes adreçats a la integració de membres de la comunitat roma Article 21 (1) L’objectiu del suport és crear una igualtat de condicions per als membres de la comunitat roma, de manera especial en l’àmbit de l’educació i el benestar, tot posant èmfasi en la prevenció de la discriminació social de membres de la comunitat roma, la situació de les dones roma, el garantiment de la participació de membres de la comunitat roma en l’aplicació dels programes 43 d’integració, en una atmosfera de confiança, enteniment i tolerància en la societat, el coneixement de la història i les tradicions de la població roma, la millora de la comunicació entre la comunitat roma i la majoritària. Els proveïdos dels ajuts per a projectes destinats a la integració dels membres de la població roma són el Ministeri d’Educació, Joventut i Esports, el Ministeri de Cultura i el Ministeri del Treball i Afers Socials. (2) Els respectius ministeris proposaran els mitjans financers per al suport de les activitats esmentades en el paràgraf 1, en un índex específic de compliment obligatori, “El Suport a projectes per a la integració dels membres de la comunitat roma”, dins el capítol del Pressupost de l’estat per a cada any pressupostari. Article 22 Els ajuts per al suport de projectes dirigits a la integració de membres de la comunitat roma es concediran a persones jurídiques. Article 23 El suport als projectes en l’àmbit de la integració de membres de la comunitat roma tindran relació amb el suport de: a) la integració dels membres de la comunitat roma, especialment en l’àmbit de les activitats socials i culturals i l’educació, b) l’educació d’alumnes i estudiants roma, c) el desenvolupament de la concessió de serveis socials especials. Article 24 Vigència del decret Aquest decret entra en vigor el 15 d’abril de 2002. Primer Ministre: Zeman Viceprimer Ministre Rychetský 44 st 31 UNESCO General Conference Paris, November 2001 Universal Declaration on Cultural Diversity The General Conference, Committed to the full implementation of the human rights and fundamental freedoms proclaimed in the Universal Declaration of Human Rights and other universally recognized legal instruments, such as the two International Covenants of 1966 relating respectively to civil and political rights and to economic, social and cultural rights, Recalling that the Preamble to the Constitution of UNESCO affirms “that the wide diffusion of culture, and the education of humanity for justice and liberty and peace are indispensable to the dignity of man and constitute a sacred duty which all the nations must fulfil in a spirit of mutual assistance and concern”, Further recalling Article I of the Constitution, which assigns to UNESCO among other purposes that of recommending “such international agreements as may be necessary to promote the free flow of ideas by word and image”, Referring to the provisions relating to cultural diversity and the exercise of cultural rights in the 15 international instruments enacted by UNESCO, Reaffirming that culture should be regarded as the set of distinctive spiritual, material, intellectual and emotional features of society or a social group, and that it encompasses, in addition to art and 16 literature, lifestyles, ways of living together, value systems, traditions and beliefs, Noting that culture is at the heart of contemporary debates about identity, social cohesion, and the development of a knowledge-based economy, Affirming that respect for the diversity of cultures, tolerance, dialogue and cooperation, in a climate of mutual trust and understanding are among the best guarantees of international peace and security, Aspiring to greater solidarity on the basis of recognition of cultural diversity, of awareness of the unity of humankind, and of the development of intercultural exchanges, 15 Among which, in particular, the Florence Agreement of 1950 and its Nairobi Protocol of 1976, the Universal Copyright Convention of 1952, the Declaration of Principles on International Cultural Cooperation of 1966, the Convention on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Ownership of Cultural Property (1970), the Convention for the Protection of World Cultural and Natural Heritage of 1972, the UNESCO Declaration on Race and Racial Prejudice of 1978, the Recommendation concerning the Status of the Artist of 1980, and the Recommendation on Safeguarding Traditional and Popular Culture of 1989. 16 This definition is in line with the conclusions of the World Conference on Cultural Policies (MONDIACULT, Mexico City, 1982), of the World Commission on Culture and Development (Our Creative Diversity, 1995), and of the Intergovernmental Conference on Cultural Policies for Development (Stockholm, 1998). 45 Considering that the process of globalization, facilitated by the rapid development of new information and communication technologies, though representing a challenge for cultural diversity, creates the conditions for renewed dialogue among cultures and civilizations, Aware of the specific mandate which has been entrusted to UNESCO, within the United Nations system, to ensure the preservation and promotion of the fruitful diversity of cultures, Proclaims the following principles and adopts the present Declaration: IDENTITY, DIVERSITY AND PLURALISM Article 1 – Cultural diversity: the common heritage of humanity Culture takes diverse forms across time and space. This diversity is embodied in the uniqueness and plurality of the identities of the groups and societies making up humankind. As a source of exchange, innovation and creativity, cultural diversity is as necessary for humankind as biodiversity is for nature. In this sense, it is the common heritage of humanity and should be recognized and affirmed for the benefit of present and future generations. Article 2 – From cultural diversity to cultural pluralism In our increasingly diverse societies, it is essential to ensure harmonious interaction among people and groups with plural, varied and dynamic cultural identities as well as their willingness to live together. Policies for the inclusion and participation of all citizens are guarantees of social cohesion, the vitality of civil society and peace. Thus defined, cultural pluralism gives policy expression to the reality of cultural diversity. Indissociable from a democratic framework, cultural pluralism is conducive to cultural exchange and to the flourishing of creative capacities that sustain public life. Article 3 – Cultural diversity as a factor in development Cultural diversity widens the range of options open to everyone; it is one of the roots of development, understood not simply in terms of economic growth, but also as a means to achieve a more satisfactory intellectual, emotional, moral and spiritual existence. CULTURAL DIVERSITY AND HUMAN RIGHTS Article 4 – Human rights as guarantees of cultural diversity The defence of cultural diversity is an ethical imperative, inseparable from respect for human dignity. It implies a commitment to human rights and fundamental freedoms, in particular the rights of persons belonging to minorities and those of indigenous peoples. No one may invoke cultural diversity to infringe upon human rights guaranteed by international law, nor to limit their scope. Article 5 – Cultural rights as an enabling environment for cultural diversity Cultural rights are an integral part of human rights, which are universal, indivisible and interdependent. The flourishing of creative diversity requires the full implementation of cultural rights as defined in Article 27 of the Universal Declaration of Human Rights and in Articles 13 and 15 of the International Covenant on Economic, Social and cultural Rights. All persons should therefore be able to express themselves and to create and disseminate their work in the language of their choice, and particularly in their mother tongue; all persons should be entitled to quality education and training that fully respect their cultural identity; and all persons should be able to participate in the cultural life of their choice and conduct their own cultural practices, subject to respect for human rights and fundamental freedoms. Article 6 – Towards access for all to cultural diversity While ensuring the free flow of ideas by word and image care should be exercised that all cultures can express themselves and make themselves known. Freedom of expression, media pluralism, multilingualism, equal access to art and to scientific and technological knowledge, including in 46 digital form, and the possibility for all cultures to have access to the means of expression and dissemination are the guarantees of cultural diversity. CULTURAL DIVERSITY AND CREATIVITY Article 7 – Cultural heritage as the wellspring of creativity Creation draws on the roots of cultural tradition, but flourishes in contact with other cultures. For this reason, heritage in all its forms must be preserved, enhanced and handed on to future generations as a record of human experience and aspirations, so as to foster creativity in all its diversity and to inspire genuine dialogue among cultures. Article 8 – Cultural goods and services: commodities of a unique kind In the face of present-day economic and technological change, opening up vast prospects for creation and innovation, particular attention must be paid to the diversity of the supply of creative work, to due recognition of the rights of authors and artists and to the specificity of cultural goods and services which, as vectors of identity, values and meaning, must not be treated as mere commodities or consumer goods. Article 9 – Cultural policies as catalysts of creativity While ensuring the free circulation of ideas and works, cultural policies must create conditions conducive to the production and dissemination of diversified cultural goods and services through cultural industries that have the means to assert themselves at the local and global level. It is for each State, with due regard to its international obligations, to define its cultural policy and to implement it through the means it considers fit, whether by operational support or appropriate regulations. CULTURAL DIVERSITY AND INTERNATIONAL SOLIDARITY Article 10 – Strengthening capacities for creation and dissemination worldwide In the face of current imbalances in flows and exchanges of cultural goods and services at the global level, it is necessary to reinforce international cooperation and solidarity aimed at enabling all countries, especially developing countries and countries in transition, to establish cultural industries that are viable and competitive at national and international level. Article 11 – Building partnerships between the public sector, the private sector and civil society Market forces alone cannot guarantee the preservation and promotion of cultural diversity, which is the key to sustainable human development. From this perspective, the pre-eminence of public policy, in partnership with the private sector and civil society, must be reaffirmed. Article 12 – The role of UNESCO UNESCO, by virtue of its mandate and functions, has the responsibility to: (a) Promote the incorporation of the principles set out in the present Declaration into the development strategies drawn up within the various intergovernmental bodies; (b) Serve as a reference point and a forum where States, international governmental and nongovernmental organizations, civil society and the private sector may join together in elaborating concepts, objectives and policies in favour of cultural diversity; (c) Pursue its activities in standard-setting, awareness-raising and capacity-building in the areas related to the present Declaration within its fields of competence; 47 (d) Facilitate the implementation of the Action Plan, the main lines of which are appended to the present Declaration. MAIN LINES OF AN ACTION PLAN FOR THE IMPLEMENTATION OF THE UNESCO UNIVERSAL DECLARATION ON CULTURAL DIVERSITY The Member States commit themselves to taking appropriate steps to disseminate widely the “UNESCO Universal Declaration on Cultural Diversity”, in particular by cooperating with a view to achieving the following objectives: 1. Deepening the international debate on questions relating to cultural diversity, particularly in respect of its links with development and its impact on policy-making, at both national and international level; taking forward notably consideration of the opportunity of an international legal instrument on cultural diversity. 2. Advancing in the definition of principles, standards and practices, on both the national and the international levels, as well as of awareness-raising modalities and patterns of cooperation, that are most conducive to the safeguarding and promotion of cultural diversity. 3. Fostering the exchange of knowledge and best practices in regard to cultural pluralism with a view to facilitating, in diversified societies, the inclusion and participation of persons and groups from varied cultural backgrounds. 4. Making further headway in understanding and clarifying the content of cultural rights as an integral part of human rights. 5. Safeguarding the linguistic heritage of humanity and giving support to expression, creation and dissemination in the greatest possible number of languages. 6. Encouraging linguistic diversity – while respecting the mother tongue – at all levels of education, wherever possible, and fostering the learning of several languages from the youngest age. 7. Promoting through education an awareness of the positive value of cultural diversity and improving to this end both curriculum design and teacher education. 8. Incorporating, where appropriate, traditional pedagogies into the education process with a view to preserving and making full use of culturally appropriate methods of communication and transmission of knowledge. 9. Encouraging “digital literacy” and ensuring greater mastery of the new information and communication technologies, which should be seen both as educational discipline and as pedagogical tools capable of enhancing the effectiveness of educational services. 10. Promoting linguistic diversity in cyberspace and encouraging universal access through the global network to all information in the public domain. 11. Countering the digital divide, in close cooperation in relevant United Nations system organizations, by fostering access by the developing countries to the new technologies, by helping them to master information technologies and by facilitating the digital dissemination of endogenous cultural products and access by those countries to the educational, cultural and scientific digital resources available worldwide. 48 12. Encouraging the production, safeguarding and dissemination of diversified contents in the media and global information networks and, to that end, promoting the role of public radio and television services in the development of audiovisual productions of good quality, in particular by fostering the establishment of cooperative mechanisms to facilitate their distribution. 13. Formulating policies and strategies for the preservation and enhancement of the cultural and natural heritage, notably the oral and intangible cultural heritage, and combating illicit traffic in cultural goods and services. 14. Respecting and protecting traditional knowledge, in particular that of indigenous peoples; recognizing the contribution of traditional knowledge, particularly with regard to environmental protection and the management of natural resources, and fostering synergies between modern science and local knowledge. 15. Fostering the mobility of creators, artists, researchers, scientists and intellectuals and the development of international research programmes and partnerships, while striving to preserve and enhance the creative capacity of developing countries and countries in transition. 16. Ensuring protection of copyright and related rights in the interest of the development of contemporary creativity and fair remuneration for creative work, while at the same time upholding a public right of access to culture, in accordance with Article 27 of the Universal Declaration of Human Rights. 17. Assisting in the emergence or consolidation of cultural industries in the developing countries and countries in transition and, to this end, cooperating in the development of the necessary infrastructures and skills, fostering the emergence of viable local markets, and facilitating access for the cultural products of those countries to the global market and international distribution networks. 18. Developing cultural policies, including operational support arrangements and/or appropriate regulatory frameworks, designed to promote the principles enshrined in this Declaration, in accordance with the international obligations incumbent upon each State. 19. Involving civil society closely in framing of public policies aimed at safeguarding and promoting cultural diversity. 20. Recognizing and encouraging the contribution that the private sector can make to enhancing cultural diversity and facilitating to that end the establishment of forums for dialogue between the public sector and the private sector. The Member States recommend that the Director-General take the objectives set forth in this Action Plan into account in the implementation of UNESCO’s programmes and communicate the latter to institutions of the United Nations system and to other intergovernmental and non-governmental organizations concerned with a view to enhancing the synergy of actions in favour of cultural diversity. _____________ 1 . La diversitat cultural, patrimoni comú de la humanitat La cultura pren formes diverses al llarg del temps i de l’espai. Aquesta diversitat s’encarna en l’originalitat i la pluralitat de les identitats que caracteritzen els grups i les societats que componen la humanitat. Font d’intercanvis, d’innovació i de creativitat, la diversitat cultural és tan necessària per al gènere humà com la biodiversitat per als éssers vius. En aquest sentit, constitueix el patrimoni comú de la humanitat i ha de ser reconeguda i afermada en benefici de les generacions actuals i de les generacions futures. Article 2. De la diversitat cultural al pluralisme cultural Dins de les nostres societats, cada cop més diversificades, és indispensable assegurar una interacció harmònica i una voluntat de viure juntes de persones i de grups d’identitats culturals plurals, variades i dinàmiques. Unes polítiques que afavoreixin la inclusió i la participació de tots els ciutadans són garantia de cohesió social, de vitalitat de la societat civil i de pau. Definit així, el pluralisme cultural constitueix la resposta política al fet de la diversitat cultural. El pluralisme cultural, indissociable d’un marc democràtic, afavoreix els intercanvis culturals i l’expansió de les capacitats creatives que nodreixen la vida pública. Article 3. La diversitat cultural, factor de desenvolupament La diversitat cultural amplia les possibilitats d’elecció que s’ofereixen a cadascun de nosaltres; és un dels motors del desenvolupament, entès no solament com a factor de creixement econòmic sinó també com a mitjà perquè els individus i els grups accedeixin a una existència intel·lectual, afectiva, moral i espiritual més satisfactòria. DIVERSITAT CULTURAL I DRETS HUMANS Article 4. Els drets humans, garants de la diversitat cultural La defensa de la diversitat cultural és un imperatiu ètic, inseparable del respecte de la dignitat de la persona humana. Aquesta defensa implica el compromís de respectar els drets humans i les llibertats fonamentals, especialment els drets de les persones que pertanyen a minories i els dels pobles autòctons. Cap persona no pot invocar la diversitat cultural per atemptar contra els drets humans garantits pel dret internacional, ni per limitar-ne l’abast. 52 Article 5. Els drets culturals, marc propici de la diversitat cultural Els drets culturals formen part dels drets humans, que són universals, indissociables i interdependents. L’expansió d’una diversitat creativa exigeix la plena realització dels drets culturals tal com estan definits a l’article 27 de la Declaració Universal dels Drets Humans i en els articles 13 i 15 del Pacte Internacional Relatiu als Drets Econòmics, Socials i Culturals. Així tota persona ha de poder expressar-se, crear i difondre les seves obres en la llengua que triï i especialment en la seva llengua materna; tota persona ha de tenir una educació i una formació de qualitat que respectin plenament la seva identitat cultural; tota persona ha de poder participar en la vida cultural que esculli i exercir les seves pròpies pràctiques culturals, dins dels límits que imposa el respecte envers els drets humans i les llibertats fonamentals. Article 6. Cap a una diversitat cultural accessible a tothom S’ha d’assegurar la lliure circulació de les idees a través de la paraula i de la imatge, tot vetllant perquè totes les cultures puguin expressar-se i donar-se a conèixer. La llibertat d’expressió, el pluralisme dels mitjans de comunicació, el multilingüisme, la igualtat d’accés a les expressions artístiques, al saber científic i tecnològic —fins i tot en forma digital— i la possibilitat que totes les cultures estiguin presents als mitjans d’expressió i de difusió, són els garants de la diversitat cultural. DIVERSITAT CULTURAL I CREATIVITAT Article 7. El patrimoni cultural, font de creativitat Tota creació s’alimenta de les arrels de les tradicions culturals però sols s’expandeix en contacte amb les altres. Per això el patrimoni, en totes les formes, ha de ser preservat, valorat i transmès a les generacions futures com a testimoni de l’experiència i de les aspiracions humanes, amb la finalitat de nodrir la creativitat en tota la seva diversitat i d’instaurar un veritable diàleg entre les cultures. Article 8. Els béns i serveis culturals, unes mercaderies diferents de les altres Davant de les transformacions econòmiques i tecnològiques actuals, que obren àmplies perspectives per a la creació i la innovació, cal dispensar una atenció particular a la diversitat de l’oferta creativa, especialment als drets dels autors i dels artistes, i també a l’especificitat dels béns i serveis culturals que, per ser portadors d’identitat, de valors i de sentit, no han de ser considerats mercaderies o béns de consum com els altres. Article 9. Les polítiques culturals, catalitzadores de la creativitat Tot assegurant la lliure circulació de les idees i de les obres, les polítiques culturals han de crear les condicions propícies a la producció i a la difusió de béns i serveis culturals diversificats, gràcies a unes indústries culturals que disposin de mitjans per afirmar-se a escala local i mundial. Pertoca a cada estat, dins del respecte de les seves obligacions internacionals, definir la seva política cultural i aplicar-la a través dels mitjans d’actuació que consideri més adequats, tant si es tracta de suport operatiu com de marcs reglamentaris apropiats. DIVERSITAT CULTURAL I SOLIDARITAT INTERNACIONAL Article 10. Reforçar la capacitat de creació i de difusió a escala mundial 53 Davant dels desequilibris que presenten actualment els fluxos i els intercanvis de béns culturals a escala mundial, cal reforçar la cooperació i la solidaritat internacionals destinades a permetre que tots els països, en particular els països en via de desenvolupament i els països en transició, posin en funcionament unes indústries culturals viables i competitives a escala nacional i internacional. Article 11. Impulsar la col·laboració entre el sector públic, el sector privat i la societat civil Les forces del mercat no poden assegurar totes soles la preservació i la promoció de la diversitat cultural, garantia d’un desenvolupament humà sostenible. Amb aquesta perspectiva cal reafirmar la funció primordial de les polítiques públiques, en col·laboració amb el sector privat i la societat civil. Article 12.
