600 KG MYTHS AND REALITY Presentation by (in alphabetical order) DULV - Deutscher Ultraleichtflugverband e.V. (German Ultralight Federation) LAA ČR - Letecká Amatérská Asociace ČR (Czech Light Aircraft Association) LAMA-EUROPE – Light Aircraft Manufacturers Association-EU (EU-Herstellervereinigung für Leichtflugzeuge) AERO Friedrichshafen 2016 - "600kg myths and reality" Jan Fridrich / Jo Konrad EASA BASIC-REGULATION 216/2008 Zuständigkeit der EASA für alle Zulassungen für Luftfahrtprodukte EASA –Scope: Type-Certification of all Aviation Products Ausnahme: Anhang II Exception: Annex II z. B.: Historische Luftfahrzeuge Experimental Militärischer Herkunft Und ULs mit der Limitierung auf 450 kg. Diese Anhang-II-Flieger bleiben in nationaler Zuständigkeit e.g.: historical aircrafts experimental military origin and Ultralights with the limitation of 450 kg. This Annex II aircrafts remain in national responsibility AERO Friedrichshafen 2016 - "600kg myths and reality" Jan Fridrich / Jo Konrad 450 KG Übernahme vor ca. 25 Jahren Transfer about 25 years ago Aus der sportlichen Definition der FAI für UL-Wettbewerbsflieger From the athletic definition of the FAI for Ultralight competition aircrafts Übertrag in die JAR 1 Definitionen Transfer to the JAR 1 definitions Übernahme der Definition in die EASA Basic-Verordnung Anhang 2003 und dann in 2008 Adoption of the definition in the EASA Basic Regulation Annex II in 2003 and in 2008 AERO Friedrichshafen 2016 - "600kg myths and reality" Jan Fridrich / Jo Konrad 560 KG GYROS Obwohl immer wieder behauptet wurde und wird, dass die Grenze von 450 kg unverrückbar ist, kam in 2008 völlig überraschend die Änderung für Gyros auf 560 kg. Niemand weiß genau, wer daran gedreht hatte. Although it is often claimed that the limit of 450 kg is fixed, there was a completely surprising change to 560 kg for Gyros in 2008 No one knows exactly who had a shot at this. But the approach for 600 kg for all Ultralights back then was blocked in Europe. PS: EAS schlägt als Leermasse 405 kg vor. PS: EAS is proposing for an empty mass of 405 kg. AERO Friedrichshafen 2016 - "600kg myths and reality" Jan Fridrich / Jo Konrad WHY EMPTY MASS 350 KG. 350 + 180 + 70 = 600 We are not fighting for heavier aircrafts We are fighting for more payload! 350 + 180 + 70 = 600 AERO Friedrichshafen 2016 - "600kg myths and reality" Jan Fridrich / Jo Konrad ABOUT MYTH No 1: IT WILL HAPPEN SOON! According to information given by some participants of a council meeting, the new BR can't be expected to commence before 2017 or 2018. AERO Friedrichshafen 2016 - "600kg myths and reality" Jan Fridrich / Jo Konrad ABOUT MYTH No 2: IT WILL AUTOMATICALLY APPLY TO ALL MICROLIGHTS! Drei Schritte der Umsetzung: Three Steps of Implementation: 1. Anhebung der Gewichtsgrenze im Annex I 1. Raising the weight limit in Annex I 2. Umsetzung in den nationalen Bestimmungen 2. Implementation within the national regulations 3. Ability and declared intention of the manufacturers of UL. AERO Friedrichshafen 2016 - "600kg myths and reality" Jan Fridrich / Jo Konrad ABOUT MYTH No 3: WE CAN FLY EVRYWHERE IN EU! Annex I bestimmt die nationale Zuständigkeit Annex I determines the national regime Im Gegensatz zu einer EASA-Zertifizierung gelten nationale Zulassungen als beschränkte Zulassungen. Unlike an EASA certification national approvals are considered as limited approvals. Dies gilt auch für die Lizenzen. This also applies to the licenses. That means, the operations are exclusively determined on national territory. For that matter we are always dependent on mutual recognition. AERO Friedrichshafen 2016 - "600kg myths and reality" Jan Fridrich / Jo Konrad ABOUT MYTH No 4: OPERATION OF LIGHTWEIGHT MICROLIGHT WILL BE COMPLICATED BY MORE BURDEN! The weight increase of gyroplanes in 2008 by the European institutions from 450 to 560 kg has brought no further conditions or restrictions. Why should it this time be like Wieso sollte das jetzt so sein? that? AERO Friedrichshafen 2016 - "600kg myths and reality" Jan Fridrich / Jo Konrad ABOUT REALITY No 1: IF IT WILL APPLY TO MICROLIGHTS IT DEPENDS ON EACH MEMBER STATES! According to the BR, the provisions of Annex I determine the competence of nations. First of all only the European cover is lifted. Die Nationen bestimmen die Umsetzung in nationales Recht. The nations determine the transposition into national law. AERO Friedrichshafen 2016 - "600kg myths and reality" Jan Fridrich / Jo Konrad ABOUT REALITY No 2: THE WAY FORWARD IS MUTUAL RECOGNITION! The only way to a Der einzige Weg für eine "Europeanisation" of the „Europäisierung“ der ULs über microlights across national Ländergrenzen hinweg ist die boundaries is the Mutual Gegenseitige Anerkennung von Recognition of Certifications, Zulassungen, Lizenzen und flugbetrieblichen Bestimmungen. Licenses and Flight Operation Regulations. AERO Friedrichshafen 2016 - "600kg myths and reality" Jan Fridrich / Jo Konrad ABOUT REALITY No 3: ALL THIS IS POSSIBLE IF THE “OPT-IN”WILL BE ALLOWED! Die Hersteller sollten wählen können, welchem System sie ihr Produkt zuordnen. The manufacturers should be able to choose which system they want to have their product in. Zum Annex I als UL in nationaler Zuständigkeit Annex I under national regime as a microlight Oder or Zum EASA-System mit Zulassung EASA-Certifcation as EU-LSA als EU-LSA AERO Friedrichshafen 2016 - "600kg myths and reality" Jan Fridrich / Jo Konrad ABOUT REALITY No 4: EASA-ROAD MAP FOR GENERAL AVIATION! Die EASA verspricht seit vielen Jahren eine bessere Regulierung der Allgemeinen Luftfahrt. Aktuelle wieder mit einer GA Road Map. Wenn die EASA nützliche Lösungen bietet wird es Zeit, sich ihr anzuschließen. Wir wollen aber eine schnelle und reale Lösung auf nationaler Ebene unter Verwendung bestehender UltraleichtflugzeugRegularien. The EASA keeps promising a better regulation of General Aviation for many years now. Currently by the means of a GA Road Map. When the EASA will come up with a useful solution it will be time to join them, but for now we do not want experiments, we want a quick solution which is practicable on national level using existing microlight systems. AERO Friedrichshafen 2016 - "600kg myths and reality" Jan Fridrich / Jo Konrad FOOTPRINTS BY NOW Sehr große Zustimmung zu dem Projekt bei Piloten und Huge support of the project by Pilots and Manufacturers (LAMA-EUROPE) Herstellern (LAMA-EUROPE) For the first time there was an expert meeting held in the Zum ersten mal fand ein Council. The representatives of Expertenmeeting im the countries have mostly Ministerrat statt. Die responded positively. Ländervertreter haben überwiegend positiv reagiert.
