Zmocnitel tímto zplnomocňuje
DOROTHEUM spol. s r.o., IČ: 270 79 716, se sídlem Ovocný trh 580/2, Praha 1,
PSČ: 110 00, dále jen „zmocněnec“,
aby zmocnitele zastupoval při aukci uměleckých předmětů, kterou organizuje zmocněnec
a která se bude konat dne 24. 9. 2016 v Radisson Blu Alcron Hotel Prague, Štěpánská 40,
Praha 1 (dále jen „aukce“), a to za podmínek uvedených v příloze č. 1 této plné moci (dále
jen „Podmínky účasti na aukci“). Zmocněnec je zmocněn ke všem úkonům, které souvisejí
se zastupováním zmocnitele jako účastníka aukce a také jako vydražitele.
Zmocnitel tímto prohlašuje, že je mu znám aukční řád, kterým se aukce řídí, jakož
i Podmínky účasti na aukci, a bez výhrad s nimi souhlasí.
Předměty aukce, u nichž vyvolávací cena je nižší než 10 tis. Kč, je možné dražit pouze na
základě písemného limitu nebo účastníkem aukce přítomným v sále.
Zmocnitel bere na vědomí, že zmocněnec je oprávněn si za sebe ustanovit zástupce.
Pokud si zmocněnec ustanoví zástupců více, souhlasí zmocnitel s tím, aby každý z nich
jednal samostatně.

Příloha č. 1 plné moci – Podmínky účasti na aukci
Zmocnitel je povinen udělit zmocněnci pokyny (předat plnou moc) nejpozději 3 hodiny
před začátkem aukce. Zmocnitel je povinen oznámit udělení plné moci zmocněnci e-mailem
na: [email protected] nebo faxem na č. 224 222 011.
Zmocnitel bere na vědomí, že za každý předmět koupený v aukci je povinen uhradit
zmocněnci aukční poplatek ve výši stanovené v aukčním řádu, tj. 20 % z kupní ceny každého
předmětu aukce, který v aukci koupil, není-li u předmětu aukce uvedeno jinak.
Zmocnitel bere na vědomí, že předmět aukce musí být v tabulce plné moci jednoznačně
určen katalogovým číslem a stanoven u něj nákupní limit v Kč odpovídající tarifu příhozů
nebo stanovena možnost udílet pokyny telefonem. Předměty aukce, u nichž vyvolávací
cena je nižší než 10 tis. Kč, je možné dražit pouze na základě písemného limitu nebo
účastníkem aukce přítomným v sále.
Zmocnitel bere na vědomí, že zmocněnec je oprávněn odmítnout přijetí plné moci,
případně plnou moc přijmout jen v omezeném rozsahu. Na tuto skutečnost zmocněnec
zmocnitele uvědomí bez zbytečného odkladu poté, co se o udělené plné moci dozví.
Zmocněnec je oprávněn překročit nákupní limit u jednotlivého předmětu aukce na částku
dalšího (vyššího) podání, pokud se nákupní limit stanovený zmocnitelem nachází v rozmezí
mezi dvěma podáními, a to tak, aby nákupní limit odpovídal možnému podání dle aukčního
řádu a aukčního katalogu.
Identifikaci a kontrolu účastníka aukce ve smyslu zákona č. 253/2008 Sb.
za DOROTHEUM spol. s r.o. provedl:
Bude-li na tentýž předmět aukce udělena zmocněnci plná moc s nákupním limitem ve stejné
výši od více účastníků aukce, zmocněnec přednostně přijme tu plnou moc, jejíž udělení mu
bylo oznámeno dříve.
V případě stanovení nákupního limitu nesmí cena dosažená v aukci (sjednaná kupní cena
předmětu aukce) bez aukčního poplatku přesáhnout nákupní limit stanovený zmocnitelem
u daného předmětu aukce.
V případě udílení pokynů telefonem je zmocněnec ohledně nákupního limitu vázán pouze
pokyny zmocnitele, které obdrží telefonicky v průběhu aukce. Pokud se v průběhu aukce
nepodaří zmocněnci navázat se zmocnitelem telefonické spojení, a to bez ohledu na důvod,
potom zmocněnec není oprávněn pokračovat v aukci toho předmětu aukce, u kterého tato
skutečnost nastala. Výlučně zmocnitel je odpovědný za pokyny, které uděluje zmocněnci.
V rámci zmocnění k zastupování zmocnitele při aukci každého předmětu aukce je
zmocněnec jménem zmocnitele zejména oprávněn:
– přihlásit se do aukce jako účastník aukce (kupující),
– přijmout aukční řád,
– v aukci činit nabídky na koupi předmětu aukce.
Zmocnitel bere na vědomí, že v případě vývozu předmětů koupených v aukci mimo území
České republiky, nezajišťuje zmocněnec na území státu, kam jsou předměty koupené v aukci
dováženy, žádné úkony a záležitosti spojené s jejich dovozem, a to zejména daňové a celní,
a že veškeré tyto záležitosti je povinen zmocnitel zajistit samostatně a na své náklady.
V rámci udělené plné moci zmocnitel dále zmocňuje zmocněnce, aby zaslal předměty
koupené v aukci na adresu zmocnitele a/nebo na jinou ze strany zmocnitele určenou
adresu, a to poté, co budou splněny podmínky jejich odevzdání vydražiteli uvedené
v aukčním řádu. Zmocniteli bude účtována cena za přepravu dle aktuálních ceníků
smluvních přepravců zmocněnce + 500 Kč za vyřízení povolení k vývozu do zahraničí za
každý jednotlivý předmět aukce (poplatek externí instituci).
Právní vztahy vyplývající z této plné moci se řídí českým právem.

To represent the Principal in an auction of artistic items organised by the Agent, which is
to be held on 24. 9. 2016 at the Radisson Blu Alcron Hotel Prague, Štěpánská 40, Prague 1
(hereinafter referred to as the “Auction”), subject to the conditions set out in Appendix 1
to this Power of Attorney (hereinafter referred to as the “Conditions for Participating in an
Auction”). The Agent is empowered to engage in any actions related to representing the
Principal as an auction participant and as the successful bidder.
The Principal hereby declares that it is familiar with the Auction Rules governing the Auction
and with the Conditions for Participating in an Auction, and agrees with them without
reservation.
Bidding on auction items whose upset price is lower than CZK 10,000 may only be done on
the basis of a written limit or by an auction participant who is present in the hall.
The Principal understands that the Agent may appoint a representative for itself.
If the Agent appoints more than one representative, the Principal agrees to each of them
acting independently.

Appendix 1 to the Power of Attorney –
Conditions for Participating in an Auction
The Principal shall give the Agent instructions (provide the power of attorney to it)
no later than 3 hours before the start of the auction. The Principal shall inform the Agent
of the granting of a power of attorney by e-mail at: [email protected] or by fax
at 224 222 011.
The Principal understands that each auction item must be clearly designated in a table in
its power of attorney by means of its catalogue number, and a purchasing limit in CZK
must be set for it that corresponds to the rate of bidding increments, or permission must
be granted to give instructions over the telephone. Bidding on auction items whose upset
price is lower than CZK 10,000 may only be done on the basis of a written limit or by an
auction participant who is present in the hall.
The Agent may exceed the purchase limit for an auction item to the amount of the next
(higher) bid, if the purchase limit set by the Principal is between two bids, such that the
purchase limit would correspond to a bid that is possible according to the auction rules and
auction catalogue.
If several auction participants have granted powers of attorney specifying the same
purchase limit for the same auction item, the Agent shall accept that power of attorney
whose granting was made known to it first.
If a purchase limit is set, the price achieved in the auction (the agreed purchase price of the
auction item), exclusive of the auction fee, must not exceed the purchase limit set by the
Principal for the given auction item.
If instructions are given over the telephone, the Agent shall only be bound by those
instructions of the Principal that it receives over the telephone during the auction
as concerns the purchase limit. If the Agent does not successfully initiate telephone
contact with the Principal during the auction, regardless of the reason, the Agent shall
not be authorised to carry on in bidding for that auction item with respect to which the
circumstance has arisen. The Principal shall bear sole responsibility for the instructions
given to the Agent.
Under the authorisation to represent the Principal in the auction of each individual auction
item, the Agent shall be entitled to do primarily the following on behalf of the Principal:
– Register for the auction as an auction participant (purchaser);
– Accept the Auction Rules;
– Make bids to purchase an auction item during the auction.
The Principal understands that in the case of the export of items purchased in an auction
outside of the Czech Republic, the Agent does not arrange any actions in the territory of the
country to which the items purchased in an auction are exported, or any matters related
to their import, in particular tax or customs issues, and that all such matters must be taken
care of by the Principal separately, at its own expense.
In the power of attorney, the Principal also empowers the Agent to send the items
purchased in the auction to the Principal’s address and/or to any other address that the
Principal designates, once the conditions for their hand-over to the successful bidder, as
stipulated in the Auction Rules, are met. The Principal shall be charged the cost of carriage
based on the current list of tariffs of the Agent’s contractual carriers plus CZK 500 for the
arrangement of an export permit for every individual auction item (fee charged by an
external institution).
The Principal understands that, for each item purchased in the auction, it is obliged to pay
to the Agent an auction fee in the amount stipulated in the auction rules, i.e., 20% of the
purchase price of each auction item purchased in the auction, unless otherwise specified
with respect to the particular auction item.
The Principal understands that the Agent may refuse to accept the power of attorney
or only accept it to a limited extent. The Agent shall inform the Principal about that fact
without undue delay of having learned of the granting of the power of attorney.
The legal relations arising from this power of attorney shall be governed by the laws
of the Czech Republic.

damit er den Vollmachtgeber bei der Auktion von Kunstgegenständen vertritt, die der
Bevollmächtigte organisiert, und die am 24. 9. 2016 im Radisson Blu Alcron Hotel Prague,
Štěpánská 40, Prag 1 (im Folgenden nur „Auktion“) stattfinden wird, und das unter den
Bedingungen, die in Anlage Nr. 1 dieser Vollmacht aufgeführt sind (im Folgenden nur
„Teilnahmebedingungen an der Auktion“). Der Bevollmächtigte ist zu allen Geschäften
bevollmächtigt, die mit der Vertretung des Vollmachtgebers als Teilnehmer der Auktion und
auch als Ersteigerer zusammenhängen.
Der Vollmachtgeber erklärt hiermit, dass ihm die Auktionsordnung, nach der sich die
Auktion richtet, sowie auch die Teilnahmebedingungen an der Auktion bekannt sind, und er
stimmt ihnen vorbehaltlos zu.
Die Gegenstände der Auktion, bei denen der Ausrufpreis niedriger als 10 Tsd. CZK ist, kann
man nur auf der Grundlage eines schriftlichen Limits oder durch einen Auktionsteilnehmer,
der im Saal anwesend ist, ersteigern.
Der Vollmachtgeber nimmt zur Kenntnis, dass der Bevollmächtigte berechtigt ist, für sich
einen Vertreter einzusetzen. Wenn der Bevollmächtigte mehrere Vertreter einsetzt, stimmt
der Vollmachtgeber zu, dass jeder von ihnen selbständig handelt.

Anlage Nr. 1 der Vollmacht –
Teilnahmebedingungen an der Auktion
Der Vollmachtgeber ist verpflichtet, dem Bevollmächtigten die Anweisungen (die
Vollmacht zu übergeben) spätestens 3 Stunden vor Beginn der Auktion zu erteilen. Der
Vollmachtgeber ist verpflichtet, dem Bevollmächtigten die Erteilung der Vollmacht per
E-Mail an: [email protected] oder per Fax an der Nr. 224222011 mitzuteilen.
Ausfuhr verbunden sind sicherstellt, und zwar insbesondere Steuer- und Zollverrichtungen,
und dass diese Angelegenheiten der Vollmachtgeber selbständig und auf seine Kosten
sicherzustellen verpflichtet ist.
Der Vollmachtgeber nimmt zur Kenntnis, dass der Gegenstand der Auktion in der
Tabelle der Vollmacht eindeutig durch die Katalognummer bestimmt sein muss und
das Einkaufslimit in CZK festgelegt sein muss, das dem Tarif der Zuschläge entspricht,
oder die Möglichkeit festgelegt sein muss, die Anweisungen per Telefon zu erteilen. Die
Auktionsgegenstände, bei denen der Ausrufpreis niedriger als 10 Tsd. CZK ist, kann man
nur auf der Grundlage eines schriftlichen Limits oder durch den bei der Auktion im Saal
anwesenden Teilnehmer ersteigern.
Im Rahmen der erteilten Vollmacht bevollmächtigt der Vollmachtgeber den
Bevollmächtigten damit, dass er die in der Auktion gekauften Gegenstände an die Adresse
des Vollmachtgebers und/oder an eine andere von Seiten des Vollmachtgebers bestimmte
Adresse sendet, und das anschließend, nachdem die Bedingungen ihrer Übergabe an den
Ersteigerer, die in der Auktionsordnung aufgeführt sind, erfüllt sind. Dem Vollmachtgeber
wird der Preis für den Transport gemäß den aktuellen Preislisten der Spediteure des
Bevollmächtigten + 500 CZK für die Erledigung der Genehmigung zur Ausfuhr ins Ausland
für jeden einzelnen Auktionsgegenstand (Gebühr für die externe Institution) berechnet.
Der Bevollmächtigte ist berechtigt, das Einkaufslimit bei einem einzelnen
Auktionsgegenstand auf den Betrag einer weiteren (höheren) Gebotsabgabe zu
überschreiten, insofern das Einkaufslimit, das durch den Vollmachtgeber festgelegt ist,
sich zwischen zwei Offerten befindet, und zwar so, damit das Einkaufslimit der möglichen
Gebotsabgabe gemäß der Auktionsordnung und dem Auktionskatalog entspricht.
Der Vollmachtgeber nimmt zur Kenntnis, dass er verpflichtet ist, für jeden in der
Auktion gekauften Gegenstand dem Bevollmächtigten die Auktionsgebühr, die in der
Auktionsordnung festgelegt ist, d.h. 20 % vom Kaufpreis von jedem Auktionsgegenstand,
den er in der Auktion gekauft hat, zu erstatten, insofern beim Auktionsgegenstand nicht
etwas anderes aufgeführt ist.
Wenn dem Bevollmächtigten für den gleichen Auktionsgegenstand eine Vollmacht mit
einem Einkaufslimit in der gleichen Höhe von mehreren Auktionsteilnehmern erteilt wird,
nimmt der Bevollmächtigte diejenige Vollmacht vorrangig an, deren Erteilung ihm früher
mitgeteilt wurde.
Der Vollmachtgeber nimmt zur Kenntnis, dass der Bevollmächtigte berechtigt ist, die
Annahme einer Vollmacht abzulehnen, gegebenenfalls die Vollmacht nur im begrenzten
Umfang anzunehmen. Auf diese Tatsache weist der Bevollmächtigte den Vollmachtgeber
ohne überflüssigen Verzug danach hin, nachdem er von der erteilten Vollmacht erfährt.
Im Fall der Festlegung des Einkaufslimits darf der Preis, der in der Auktion erreicht
wird (vereinbarter Kaufpreis des Auktionsgegenstandes) ohne Auktionsgebühr das
Einkaufslimit, das vom Vollmachtgeber beim gegebenen Auktionsgegenstand festgelegt
wurde, nicht überschreiten.
Die Rechtsbeziehungen, die aus dieser Vollmacht hervorgehen, richten sich nach dem
tschechischen Recht.
Im Fall der Erteilung von Anweisungen per Telefon ist der Bevollmächtigte bezüglich des
Einkaufslimits nur an die Hinweise des Vollmachtgebers gebunden, die er telefonisch im
Verlauf der Auktion erhält. Wenn es dem Bevollmächtigten im Verlauf der Auktion nicht
gelingt, mit dem Vollmachtgeber eine telefonische Verbindung aufzunehmen, und das
ohne Rücksicht auf den Grund, ist der Bevollmächtigte danach nicht berechtigt, in der
Auktion dieses Auktionsgegenstandes fortzufahren, bei der diese Tatsache eintrat. Der
Vollmachtgeber ist ausschließlich für die Hinweise, die er dem Bevollmächtigten mitteilt,
verantwortlich.
Im Rahmen der Bevollmächtigung zur Vertretung des Vollmachtgebers bei der Auktion
von jedem Auktionsgegenstand ist der Bevollmächtigte im Namen des Vollmachtgebers
insbesondere berechtigt:
– sich zur Auktion als Auktionsteilnehmer (Käufer) anzumelden,
– die Auktionsordnung anzunehmen,
– in der Auktion Angebote für den Kauf des Auktionsgegenstandes abzugeben.
Der Vollmachtgeber nimmt zur Kenntnis, dass im Fall der Ausfuhr der Gegenstände,
die in der Auktion gekauft werden, außerhalb des Gebiets der Tschechischen Republik,
der Bevollmächtigte auf dem Gebiet des Staates, wohin die in der Auktion gekauften
Gegenstände ausgeführt werden, keine Verrichtungen und Angelegenheiten, die mit ihrer
