Dokumentární inkaso
Podpisem tohoto příkazu příkazce přijímá následující podmínky Citibank:
1. Citibank přijímá pouze k předání a na riziko příkazce položky nesplatné v Citibank a neodpovídá za žádné ztráty nebo prodlení, která
mohou být způsobena stávkou nebo jinými okolnostmi mimo kontrolu Citibank, ani za žádná jednání, opomenutí, zanedbání, prodlení,
selhání nebo nesolventnost jakéhokoliv korespondenta nebo agenta či jejich zaměstnanců, ani za ztráty či zpoždění v přenosu dat.
2. U položek, které nebudou proplaceny během obvyklé doby budou účtovány zvláštní výlohy.
3.Nebude-li uvedeno jinak, všechny výlohy budou požadovány od plátce, ale budou-li odmítnuty, budou sraženy z výtěžku. Jestliže
vzniknou po zaplacení korespondentovi Citibank oprávněné výlohy spojené s proclením zboží nebo jiné výlohy vynaložené v zájmu
příkazce, takové výlohy půjdou k tíží příkazce.
4. Inkaso se řídí Všeobecnými obchodními podmínkami Citibank a také podmínkami korespondentů a agentů Citibank a dále právními
předpisy platnými v zemích, kterých se to týká.
5. Citibank bude postupovat s náležitou péčí při volbě svých agentů, avšak určí-li si příkazce jiného korespondenta, než který byl vybrán
Citibank, bude Citibank postupovat v souladu s instrukcemi příkazce za předpokladu, že příkazce přijme a potvrdí všechna jednání
vybraného korespondenta. V takovém případě se příkazce zavazuje odškodnit Citibank za veškeré následky z tohoto jednání.
6. Jakékoli jednání či opomenutí učiněné nebo strpěné Citibank či jejími korespondenty podle tohoto příkazu nebo v souvislosti s ním
učiněné v dobré víře a v souladu s platnými právními předpisy obchodními zvyklostmi a pravidly bude závazné pro příkazce a nevzejde
z nich žádná odpovědnost Citibank vůči příkazci.
Documentary Collections
By signing this application the drawer hereby accepts the following conditions of Citibank:
1. Citibank accepts for transmission only and at your risk and at the risk of the drawer items not payable at Citibank and Citibank will not be
responsible for any losses or delays which may be caused by strike or other causes beyond the control of Citibank nor for any act, omission,
neglect, default, failure or insolvency of any correspondent or agent or their employees or delays occurring in the course of transmissions.
2. An extra charge will be made on items not paid within the normal period.
3. Unless otherwise indicated all charges will be claimed from the drawee, but if refused they will be deducted from the proceeds paid. In case
the Citibank‘s correspondents shall incur charges arising from clearing the goods or otherwise protecting the interests of the drawer, such
charges will be for the account of the drawer .
4. Collections are subject to the General Business Conditions of Citibank and also the conditions of the Citibank‘s correspondents and agents
as well as the laws and regulations valid in the countries concerned.
5. Citibank shall exercise due diligence in the selection of its agents, however in the event the drawer shall designate a correspondent other than
the one selected by Citibank, Citibank shall follow the instructions of the drawer, provided that the drawer shall assume and confirm all the
acts of such correspondent of his own choosing. In such case the drawer shall hold Citibank harmless from all consequences thereof.
6. Any act or omission taken or suffered by Citibank or by any of Citibank‘s correspondents under or in connection with this application, if in
good faith and conformity with laws and regulations or customs applicable thereto, shall be binding upon the drawer and shall not result in
any liability of Citibank to the drawer.
